PUBLIC RECREATION GROUNDS ACT

BY-LAWS
(Section 7)
G.N. No. 176 of 1961
1. Citation
These By-laws may be cited as the Mwanza Municipality (Recreation Grounds) By-laws, and shall apply to the recreation grounds specified in the Schedule.
2. Interpretation
In these By-laws–
"Council" means the Mwanza Municipal Council;
"recreation grounds" means any of the recreation grounds (or sports stadia) specified in the Schedule;
"vehicle" means motor vehicle, cart, carriage, perambulator, bicycle or motor bicycle.
3. Acts by Council's officers or servant
An act performed in a recreation ground by an officer or servant of the Council in the proper execution of his duty shall not be an offence against these By-laws.
4. Damage to recreation ground or buildings
No person shall in a recreation ground–
(a) soil, deface or destroy any building, barrier, railing, post, seat, erection, ornament, or any wall or fence in or enclosing a recreation ground;
(b) climb any wall or fence in or enclosing a recreation ground, or any tree, barrier, railing, post or other erection;
(c) remove or displace any barrier, railing, post, seat, or any part of any erection or ornament, or any implement provided for use in the laying out or maintenance of a recreation ground.
5. Prohibition of cattle
No person shall bring or cause to be brought into a recreation ground any cattle, sheep, goats, pigs, or any beast of draught or burden, except in pursuance of an agreement with the Council, or in the exercise of any lawful right or privilege.
6. Prohibition of vehicles
No person shall bring or cause to be brought into a recreation ground any vehicle:
Provided that this By-law shall not apply to–
(a) vehicles of a recognised type intended for the conveyance of children or invalids; and
(b) vehicles for the use of which a place is set apart by the Council.
7. Restriction of vehicles
No person shall in a recreation ground drive, ride, wheel or station a vehicle over upon–
(a) any flower bed, shrub, or plant, or any ground in course of preparation as a flower bed or for the growth of any tree, shrub, or plant;
(b) any portion of a recreation ground prohibited by the Council by a notice board affixed or set up in a conspicuous position.
8. Bill posting
No person shall affix any bill, placard, or notice, to or upon any tree, plant, building, barrier, railing, seat, erection, ornament or any wall or fence in or enclosing a recreation ground.
9. Protection of grass and plants
No person shall in a recreation ground enter–
(a) any place where entry is prohibited by notice placed thereon;
(b) any flower bed, shrub, or plant, or any ground in course of preparation as a flower bed or for the growth of any tree, shrub, or plant.
10. Damage to grass and plants
No person shall in a recreation ground–
(a) remove, cut, or displace any soil, turf, plant or tree;
(b) pluck any bud, blossom, flower, or leaf of any tree, shrub, or plant;
(c) throw or discharge any missile to the damage or danger of any person.
11. Admission charge
Where a charge is made for admission of the public to a recreation ground no person entering such recreation ground shall refuse or neglect to pay such charge.
12. Dogs
No person shall cause, suffer or permit any dog belonging to him or in his charge to enter or remain in a recreation ground, unless such dog is under proper control, and effectually restrained from causing annoyance or disturbance to any person, animal or water-fowl, or entering any ornamental water.
13. Specified games
Where the Council has set apart a portion of a recreation ground by a notice board affixed or set up in a conspicuous position therein, for the purpose of a game specified in the notice board, no person shall elsewhere in such recreation ground play or take part in such game.
14. Unfit ground
No person shall in any portion of a recreation ground play or take part in any game when the state of the ground makes it unfit for use or a notice prohibiting play is set up in a conspicuous position.
15. General prohibitions
No person shall in a recreation ground–
(a) erect any post, rail, fence, pole, tent, booth, stand, building or other structure without first obtaining permission in writing from the Council which, in granting such permission, may impose such conditions as it considers appropriate;
(b) beat, shake, sweep, brush, or cleanse any carpet, rug, mat, or any other fabric retaining dust or dirt;
(c) wash clothing or other material or hang, spread, or deposit any linen or other fabric for drying or bleaching;
(d) sell, offer or expose for sale, or let to hire, or offer or expose for letting to hire, any commodity or article, excepting in pursuance of an agreement with the Council, or in the exercise of any lawful right or privilege;
(e) deposit litter or refuse, except in litter bins provided therefor.
16. Annoyances and obstructions
No person shall in a recreation ground wilfully obstruct, disturb, interrupt, or annoy any other person in the proper use of the recreation ground, or wilfully obstruct, disturb, or interrupt any officer of the Council in the proper execution of his duty, or any person or servant of any person employed by the Council in the proper execution of any work in connection with the laying out or maintenance of the recreation ground.
17. Penalty
Any person who shall contravene or fail to comply with any of these By-laws commits an offence and on conviction shall be liable to a fine not exceeding one hundred shillings.
18. Removal of offenders
Any person who shall infringe any of these By-laws may be removed from a recreation ground by any officer of the Council.

1. These By-laws may be cited as the Tukuyu Recreation Grounds By-laws.
2. Any person who rides a bicycle on such part of the recreation grounds where the riding of bicycles has been prohibited by public notice erected by the Executive Officer of the Municipal Authority or by his agent commits a breach of these By-laws and shall on conviction be liable to a fine not exceeding forty shillings.
3. Any person who grazes cattle or knowingly causes or permits a person to graze cattle in the Tukuyu Recreation Grounds without the permission in writing of the Executive Officer, Tukuyu Municipal Authority, commits a breach of the By-laws and shall on conviction be liable to a fine not exceeding one thousand shillings.

1. Citation
These By-laws may be cited as the Moshi Municipality (King George VI Playing Fields) By-laws.
2. Interpretation
In these By-laws unless the context otherwise requires–
"Council" means the Municipality Council;
"King George VI Playing Fields" means all that area within the Moshi Municipality described in the Schedule to the Public Recreation Grounds Order.
3. Open hours
The King George VI Playing Fields shall be open to the public each day, including Sundays, from the hours of 9 a.m. to 7.15 p.m., provided that these days and times may be varied by the Council when the good management and control of the King George VI Playing Fields so require. The days and times during which the King George VI Playing Fields shall be open to the public shall be displayed on a Notice Board at the main entrance to the King George VI Playing Fields on Kingsway.
4. Sale of goods
No person shall sell, or expose, or offer for sale on the King George VI Playing Fields any goods of any kind whatsoever without a permit in writing from the Council, given under the hand of the Town Clerk, authorising him to do so.
5. Offences
A person shall not do any of the following acts in the King George VI Playing Fields–
(a) enter or remain therein during the time the King George VI Playing Fields are closed to the public;
(b) enter or depart except by the main entrance on Kingsway;
(c) cut, pluck, injure, or destroy any tree, sapling, shrub or bush;
(d) dig, cut, displace, or remove any turf, gravel, or any other substance;
(e) light any fire or wilfully, carelessly, or negligently any act which may cause, or be likely to cause a fire;
(f) cause or suffer any sheep, goat or any other animal belonging to him, except a dog, or dogs, under his control, to enter or go therein, except in pursuance of some lawful right or privilege;
(g) affix, paint, or post any bill, placard, or notice, or erect any structure without the written permission of the Council;
(h) damage wilfully any building or structure placed by, or by the authority of, the council;

(i) wilfully, carelessly, or negligently, throw or deposit any filth, rubbish, refuse or other substance or material.
6. Regulation of Games
Where the Council have set apart any portion of the King George VI Playing Fields for any game or athletic sport, persons concerned shall comply with those requirements as to times of play which may be fixed by the Council, when the good management and control of the King George VI Playing Fields so requires. When such times for play have been fixed by the Council, notification shall be displayed on a notice set up in some conspicuous place in the King George VI Playing Fields.
7. Employees
Nothing in these By-laws shall interfere with or prevent the carrying on of the work or supervision of the King George VI Playing Fields by the employees of the Council.
8. Parking
Motor Vehicles parking in the King George VI Playing Fields must use only those parking places as are indicated by a parking sign erected by the Council.
9. Speed limit
Motor Vehicles shall not travel on the King George VI Playing Fields at a speed exceeding 10 miles per hour.
10. Penalties
Every person who offends against any provision of the foregoing By-laws shall be liable for every such offence to a penalty not exceeding one hundred shillings.

1. This Order may be cited as the Public Recreation Grounds Order.
2. Each of the areas of public land described in the Schedule has been declared to be a public recreation ground for the purposes of the Public Recreation Grounds Act.
SCHEDULE
ARUSHA MUNICIPALITY
All that piece of land being 6.88 acres in extent shown delineated in red on Plan D.>
All that area of land within the Municipality of Arusha amounting to 4.5 acres and contained by a succession of straight line boundaries commencing at survey beacon EB 479 then passing in turn through survey beacons EB 477, EB 475, EB 474, EB 444, EB 496, EB 495 and EB 494; thence, in the direction of survey beacon EB 493, to the furrow; thence by a curvilinear boundary following the furrow to its intersection with the straight line joining survey beacons EB 479 and EB 480; thence by a straight line to survey beacon EB 479, more particularly defined as the area edged blue on registered plan No. 9794, deposited with the Ministry of Lands *.
All that area of land within the Municipality of Arusha amounting to 3.089 acres, contained by a succession of straight line boundaries commencing at survey beacon EB 440, then passing in turn through survey beacons EB 441, EB 442, EC 969, EC 970, EB 862 and thence to survey beacon EB 440, more particularly defined as the area edged green on registered plan No. 11833, deposited with the Survey Division of the Ministry of Lands.
All that area of land within the Municipality of Arusha amounting to 3.945 acres, contained by a succession of straight line boundaries commencing at survey beacon EB 461, then passing in turn through survey beacons V 920, V 919, EB 467, V 915, EB 466, EB 469, EB 471, EB 472, EA 772, EA 771, EB 448, EA 865, EB 447, EB 438, EB 437 and thence to survey beacon EB 461, more particularly defined as the area edged in blue on registered plan No. 13399, deposited with the Ministry of Lands *.
BUKOBA TOWN
All that area of land amounting to 10.43 acres contained by a succession of straight line boundaries commencing at boundary beacon V.92, then passing in turn through boundary beacons DB639, V.85, V.84, V.37, GD.238, GD.239, DB.95, DB.18, 27SE, 27NE, DA.2, 32SW, 32NW, D.1221, D.1220, 41NE, V.90, V.91, and thence to V.92, more particularly defined as the area edged blue on Registered Plan No. 9465, deposited with the Ministry of Lands *.
DAR ES SALAAM CITY
All that piece or parcel of land situated at Mnazi Mmoja between Kisarawe Street and Bagamoyo Street and shown coloured green on Plan No. D'223/E (Registered Plan No. 13381), deposited with the Director, Department of Lands and Surveys *.
All that area of land comprising approximately one hundred and three acres shown edged in green excluding the roads marked in red, the area of the Gymkhana Club edged in blue and the Pumping Station site coloured brown on the Registered Plan No. 11040 and also excluding *–
(a) all that piece of land in the Golf Course Area of Ghana Avenue, Dar es Salaam City being approximately 10.89 acres in extent and bounded by beacons AP. 826-AP. 831 AQ. 160, AP. 832, AG. 159, AP. 833, AP. 834, CB. 6, CB. 7, AK. 554, AK. 553, AR. 591, AK. 552 and AP. 851, the whole as delineated on Registered Plan No. 14953;
(b) the Areas of the "Nyumba ya Sanaa", Danish Embassy and the Sheraton Hotel Site as shown respectively on Plan No. D'583, D'588/5 and D'336/4 (Registered Plan No. 25514) all deposited at the Office of the Director of Surveys and Mapping Division of the Ministry of Lands.
The land contained by a succession of straight line boundaries commencing at boundary beacon No. AH485 then passing in turn through boundary beacons AH486, AH510, AH513 and then to AH485 as delineated in red and marked "Public Recreation Ground No. 1" on registered plan No. 12870, deposited with the Survey Division of the Ministry of Lands *.
The land contained by a succession of straight line boundaries commencing at boundary beacon No. AH480 then passing in turn through boundary beacons AH481, AH491, IPC"A", IPC"B", IPC"C", IPC"D", IPC"E", IPC"F", AH490, AH489, AH492 and thence to AH480, as delineated in red and marked "Public Recreation Ground No. 2" on registered plan No. 12870.
Note- The effect of this order is to excise from the Mnazi Mmoja public recreation ground land required for a Nursery School and the National Assembly Building *.
DODOMA MUNICIPALITY
All that piece or parcel of land approximately 9.65 acres in extent situated at Dodoma and contained within survey beacons HD.50, HD.54, HD.53, HD.52 and HD.51, delineated in red on Registered Plan No. 10402, held by the Chief Surveyor, Ministry of Lands, Dar es Salaam *.
IRINGA MUNICIPALITY EXCLUDING ALL ROADS PASSING THROUGH THE AREA *
All that piece or parcel of land situate at Iringa estimated to contain 10.5 acres more or less and bounded as follows–
Commencing at a point on the eastern side of Kingsway approximately 870 feet northwards from the north-west corner of Plot 97; thence in a straight line at right angles to Kingsway to a point 60 feet from the western boundary of Dodoma Road; thence southwards for 900 feet by a straight line parallel to Dodoma Road; thence westwards at right angles to Dodoma Road to the eastern side of the road reserve which runs from Plots 87-96; thence northwards and westwards by that side of the road reserve to the eastern side of Kingsway; thence northwards by the eastern side of Kingsway to the point of commencement; as delineated on Registered Plan No. CTPO. 256, held by the Chief Surveyor, Department of Lands and Surveys, Dar es Salaam.
Commencing at survey beacon No. X.889, which marks the south-east corner of the junction of Kingsway and Pawaga Road in Iringa Municipality the boundary runs on a bearing of 60 degrees 59 minutes and 59 seconds for a distance of 267.34 feet to survey beacon No. J.581; thence on a bearing of 128 degrees 12 minutes and 29 seconds for a distance of 39.22 feet to beacon No. R. 1497; thence on a bearing of 150 degrees 41 minutes and 03 seconds for a distance of 199.52 feet to beacon No. J.594; thence on a bearing of 189 degrees 22 minutes and 37 seconds for a distance of 72.85 feet to beacon No. J.587; thence on a bearing of 217 degrees 00 minutes and 18 seconds for a distance of 292.54 feet to beacon No. G.1694; thence on a bearing of 300 degrees 26 minutes and 36 seconds for a distance of 65.87 feet to beacon No. G.1693; thence on a bearing of 311 degree 01 minute and 57 seconds for a distance of 60.81 feet to beacon No. G.1692; thence on a bearing of 312 degrees 35 minutes and 33 seconds for a distance of 61.99 feet to beacon No. G.1691; thence on a bearing of 343 degrees 38 minutes and 14 seconds for a distance of 203.03 feet to beacon No. X.890; thence on a bearing of 22 degrees 30 minutes and 03 seconds for a distance of 62.20 feet to the point of commencement *.
All bearings are referred to True North. The boundary is shown edged in red on Plan No. D.18.66, deposited with the Survey Division of the Ministry of Lands, Dar es Salaam.
KILOSA TOWN
Commencing at point "A", which demarcates the south-east corner of the P.W.D. depot plot and lies on a bearing of approximately 94 degrees 54 minutes at a distance of approximately 360 feet from beacon K91, which is the south-east beacon of petrol godown plot 13; thence on a bearing of approximately 94 degrees 54 minutes for a distance of approximately 535 feet to point "B"; thence in a northerly direction for a distance of approximately 600 feet, parallel to point "C"; thence directly to the said road reserve boundary, for a distance of approximately 65 feet so that it joins the said road reserve boundary in a right angle at point "D"; thence following the said road reserve boundary, in a northerly direction for approximately 100 feet to its intersection with the south bank of a watercourse at point "E"; thence along the south bank of the said watercourse in a westerly direction for a distance of approximately 600 feet to point "F"; thence on a bearing of approximately 274 degrees 54 minutes for a distance of approximately 400 feet to point "G"; which demarcates the north-east corner of the aforementioned P.W.D. depot; thence continuing on this bearing for 200 feet to point "A", the point of commencement; the whole as shown in green on Registered Plan CTPO. 374, deposited in the Department of Lands and Surveys, Dar es Salaam *.
LINDI TOWN
Commencing at the north-eastern corner of the junction of Market Avenue and Artillery Road, thence northwards along the eastern boundary of Artillery Road to the southern boundary of the government quarters plot; thence eastwards along the southern boundaries of the government quarters, school and cemetery plots to the western boundary of Coast Street; thence southwards along the western boundary of Coast Street to a point in line with the northern boundary of the Hindu Mandal plot; thence to the north-eastern beacon of the Hindu Mandal plot; thence following the northern, western and southern boundaries of the Hindu Mandal Plot to its south-eastern beacon; thence crossing Coast Street to the south-western beacon of Plot 31 "H"; thence along the southern boundary of Plot 31 "H" to the north-western beacon of Plot 30 "H"; thence southwards and eastwards along the eastern and southern boundaries of Plot 30 to Marine Avenue; thence southwards along the western boundary of Marine Avenue to a point being the intersection of a line drawn parallel to and a 100 feet from the northern boundary of plot 27 "H" the Police lines; thence westwards along the said line parallel to Plot 27 "H" for a distance of 450 feet; thence due south to the northern boundary of the cemetery; thence north-eastwards crossing Coast Street to the western side of Coast Street; thence southwards along the western boundary of Coast Street to the northern boundary of Market Street; thence north-westwards along the northern boundary of Market Street to its junction with Artillery Road the point of commencement; as shown edged in red on Registered Plan No. 11275, deposited with the Survey Division of the Ministry of Lands, Dar es Salaam *.
MBEYA MUNICIPALITY
All that area of land amounting to 13.61 acres contained by a succession of straight line boundaries commencing at boundary beacon IA.820, then passing in turn through boundary beacons J.1490, J.1491, J.1492, IA.813, IA.832, IA.831, IA.830, IA.829, IA.828, IA.827, IA.826, IA.825, IA.824, IA.823, IA.822, IA.821, and thence to IA.820 more particularly defined as the area edged red on registered plan No. 12161, deposited with the Survey Division of the Ministry of Lands, Dar es Salaam *.
MOROGORO MUNICIPALITY
King George VI Memorial Stadium, Morogoro:
Commencing at survey beacon B.247; thence south-eastwards for 185.9 feet through survey beacon B.248 to B.249; thence southwards for 575.9 feet through survey beacons B.241, B.242 and B.245 to B.243; thence westwards for 193.4 feet to survey beacon B.244; thence northwards for 583.6 feet through survey beacons B.238, B.237 and B.246 to B.251; thence north-eastwards for 178.0 feet through survey beacon B.250 to B.247, the point of commencement, the whole enclosing 4.285 acres as delineated and coloured green on Survey Plan D. 13/143 registered and held by the Chief Surveyor, Lands and Surveys Department, Dar es Salaam *.
MOSHI MUNICIPALITY
Commencing at the point where the southern boundary of the new Namanga-Taveta road reserve crosses the eastern bank of the Karanga River; thence eastwards along the southern side of that road reserve for approximately 1,500 feet; thence by a straight line bearing approximately 185 degrees N to a point on the northern boundary of the Moshi aerodrome reserve; thence westwards along the northern boundary of the aerodrome reserve to its junction with the south-east corner of Plot No. 146/6; thence northwards and westwards by the eastern and northern boundaries of Plot 146/6 to the eastern bank of the Karanga River; thence northwards by the eastern bank of the Karanga River to the point of commencement, the whole enclosing approximately 54 acres as delineated on Plan No. E.5 241, registered and held in the Survey Division of the Land and Surveys Department *.
All that area of land, amounting to 16 acres, contained by a succession of straight line boundaries commencing at boundary beacon FA 435, then passing in turn through boundary beacons S 45, FA 707, FA 706, FA 705, F 167, F 168, F 169, FA 745, FA 716, FA 717, F 489, F 490, FA 433, FA 434, and thence to boundary beacon FA 435, more particularly defined as the area edged red on registered plan No. 11932, deposited with the Survey Division of the Ministry of Lands, Dar es Salaam *.
MWANZA MUNICIPALITY
All that piece or parcel of land situated south of Post Street at Mwanza comprising 5.63 acres as follows *–
Commencing at survey beacon No. DA327 on the southern side of Post Street; thence south-south-eastwards for a distance of 159.97 feet to DD426; thence south-eastwards for a distance of 100.60 feet to DD449; thence in a southerly direction for a distance of 97.83 feet to CB20; thence in the same direction for a distance of 68 feet to "N.P." being on the western boundary of Plot No. 19, Usagara and Tabora Road; thence south-westwards for a distance of 428.88 feet to DD451; thence north-westwards for a distance of 464.51 feet to DD445; thence in the same direction for a distance of 64.61 feet to DD446; thence north-eastwards for a distance of 209.81 feet to DD448; thence south-eastwards for a distance of 160 feet to D794; thence north-eastwards for a distance of 241.04 feet to D793; thence north-westwards for a distance of 61.10 feet to D792; thence in an easterly direction for a distance of 151.37 feet to the point of commencement, as delineated in red on registered plan No. 11268, held by the Commissioner for Surveys, Ministry of Land, Dar es Salaam.
All that piece of land approximately 19.5 acres in extent situated on the old Mwanza Airfield on the south side of the road from Ihale to Mwanza depicted and edged in red on Registered Plan No. 11764, deposited with the Commissioner for Surveys, Ministry of Lands, Dar es Salaam *.
MWANZA (RURAL) DISTRICT
All that piece of land 7.57 acres in extent situated in the old Mwanza Airfield on the south side of the road from Mwanza to Ihale, depicted and edged in red on Registered Plan No. 10659, deposited with the Director of Lands and Surveys, Dar es Salaam *.
SINGIDA TOWN
All that area of land situated in Singida Town being 437,570 square feet in area, shown on Registered Plan No. D11 203/2, deposited with the Chief Surveyor, Ministry of Lands, Dar es Salaam, and bounded by a line commencing at a beacon shown in the said survey plan as No. HB688 and running through beacons shown on the plan HB689, HB690, HB691, HB692, HB693, HB694, HB695 back to the point of commencement each stretch of the said boundary between any two beacons being a straight line *.
TANGA MUNICIPALITY
Commencing at survey beacon T.669 at the top of the steps leading to the fish market; thence northwards by a line parallel to the said steps for 200 feet; thence west-north-westwards for approximately 650 feet; thence southwards for approximately 320 feet to a point 15 feet north of King Street; thence south-eastwards to King Street; thence eastwards along King Street for about 615 feet to the point of commencement; the whole enclosing approximately 4 acres as delineated in red on Registered Plan No. 9373, held by the Chief Surveyor, Dar es Salaam *.

Commencing at survey beacon K395; thence on a bearing of 40 degrees 15 minutes for a distance of 242.11 feet to survey beacon G600; thence on a bearing of 102 degrees 35 minutes for a distance of 186.14 feet to survey beacon G585; thence on a bearing of 192 degrees 34 minutes for a distance of 20.00 feet to survey beacon G587; thence on a bearing of 102 degrees 32 minutes for a distance of 85.02 feet to survey beacon G583; thence on a bearing of 189 degrees 20 minutes for a distance of 495.00 feet to point Y; thence on a bearing of 279 degrees 20 minutes for a distance of 341.40 feet to point X; thence on a bearing of 00 degrees 04 minutes for a distance of 326.82 feet to point K395 the point of commencement; the whole as delineated on Registered Plan No. D2 193c, held in the Department of Lands and Surveys, Dar es Salaam *.

REGULATIONS

1. These Regulations may be cited as the Public Recreation Grounds (Allocation, Development Conditions, Management and Control) Regulations.
2. In these Regulations–
"public recreation grounds" means and includes all those areas which have been earmarked in any approved planning scheme as areas for the passive or active recreation of members of the public, whether or not the said areas have been declared to be public recreation grounds under section 4 of the Public Recreation Grounds Act *.
3. Public recreation grounds may be allocated to a person, group of persons, club or institution other than the local government authority for care and maintenance.
4. Any person, group of persons, club or institution to whom a public recreation ground is allocated, shall ensure that the public recreation ground so allocated is open to use by all members of the public for all reasonable hours as determined by the local government authority, without constraints.
5. Where the Minister or local government authority is satisfied that no proper care or maintenance of a public recreation ground can be undertaken without adequate fencing, the Minister or Local Government Authority, may give permission to fence the boundaries of the public recreation ground and the fence shall be kept in good condition at all times.
6. Subject to the approval of the Minister, the Local Government Authority may permit a person, group of persons, club or institution to whom a public recreation ground is allocated to establish, maintain and control aquaria, pavilions, piers, dressing rooms, lavatories and such other buildings, structures or conveniences of any nature as the local government authority may consider to be necessary for the proper care and maintenance or for convenient use of the recreation ground by the public.
7. Public recreation grounds shall be allocated for an initial term of five years. Thereafter, depending on the opinion of the local government authority allocation may be extended for a further term not exceeding ten years, subject to renewal.
8. The Minister may require the Local Government Authority to attach any other development conditions to the allocation of a public recreation ground including, inter alia, conditions to regulate the size of permitted buildings or structures, type of building materials, number and position of exits, or for protecting natural water courses and water bodies, natural vegetation; or any other conditions that the local government authority may consider necessary for the proper care and maintenance of the public recreation ground, or any matter in accordance with section 26 of the Town and Country Planning Act *. {/mprestriction}
