1. These Regulations may be cited as the Tourist Agents Regulations.
2. In these Regulations, unless the context otherwise requires–
"licence" means a licence granted under the Tourists Agents (Licensing) Act *;
"Schedule" means a schedule to these Regulations.
3. An application for the grant of a licence or for the variation of a licence shall be made in the form given in the First Schedule.
4. Every licence shall be in the form given in the Second Schedule and shall be subject to the terms and conditions specified in the licence.
5. The business of tourists agents shall be classified as class A or class B according to the classification given in the Third Schedule.
6. The fees prescribed in the Fourth Schedule shall be payable in respect of the licences and variation of licences.
7. Every appeal against an order of the Licensing Authority refusing to grant a licence, or revoking a licence or imposing conditions on a licence or varying any conditions already imposed shall be in writing and shall be lodged with the Minister within thirty days of the date of such order, unless the Minister having regard to the circumstances of any case extends the said period.

Any person guilty of an offence under this Act or under any regulations made under the Act shall, unless some other penalty has been prescribed, be liable on conviction to a fine not exceeding Shs. 5,000/- or to imprisonment for a term not exceeding one year or to both such fine and imprisonment. |

THIRD SCHEDULE
CLASSIFICATION OF TOURISTS AGENTS BUSINESS
CLASS A LICENCE
The business of the following categories of tourist agents (whether carried on alone or in conjunction with some other enterprise) connected with the tourist industry in Tanzania (other than the exempted tourist agents), shall be classified as Class A: |
1. Proprietors, owner-drivers and self-employed drivers of passenger vehicles used wholly or partly in a tourist agent's business. |
2. Tour or safari operators. |
3. Safari outfitters. |
4. Motor-vehicle-hire enterprises offering tour transport facilities, whether self-driven or chauffeur-driven. |
5. Big-game-fishing outfitters and operators. |
6. Proprietors of safari, hunting or sight-seeing lodges and proprietors of tented camps catering for tourists. |
7. Travel bureaux or booking offices which (alone or with other business) offer tours or safaris other than those of an air line which operates international air tours and does not carry on any tourist activities in Tanzania. |
8. Professional safari photographers. |
CLASS B LICENCE
The business of the following categories of tourist agents (whether carried on alone or in conjunction with some other enterprises) connected with the tourist industry in Tanzania (other than the exempted tourist agents), shall be classified as Class B: |
1. Professional hunters. |
2. Persons letting out vessels, whether manned or not. |
3. Proprietors of enterprises offering camps and camping equipment for hire. |
4. Professional and self-employed guides and couriers. |
5. Any other business of a tourist agent not otherwise classified. |
CLASS C LICENCE
The business of the following categories of tourist agents (whether carried on alone or in conjunction with some other enterprises) connected with the tourist industry in Tanzania (other than the exempted tourist agents), shall be classified as Class C: |
1. Tourist hotels. |
2. Exclusive clubs. |
3. Unclassified hotels. |
CLASS D LICENCE
The business of the following categories of tourist agents whether carried on alone or in conjunction with some other enterprises) connected with the tourist industry in Tanzania (other than the exempted tourist agents), shall be classified as Class D: |
Curio shops. |

1. These regulations may be cited as the Tourist Agents (Licensing) Regulations, and shall be read as one with the Tourist Agents (Licensing Regulations), 1969.
2. The Applicant must satisfy the Licensing Authority's following conditions:
I. Tour Operator
If the applicant is a citizen of the United Republic, he/she must submit the following:
(a) A Certificate of Regulation and Memorandum and Articles of Association of the Company registered in Tanzania.
(b) He must have suitable office premises for carrying out the business of tour operator.
(c) He must have a fleet of not less than five road worthy vehicles. The vehicles must not be more than five years old since first registration. The vehicles must be registered under the Company's business name.
(d) All tour vehicles must be comprehensively insured.
(e) All tour vehicles shall vividly display in writing the name of the Tour Operator on each side of the vehicle. Stickers shall not be allowed.
(f) All tour vehicles shall vividly display the TALA Licence on the vehicle subject for inspection.
II. Requirements for Tour Operator licences
Companies applying for Tour Operator licences but not owned fully by Tanzanians will have to meet the requirements stipulated under section 1(a), (b), (d), (e) and (f) mentioned herein and in addition must satisfy the following conditions before being issued with a Tour Operator Licence:
Have a fleet of new vehicles (not less than ten vehicles) of a type approved for tour business by the Licensing Authority. The vehicles must be registered under the name of the company/business name.
III. Car Hire
Car Hire Licence will be issued to companies owned by Tanzanian nationals only.
IV. Travel Agent
A Travel Agent Licence will be issued to business firms which are 100% Tanzanian owned.
The Travel Agent must satisfy all the regulations under item 1(a) and (b) mentioned herein above and must also satisfy the following requirement:
The applicant must have not less than two employees who are Tanzanian nationals and who have recognized certificates in tourism i.e. IATA recognized Certificates/Diplomas.
V. Mountain Climbing/Trekking
Mountain Climbing/Trekking Licences will be issued to business firms which are 100% Tanzanian owned.
VI. Hunting Safaris
All applicants must fulfil all the conditions stated in section I(a) and (b) mentioned herein above. The ownership of hunting facilities by applicants will be considered/taken into account. The applicants must comply with all the regulations issued by the Directorate of Wildlife from time to time.
VII. Tour Guides
(a) Tour guides must be Tanzanian nationals.
(b) They must be holders of a certificate recognized by the Tourist Agents Licensing Authority and must have adequate experience reasonably required in this profession.
Applicants who are non-citizens but who are professionals with not less than ten years' experience may forward their applications through their employers' companies. Such applications may be considered.
VIII. Other conditions of application
For applicants of other tourism-related business the conditions of application will be those that will be issued by the Ministry or such other relevant Authorities.
IX. Reports regarding disaster or disruption
The licensee shall report in writing to the Licensing Authority:
(a) any occurrence which brings death or injury to a tourist(s);
(b) any major disruption of the itinerary of a tourist, being a tourist taking part in a tour with which the licensee is concerned.
X. Promotion and Marketing Plans
It is a requirement that each Tour Operator provides a Promotion and Marketing Plan plus budget to the Authority before consideration of his application.
XI. Non-citizens to apply to Authority Secretariat
For all non-citizen employees in the sector applying for Work Permit/Resident Permit, should channel their applications through the Authority Secretariat.
XII. Licensing fees
Tourist Agents licensing fees may be changed at any time without prior notice to the Tourist Agents.
All the above licences will be issued depending on the various existing regulations of the Government Authorities. {/mprestriction}
