1. Citation
These Rules may be cited as the Ngorongoro Conservation Area (Control of Guides) Rules, and shall apply to the whole Conservation Area.
2. Interpretation
In these Rules unless the context otherwise requires–
"Conservator" means the person appointed to the office of Conservator of the Ngorongoro Conservation Area or any other person lawfully authorised to act in that office;
"Guide" means any person who, whether on foot, in a motor vehicle or otherwise, for monetary reward, escorts any visitor with the view to leading such visitor to any natural feature, including wildlife, within the Conservation Area;
"Licensed professional hunter" means any person holding a valid professional hunter's licence issued in accordance with the provisions of the Wildlife Conservation Act *.
3. Guides
No person other than a Government employee duly authorised by the Conservator in that behalf, or a licensed professional hunter shall act as a guide within the Conservation Area unless he is the holder of a valid permit issued by the Conservator in that behalf.
4. Application for permit
Applications for such a permit shall be made to the Conservator and shall be accompanied by the appropriate fee. On such application being made, subject to the provisions hereinafter contained, the Conservator shall issue the requisite permit.
5. Grant of a permit
Such a permit may be granted for a year or three months. Unless previously cancelled, a yearly permit shall expire on the following thirtieth day of June, and a three-monthly licence on the following thirtieth day of September, thirty-first day of December, thirty-first day of March, or thirtieth day of June, whichever is the earliest.
6. Terms and conditions
(1) When issuing such a permit the Conservator shall endorse on such permit such terms and conditions as may be necessary to secure the physical safety of any visitor escorted by a guide or the protection of wildlife from disturbance or fright, and where any such terms or conditions are enforced on a permit such permit shall be valid only subject to such terms and conditions.
(2) Where any guide is in breach of any term or condition endorsed on his permit or conducts himself in such a manner as to endanger the safety of any visitor under his charge or to disturb or frighten any wildlife the Conservator shall cancel such permit without refund.
7. Competent applicant
The Conservator shall not issue a permit unless he is satisfied that the applicant for such a permit is competent to act as a guide and would not be likely to endanger the physical safety of any visitor under his charge or to disturb or frighten any wildlife.
8. Fees
The fees payable for a permit issued under the provisions of these Rules are as follows–

9. Offences
Any person who fails to comply with or contravenes any of these rules commits an offence and shall be liable on conviction, in the case of a first conviction, to a fine not exceeding one thousand shillings or to imprisonment for a term not exceeding three months or to both such fine and imprisonment; and in the case of a second or subsequent conviction, to a fine not exceeding three thousand shillings or to imprisonment for a term not exceeding six months, or to both such fine and imprisonment.

1. Title
The Rules may be cited as the Ngorongoro Conservation Area Rules.
2. Interpretation
In these Rules, unless the context otherwise requires–
"the Act" means the Ngorongoro Conservation Area Act *;
"the Conservator" means the Conservator of the Conservation Area appointed under Section 4 of the Act.
"the Crater" means the Ngorongoro Crater;
"the Gorge" means the part of the Oldupai Gorge, which is demarcated or fenced off from the remaining part of the Gorge as a protected area;
"licensed professional guide" means any person who holds a certificate issued by the College of African Wildlife Management or any other College or Institution recognised by the Conservator for the purposes of these Rules, including a professional hunter, licensed under the provisions of section 26 of the Wildlife Conservation Act *, who whether on foot or in a motor vehicle or otherwise, for monetary reward, escorts any visitor or tourist with the view to leading such visitor to any natural feature, including wildlife within the Conservation Area;
"licensed safari attendant" means any person other than the professional guide or official guide who is licensed to accompany the tourists in the Conservation Area, including a cook, a driver or a turnboy;
"official guide" means any employee of the Conservation Unit, who holds a certificate issued by the College of African Wildlife Management or any other College or Institution recognised by the Conservator for the purpose of these Rules, who is authorised by the Conservator whether on foot, in a motor vehicle or otherwise, to escort any visitor or tourist to any natural feature, including wildlife within the Conservation Area or the Gorge;
"photographs" means pictures, images or likenesses whether cinematographic or still, obtained by means of a camera;
"professional hunter" means any person holding a professional hunter's licence issued in accordance with the provisions of section 26 of the Wildlife Conservation Act *,
"resident" means a person ordinarily residing in the United Republic of Tanzania;
"tourist" means any person who enters the Conservation Area other than a resident or visitor;
"the Unit" means the Conservation Unit including any person employed by the Unit to work in the Conservation Area;
"visitor" means any person other than a tourist or a resident who enters the Conservation Area for the purposes of trade, business or employment and includes any person employed by the Government or Masai District Council who enters the Conservation Area in the course of his employment.
3. Tourist's and visitor's permits
(1) Every tourist or visitor who enters or wishes to enter the Conservation Area shall first obtain a tourist's permit from the Conservator.
(2) Such permit shall be obtained–
(a) before entry, on application by post to the Conservator at the Conservation Office in Arusha; or
(b) in the case of tourists or visitors entering the Conservation Area at Lodoare Gate or Naapi Hill Gate, on entry at such points; or
(c) in the case of the tourists or visitors who do not apply for a permit from the Conservator by post in accordance with the provisions of subparagraph (a) of paragraph (2) or who do not enter the Conservation Area at Lodoare Gate or Naapi Hill Gate, shall obtain a permit within one week after the entry or before leaving the Conservation Area, which ever shall be the sooner at the Conservation Office, at Ngorongoro.
(3) Any person who enters and remains in the Conservation Area without a permit for more than one week after his entry in the Conservation Area shall be guilty of an offence against these Rules.
(4) The permits issued under paragraph (2) shall be in the Form prescribed in the First Schedule hereto.
4. Crater and camper's permits
(1) In addition to the tourist's or visitor's permit referred to in rule 3 of these Rules, every tourist or visitor who intends to visit the Crater shall obtain a Crater Permit issued by the Conservator.
(2) In addition to the tourist's and visitor's permit referred to in rule 3 of these Rules every tourist or visitor who intends to spend one or more nights in the Conservation Area otherwise than in dwelling house, hotel or lodge or other building shall before entering the Conservation Area, obtain camper's permit issued by the Conservator.
(3) The permits mentioned in paragraph (2) of this rule shall be obtained at the Conservator's office or the Crater Gates at Ngorongoro.
5. Gorge permits
(1) In addition to the tourist's and visitor's permit referred to in rule 3 of these Rules, every tourist or visitor who intends to visit the Oldupai Gorge shall obtain a permit which shall be available either at the entrance to the Gorge or the Conservator's office.
(2) No person shall enter the Gorge unless he is accompanied by an official guide or, if he is with a group of tourists or visitors, such a group is accompanied by an official guide.
(3) A fee payable by every tourist or visitor or group of tourists or visitors in respect of the official guide accompanying the tourists or visitors shall be as prescribed in the Second Schedule hereto.
6. Official guide, professional guide and safari attendant to act as guides
(1) No person other than an official guide, a licensed professional guide, a licenced safari attendant or an employee of the Conservation Unit, authorised in writing by the Conservator, may act as a guide or safari attendant, as the case may be, within the Conservation Area.
(2) Any person who acts as an official guide, professional or safari attendant without having first obtained a licence or without the written authority of the Conservator or who contravenes any of the provisions of these Rules commits an offence against these Rules.
7. Permit to act as a guide or safari attendant
(1) Any person who intends or is required to act as a professional guide or safari attendant within the Conservation Area shall apply in writing to the Conservator for a licence to act as a professional guide or safari attendant.
(2) Such an application shall be accompanied by the appropriate fee prescribed in the Second Schedule hereto.
(3) A licence shall be valid for a period of one year or for three months. Unless previously cancelled, a yearly licence shall expire on the thirtieth day of December, and a three-month licence shall expire on the following thirtieth day of September, thirty-first day of December, thirty-first day of March or thirtieth day of June, whichever is the earliest.
(4) The Conservator may, while issuing a licence or permit endorse on such licence or permit such terms and conditions as may be necessary to secure the physical safety of any tourist or visitor escorted by the professional guide or safari attendant or the protection of the wildlife from disturbance or fright, and where any such terms or conditions are endorsed on a licence or permit such licence or permit shall be valid only subject to such terms and conditions.
(5) When any guide or safari attendant contravenes any provision of the Act or condition endorsed on the licence or permit or conducts himself in such a manner, as to endanger the safety of any tourist or visitor under his charge or to disturb or frighten any wildlife, the Conservator shall cancel such licence or permit without refund.
8. Certificate of residence
(1) Every person to whom the provisions of the Act apply and who resides in or intends to reside in or intends to enter the Conservation Area and reside within the Conservation Area shall first obtain a resident certificate from the Conservator.
(2) Upon being satisfied that the applicant for a residence certificate is a person to whom the provisions of paragraph (1) of this Rule apply, the Conservator may issue a certificate to such a person subject to such conditions as he may deem fit to impose. A certificate issued to such an applicant shall be in the form prescribed in the First Schedule hereto.
(3) Any person to whom paragraph (1) of this rule applies and who resides in or within or enters in the Conservation Area without a certificate commits an offence:
Provided that the provisions of this paragraph shall not come into operation until after the expiration of ninety days from the date of coming into operation of these Rules.
(4) The Conservator may revoke the certificate of any person who is convicted of any offence against these Rules.
(5) Any person to whom a certificate of residence is issued under this rule shall upon demand produce the same to the Conservator, Assistant Conservator or any other person authorised in writing by the Conservator in that behalf.
(6) The Conservator or any person authorised by the Conservator in writing may require any person within the Conservation Area without a permit or certificate to leave the Conservation Area and any person who fails to comply with such an order within a reasonable time commits an offence against these Rules.
9. Validity of licences and refusal to issue certificates
(1) A certificate issued under these Rules shall be valid for such period and shall be subject to such conditions as may be imposed by the Conservator and endorsed on the certificate.
(2) The Conservator may endorse on the licence, permit or certificate any conditions which he may deem fit to impose.
(3) Any person who is aggrieved by the decision of the Conservator or of any person authorised by him in writing concerning the refusal to issue a permit, licence or certificate of residence may within fourteen days of being notified of such refusal appeal against such refusal to the Minister whose decision shall be final.
(4) The Minister may either confirm the refusal or condition or may vary, modify or quash the order or condition or direct the issue of a licence or permit, with or without conditions, as the case may be, and the Conservator shall give effect to such directions.
10. Motor vehicle permits
(1) No motor vehicle may be driven in or within the Crater unless a motor vehicle permit in respect of such motor vehicle has previously been obtained from the Conservator by the person in charge thereof.
(2) No person shall drive or cause to be driven, a motor vehicle at a speed exceeding twenty-five miles an hour inside the Crater, except in an emergency or where authority has previously been obtained from the Conservator.
11. Road barriers
(1) The Conservator may for the purpose of controlling entry into the Conservation Area, erect and maintain road barriers on the public highway or any track within the Conservation Area.
(2) The Conservator or any person duly authorised in writing by him may, for such periods or such times as he may consider necessary for the protection of the highway or track or due to weather conditions, by notice in the Gazette in that behalf, close to any kind of traffic; or vehicle any highway or track or part of the highway or track within the Conservation Area, unless the person in charge of any such vehicle first obtains the permission of the Conservator to travel on any such road or track.
12. Display of signs and advertisement
(1) Except with the permission of the Conservator and in accordance with the permit issued by the Conservator or any person authorised by the Conservator in writing in that behalf no person shall–
(a) erect or display any notice or advertisement in or within the Conservation Area or at any entrance gate or on any boundary of the Conservation Area; or
(b) collect any money from members of the public or sell any goods or offer any goods for sale or purchase any goods or carry on any trade, within the Conservation Area.
(2) Such permit shall specify the form, size, location of such sign and design or advertisement or stall or stand and shall be subject to such other terms and conditions as may be imposed by the Conservator and endorsed on the permit.
13. Fees
(1) The fees prescribed in the Second Schedule hereto shall be payable in respect of the permits, licences and other facilities provided in the Conservation Area by the Conservator or the Conservation Unit:
Provided that the Conservator may exempt any person or group or class of persons from the payment of the whole or any part of such fees.
(2) The concession fees to be paid to the Unit by the hotel owners shall be paid in arrears at the end of each month in respect of which the fee is payable.
(3) Every person who stays in a Government Rest House situated within the Conservation Area shall pay a fee specified in the Second Schedule hereto.
14. Penalty
Any person who commits any offence under these Rules shall be liable on conviction to a fine not exceeding one thousand shillings or to imprisonment for a term not exceeding three months or to both such fine and imprisonment, and in the case of a second and subsequent offence to a fine not exceeding three thousand shillings or to imprisonment for a term not exceeding six months or to both such fine and imprisonment.
15. Revocation
The Ngorongoro Conservation Area (Control of Guides) Rules, 1963, and the Ngorongoro Conservation Area Rules, are hereby revoked:
Provided that all the permits, licences and certificates which were issued before the coming into operation of these Rules shall be deemed to continue to be valid until such time as they expire or they are revoked.

CONDITIONS OF THE PERMIT |
1. The Permit holder or any person in his party shall not cut, pluck or destroy any tree, shrub or plant in the Conservation Area: |
Provided that the permit holder shall gather or collect dead wood for fire wood. |
2. Except with the permission of the Conservator or any officer duly authorised by the Conservator in writing, no person shall light or cause a fire to be lit within the Conservation Area. |
3. No person shall deposit any refuse or any litter within the Conservation Area. |
4. Every person who is within the Conservation Area, other than at a camping place or hotel or lodge, shall be inside a motor vehicle while he is within two hundred yards of any game or animal. |
5. Every person who enters or who is within the Conservation Area shall obey all the lawful orders, instructions or directions whether verbal or written issued or given by the Conservation or any officer duly authorised by the Conservator in writing. |
6. Every person who enters or who is within the Conservation Area shall comply with all the provisions of the Ngorongoro Conservation Area Act and any rules made hereunder. |
7. Every tourist or visitor who enters or who is within the Conservation Area, enters or remains within the Conservation Area at his own risk. |

CONDITIONS |
1. No person may travel or drive a motor vehicle on or along the Lerai or Seneto descent roads unless such motor vehicle is a four-wheel drive. |
2. No person may use the Ngorongoro Crater access roads except in accordance with the following directions– |
(a) all the roads are open from 6.00 a.m. to 7.00 p.m.; |
(b) two way traffic is only allowed along the Munge Road, which is suitable for all types of motor vehicles; |
(c) one way traffic is allowed along the Lerai and Seneto Roads, going downwards towards the Crater. |
No motor vehicle will be allowed to be driven or travel along the Munge Road, Lerai Road and Seneto Road when half an hour remains before the closing time (7.00 p.m.). |
3. No person may use any motor vehicle in the Crater unless the motor vehicle is fully equipped with standard safari equipment, consisting of a heavy duty jack, chains, tow-rope, shovel or jembe and axe or panga. |
4. No person unless accompanied by a professional guide, or official guide may enter the Lerai and Laiyamai Forests whether in a motor vehicle or on foot. For the purposes of these Rules the Lerai Forest is defined as all that area of land, within the graded and gravel-strewn track, which surrounds the Lerai Forest. |
5. Every tourist or visitor unless he is authorised in writing by the Conservator or any person authorised by the Conservator in writing must be accompanied by a professional guide or official guide when entering and while within the Crater. |
6. No visitor or tourist shall bring or carry any cat or dog within the Crater. |
7. No person may drive or cause to be driven a motor vehicle into the Emphakai Crater. |
8. Any person who walks within the Crater shall follow the authorised foot paths, which include Lengai Lomutroish or Sendui paths and shall be accompanied by an armed official guide. |
9. Every tourist or visitor or group of tourists or visitors shall take an official guide at Oldupai Gate before entering the Gorge: |
Provided that an official guide shall only escort a tourist or visitor or a group of tourists or visitors in one motor vehicle at a time. |
10. Except with the permission of the Conservator or any officer duly authorised in writing in that behalf, no person shall move, pick, spoil, damage, break, cover or alter any object or material, whether natural or artificial, of geological, historical or archeological interest within the Crater or Gorge. |
11. The permit must be produced on demand if the holder fails to produce it, he will be required to pay fees again. |

CONDITIONS |
1. A guide shall not while acting as such drive or cause to be driven any motor vehicle in a manner which is likely to endanger or cause danger to the safety of any tourist or visitor or to damage or otherwise disturb or frighten any wild life. |
2. A guide, while acting as such shall not drive or cause to be driven any motor vehicle within two hundred yards of any rhinoceros, lion or any other dangerous animal or any animal with young likely to be disturbed by such action. Only one motor vehicle at a time shall approach the animals; where there are more than one motor vehicles within the area for viewing wildlife, each motor vehicle shall only stop for a reasonable time for the purpose of watching or viewing the game animals and then shall move away to allow the other motor vehicles to approach the place where the wildlife may be seen. {mprestriction ids="1,2,3"} |
3. A guide shall, while he is on duty– |
(a) not smoke any cigarettes unless allowed by the people he is escorting to do so; |
(b) not solicit or accept any gift; |
(c) read and follow the instructions or orders issued to him by the Conservator or any officer duly authorised in writing by the Conservator; |
(d) acquaint or inform his clients of the conditions endorsed at the back of every Tourist's or Visitor's permit; |
(e) produce his own permit on request or within a reasonable time of his being requested to do so; |
(f) stop or cause to be stopped any motor vehicle and remove minor obstacles from the roads, including stones and branches of trees and to report any major obstacles or damage at the Conservation Office; |
(g) not drop or deposit any litter in the Conservation Area or in the Gorge and ensure that his clients too do not drop, throw or deposit any litter anywhere within the Conservation Area or within the Gorge. |
4. A guide shall surrender or deliver the badge issued to him, which is the property of the Unit, when his licence is cancelled or when he is requested to do so by the Conservator or any officer duly authorised in writing by the Conservator. |
5. Every guide shall comply with the provisions of the Ngorongoro Conservation Area Act, the rules made hereunder as well as the conditions which are endorsed on the permit. |

CONDITIONS |
1. A safari attendant shall not, while acting as such, drive or cause to be driven any motor vehicle in a manner which is likely to endanger the safety of or cause danger to any tourist or visitor or to damage or otherwise disturb or frighten any wildlife. |
2. A safari attendant, while acting as such, shall not drive or cause to be driven any motor vehicle within two hundred yards or any rhinoceros, lion or any other dangerous animal or any other animal with young likely to be disturbed or be in the vicinity of any dangerous animals. |
Where there are many motor vehicles, each motor vehicle shall only stop for a reasonable time for the purposes of watching such animal and then shall move away to allow the other motor vehicles to approach the place where such animals may be seen. |
3. A safari attendant shall, while on duty– |
(a) not smoke any cigarettes, unless allowed by the people, whom he is escorting to do so; |

5. A safari attendant shall comply with all the provisions of the Ngorongoro Conservation Area Act, the rules made thereunder as well as all the conditions, which are endorsed on the permit. |

PART I
PRELIMINARY PROVISIONS (rules 1-2)
1. Citation and application
These Rules may be cited as the Ngorongoro Conservation Area (Establishment of Ngorongoro Pastoral Council) Rules shall apply to all Pastoralists residing within the Ngorongoro Conservation Area.
2. Interpretation
In these Rules unless the context otherwise requires–
"Area" means the Ngorongoro Conservation Area to which the Ordinance applies;
"Authority" means the Ngorongoro Conservation Area Authority established under section 4 of the Ordinance *;
"Board" means the Board of Directors of Ngorongoro Conservation Area Authority established under the Ordinance;
"Conservator" means the person for the time being appointed to the office of the Conservator of Ngorongoro Conservation Area Authority and includes any other person lawfully authorised to act in that capacity;
"Constitution of the Pastoral Council" means the Constitution of the >Ngorongoro Pastoral Council titled in Kiswahili "Katiba ya Baraza la Wafugaji" as prescribed in the Schedule to these Rules;>
"Ordinance" means the Ngorongoro Conservation Area Ordinance *;
"Pastoral Council" means the Pastoral Council of Ngorongoro Pastoralists >established under rule 3 of these Rules;
"Pastoralists" means the pastoralists who were inhabitants of Ngorongoro Conservation Area before the area was declared by the Government of >Tanganyika in 1959 by proclamation in the Government Gazette, to be >the Conservation Area, and their generations;>
"Schedule" means the Schedule to these Rules titled "Katiba ya Baraza la wafugaji waishio katika Hifadhi ya Ngorongoro".
PART II
ESTABLISHMENT AND FUNCTIONS OF THE PASTORAL COUNCIL (rules 3-10)
3. Establishment >of the Council>
(1) There is hereby established the Council to be known as the Ngorongoro Pastoral Council.
(2) The Council established under subrule (1) shall be composed of >such number of members as specified in the constitution.
(3) The Council shall for the purposes of tenure of office, proceeding >or any other matters of the Council, be governed by the constitution.
4. Office of >the Council>
The Council shall have its separate and independent office or offices at such place within Ngorongoro Conservation Area as the Conservator >may direct or in any other place as the Conservator and the Council may >deem appropriate.
5. Functions of the Council
Powers, functions and source, of funds of the Council shall be as provided for under the Constitution as prescribed in the Schedule to these R>ules.>
6. Decision of the Council
The Council shall, before making its decision on any matter relating to Conservation and development of pastoralists in the area, involve the Ngorongoro pastoralists.
7. Procedure for Amendment of the Constitution
(1) The Council shall wherever it deems appropriate have power >to amend vary or replace all or any of the provisions of the Constitution.>
(2) Notwithstanding subrule (1), the Council shall before exercising its powers under subrule (1), submit the proposal for amendment, variation or replacement of all or any of the provisions of the Constitution to the Board for consideration.
(3) The Board shall, after receiving the proposals for amendment of the Constitution under subrule (2) and after due consideration of the matter, submit the proposal to the Minister for approval and publication in the official Gazette.
(4) The Board may, where the proposed amendments or variation of >the Constitution contravene any of the provisions of the Ngorongoro >Conservation Area Ordinance or any other regulation made under it disapprove the proposal and advise the Council accordingly.>
8. Development project
(1) The Council shall, for the purpose of development within the area, have power to develop and plan for implementation of any project and submit the project proposal to the Authority.
(2) Upon submission of the project proposals to the Authority under subrule (1), the funds budgeted in any financial year of the Authority for Ngorongoro Pastoralists development projects, shall be remitted to the Pastoral Council to carry out its functions for the targeted people as described in the Constitution.
9. Board to control funds
(1) The funds budgeted for and remitted to the Pastoral Council >shall remain under the control of the Board and the Board shall cause to be provided and kept proper books of accounts and records in respect of such funds that is to say–>
(a) The Board shall cause to be made and kept in accordance with accounting practice proper records in respect of the receipt and expenditure of money and other financial transactions involving the Authority's money budgeted for and remitted to the Pastoral Council to enable it carry out its functions;
(b) the Board shall cause to be prepared for every financial year a balance sheet and a statement showing details of the expenditure of Pastoral Council's money from the Authority.
(2) Not later than six months after the close of every financial year the accounts including the balance sheet of the Pastoral Council relating to that financial year shall be audited by registered and credible auditors subject to authorisation by the Board.
(3) As soon as the accounts of the Pastoral Council have been audited, and in any case not later than six months after such audit, the >Pastoral Council shall submit an audit report to the Conservator who >shall as soon as practicable cause a copy of such report made by the auditors, to be submitted to the Board.>
10. Offences and penalties
(1) Any person or member of the Pastoral Council who utilises the Authority's money remitted to the Pastoral Council for any purpose other than the purposes stated in the constitution commits an offence.
(2) Any person who commits an offence under these Rules shall on >conviction be liable to a fine or imprisonment as may be appropriate under the Penal Code *.>
SCHEDULE
KATIBA YA BARAZA LA WAFUGAJI WAISHIO HIFADHI YA NGORONGORO
(Rule 2)
1.0 SEHEMU YA KWANZA: UFAFANUZI
1.01> "Baraza la Wafugaji":
Ni chombo ambacho kinawaunganisha wafugaji wakazi wa Hifadhi ya Ngorongoro kupitia wawakilishi wa Serikali za Vijiji na Kamati za maendeleo za Kata zote ndani ya Hifadhi ya Ngorongoro, Uwakilishi huu, >umeelezwa katika sehemu ya pili: Uendeshaji namba 2.02 (Muundo wa Baraza la Wafugaji).
1.02> "Kamati ya Utendaji":
Ni kamati ya Utendaji ya Baraza la Wafugaji ambayo muundo wake (upo kwenye sehemu ya tano 5.02) (imeelezwa kwenye sehemu 2.03(b);
1.03 "Kamati Maalum":
Ni kamati mbalimbali ambazo zitaundwa na Kamati ya Utendaji au Baraza >la wafugaji ili kutekeleza jukumu maalum kwa wakati uliopangwa.>
1.04 "Shirika la Mamlaka ya Hifadhi ya Ngorongoro":
Ni chombo cha kisheria ambacho kinamilikiwa na Serikali ya Tanzania ili kutekeleza malengo makuu matatu yafuatayo–
(a) kubadilisha na kuziendeleza maliasili zilizopo ndani ya Hifadhi ya >Ngorongoro;>
(b) kuendeleza wafugaji wenyeji wakazi wa ndani ya Hifadhi ya >Ngorongoro
(c) kuendeleza utalii ndani ya Hifadhi ya Ngorongoro.
1.05. "Tarafa ya Ngorongoro":
Ni eneo lenye mipaka ya kiutawala kimaendeleo iliyowekwa na Serikali ambayo inajumuisha eneo lote la Hifadhi ya Ngorongoro. Tarafa hii ni kati >ya Tarafa tatu zinazounda Wilaya ya Ngorongoro. Tarafa nyingine ni Loliondo na Salei.>
1.06> >"Wajumbe wa Baraza la Wafugaji":
Ni wawakilishi wa wafugaji wenyeji wakazi wa Tarafa ya Ngorongoro ambao wanawakilisha wafugaji wa maeneo yao. Uwakilishi huu umeelezewa kwenye sehemu ya tano, kipengele cha 5.01.
1.07> "Watumishi/Wafanyakazi wa Baraza la Wafugaji":
Baraza la Wafugaji kutokana na sababu za kiutendaji linaweza kuajiri watumishi/wafanyakazi kwa mikataba maalumu ya kazi. Ajira hizi zinaweza >kutoka ndani au nje ya Tarafa ya Ngorongoro kulingana na maamuzi ya Baraza la Wafugaji lenyewe;
1.08> "Taasisi za Baraza la Wafugaji":
Ni vyombo mbalimbali vya uendeshaji wa Baraza la wafugaji >vitakavyobuniwa kulingana na maelekezo yaliyopo kwenye Katiba hii;
1.09> >"Menejiment ya Shirika":
Ni chombo cha uendeshaji wa Shirika la Mamlaka ya Hifadhi kwa niaba ya Bodi ya Wakurugenzi wa Shirika. Chombo hiki kinaundwa na Mkuu wa Shirika ambaye ni Mhifadhi wa Ngorongoro pamoja na wakuu wa Idara zote za Shirika.
1.10> "Bodi ya Wakurugenzi":
Ni chombo cha juu cha ubunifu wa sera na usimamizi wa utekelezaji wa sera za Shirika la Mamlaka ya Hifadhi ya Ngorongoro. Mwenyekiti wa bodi >ya Wakurugenzi huteuliwa na Rais na Katibu wa bodi ya Wakurugenzi ni >Mkuu wa Shirika la Mamlaka ya Hifadhi ya Ngorongoro. Waziri wa Maliasili na Utalii huteua idadi ya wajumbe wa bodi ya Wakurugenzi kati ya watano >hadi tisa. Katika uteuzi wa Waziri wajumbe wawili hutoka kwenye wilaya >ya Ngorongoro.>
1.11> >"Wafugaji wenyeji wakazi wa Hifadhi ya Ngorongoro":
Ni wafugaji wote pamoja na vizazi vyao ambao walikuwepo ndani ya Hifadhi ya Ngorongoro mwaka 1959 wakati ambapo Hifadhi ya Ngorongoro ilianzishwa kisheria.
1.12> "Ajira za Baraza la Wafugaji":
Kwa sababu mbalimbali Baraza la Wafugaji linaweza kuajiri watu kwa mikataba maalum ili kuongeza ufanisi wa shughuli zake kwa malipo kutoka >mfuko wa Baraza la Wafugaji.
Ajira hizi za Baraza la Wafugaji hazina uhusiano wowote na ajira za Shirika >la Mamlaka ya Hifadhi ya Ngorongoro au taasisi zilizopo ndani ya Hifadhi Ngorongoro.>
2.0 SEHEMU YA PILI: UENDESHAJI
2.01 Makao Makuu ya Baraza la Wafugaji:
Makao makuu ya Baraza la Wafugaji yatakuwa katima eneo lililopo la makao >makuu ya Shirika la Mamlaka ya Hifadhi ya Ngorongoro.
2.02> Muundo wa Baraza la Wafugaji:
Baraza la Wafugaji litakuwa na muundo ufuatao:
(i) "Baraza la Wafugaji"
Hiki ni kikao kinachojumuisha wajumbe wote wa Baraza la wafugaji kulingana na sehemu ya tano kipengele 5.01 cha Katiba hii.
(ii) "Kamati ya Utendaji"
Kamati ya Utendaji itaundwa na idadi ya wajumbe wasiopungua t>isa na idadi hiyo isizidi wajumbe kumi na tatu. Idadi kamili ya >wajumbe wa Kamati ya Utendaji itaamuliwa na baraza la Wafugaji.>
Wajumbe wa Kamati ya Utendaji watakuwa na nyadhifa zifuatazo:
- Mwenyekiti;
- Katibu;
- Mweka Hazina;
- Msaidizi wa Mweka Hazina;
- Wajumbe wa kawaida wasiopungua watano na wasiozidi tisa.
(iii) "Kamati nyinginezo ndogo maalum"
Baraza la Wafugaji linaweza au Kamati ya Utendaji inaweza kuteua kamati ndogondogo ambazo zitatekeleza majukumu mbalimbali. Majukumu haya yanaweza kuwa ni ya muda mrefu au ni majukumu >ya muda mfupi.
2.03(a) Majukumu ya Baraza la Wafugaji:
(i) Kuishauri Bodi ya Wakurugenzi wa Shirika la Mamlaka ya Hifadhi ya Ngorongoro juu ya ubunifu na utekelezaji wa sera zote kulingana >na Katiba ya Baraza la wafugaji wa Hifadhi ya Ngorongoro;
(ii) Kuchagua wajumbe wa Kamati ya utendaji na Kamati nyinginezo >ndogondogo litakazoziunda;
(iii) Kuisimamia Kamati ya Utendaji ili iweze kutekeleza sera >zinazolihusu baraza la Wafugaji na zilizopitishwa na Bodi ya >Wakurugenzi kulingana na Katiba hii;>
(iv) Kujadili na kufanya maamuzi juu ya agenda/taarifa mbalimbali zitakazoletwa na Kamati ya Utendaji;
(v) Kupitia takwimu za mapato na matumizi ya Baraza la Wafugaji zitakazopendekezwa na Kamati ya Utendaji na kufanya maamuzi juu ya mapendekezo hayo;
(vi) Kuhakikisha ya kuwa vyombo vyote vya ushirikishwaji kuanzia >Serikali za vijiji na Kamati za maendeleo za Kata vinapewa nafasi >ya kutosha katika kutoa mchango wa mawazo, katika kutatua >matatizo ya maeneo yao na kubuni mbinu na mikakati ya kuyapatia >ufumbuzi matatizo hayo;
(vii) Kushirikiana na Shirika la Mamlaka ya Hifadhi ya Ngorongoro, Wafadhili mbalimbali, Mashirika ya Kiserikali na yasiyo ya Kiserikali na vyombo mbalimbali vya kiutawala vya Wilaya zinazopatikana na Hifadhi ya Ngorongoro pamoja na Serikali Kuu >ili kutekeleza malengo na madhumuni yaliyopo katika katiba hii.
(b) Majukumu ya Kamati ya Utendaji:
(i) Kutekeleza sera zote zinazolihusu baraza la Wafugaji na zilizo>pitishwa na Bodi ya Wakurugenzi kulingana na Katiba hii;>
(ii) Kuyatambua matatizo yanayokwamisha maendeleo na kubuni mbinu na mikakati ya ufumbuzi wa matatizo hayo, kwa kuhakikisha Serikali za vijiji na Kamati za maendeleo ya Kata ndani ya Hifadhi >ya Ngorongoro zimeshirikishwa kikamilifu;
(iii) Kulishauri Baraza la Wafugaji juu ya mbinu na mikakati mbalimbali ya ufumbuzi wa matatizo yanayokwamisha maendeleo ya wafugaji;
(iv) Kufanya jitihada ya kukusanya agenda mbalimbali kutoka kwenye Serikali za vijiji pamoja na kamati za maendeleo za Kata ndani ya >Hifadhi ya Ngorongoro. Kwa zile Agenda zinazogusa mwelekeo >wa sera za Hifadhi ya Ngorongoro, zitakazojadiliwa na Kamati ya utendaji, ni lazima mapendekezo ya Kamati ya utendaji yafikishwe kwenye Baraza la wafugaji ili maafikiano yatakayofikiwa kwenye baraza la wafugaji yafikishwe kwenye Bodi ya Wakurugenzi kwa ushauri. Agenda zinazogusa utekelezaji wa sera zilizopitishwa na Bodi ya Wakurugenzi kulingana na malengo na madhumuni yaliyomo kwenye katiba hii zitajadiliwa na Kamati ya utendaji na maamuzi yatakayofikiwa yatatekelezwa. Taarifa ya utekelezaji >itapelekwa kwenye Baraza la Wafugaji.
(v) Kutangaza nafasi za kazi/ajira zilizopo kama zilivyopitishwa na Baraza la Wafugaji kwa ajili ya watumishi. wafanyakazi wa baraza la wafugaji Vilevile kusimamia kikamilifu zoezi la kuwasaili >watumishi/wafanyakazi hao. Isipokuwa ajira hizi hazitahusu ajira >za Wafanyakazi wa aina yoyote wa Shirika au taasisi nyinginezo >ndani ya Hifadhi ya Ngorongoro).
(vi) Kudhibiti mwenendo wa watumishi/wafanyakazi walioajiriwa na >Baraza la Wafugaji. Hii pia inajumuisha kufuta ajira za watumishi ambao itaona hawafai;>
(vii) Kuunda Kamati ndogo ambazo zitasaidia katika utekelezaji wa sera zilizopitishwa na vikao vinavyohusika;
(viii) Kuandaa Kongamano/warsha na semina mbalimbali kwa wajumbe >wa baraza, wafanyakazi wa baraza na wenyeji wakazi wa Hifadhi >ya Ngorongoro;>
(ix) Kutoa ushauri wa kina kwa Baraza la Wafugaji.
(c)> Majukumu ya Kamati nyingine ambazo ni ndogo ndogo:
Kamati hizi zitakuwa ni za muda maalum na zitatekeleza majukumu kama zitakavyopangiwa na Baraza la Wafugaji au Kamati ya Utendaji. Vile vile Kamati hizi zitawajibika kwa chombo ambacho kimeziteua.
(d)> Kazi za viongozi wa Baraza la wafugaji:
(i) Mwenyekiti:
(a)> >Atakuwa Mwenyekiti wa Baraza la Wafugaji na Kamati ya >Utendaji, Vielelezo ataitisha na kuendesha vikao vya vyombo >hivyo viwili.>
(b) Atakuwa ni msimamizi mkuu wa Baraza la Wafugaji.
(c) Atahakikisha ya kuwa katiba ya Baraza la Wafugaji inalindwa >na inatekelezwa ipasavyo na wajumbe wote wa Baraza la >wafugaji.
(d)> >Atahakikisha ya kuwa endapo kuna haja ya marekebisho ya Katiba basi taratibu zote zinafuatwa kama ilivyoelekezwa >katika sehemu ya kumi ya Katiba ihusuyo marekebisho ya Katiba.
(ii) Katibu:
(a) Atakuwa Katibu wa Baraza la Wafugaji na Kamati ya Utendaji.
(b) Atatoa taarifa ya mikutano kwa wajumbe na waalikwa katika kikao husika kulingana na maelekezo atakayoyapata kutoka kwa Mwenyekiti.
(c) takuwa ni mtekelezaji mkuu wa shughuli zote za Baraza la Wafugaji.
(d)> >Ataandaa muhtasari wa vikao na kuusoma kwenye vikao vinavyohusika.>
(e) Ataandaa agenda za vikao kufuatana maelekezo atakayoyapata katika Kamati ya Utendaji.
(f) Ataandaa taarifa za utekelezaji za Kamati ya Utendaji zitakazosomwa na Katibu/Mweka Hazina au Mwenyekiti wa muda kulingana na maelekezo ya Mwenyekiti.
(g) Atakuwa ni mwandishi wa shughuli zote za Baraza la Wafugaji.
(h) Ataandaa nafasi za semina na Warsha kwa ajili ya >wajumbe na wafanyakazi wa Baraza la Wafugaji pamoja na wafugaji wakazi wenyeji wa Tarafa ya Ngorongoro.>
(i) Atapokea na kutunza kumbukumbu za mali zote za Baraza la wafugaji.
(iii) Mweka Hazina:
(a)> >Kwa kushirikiana na mwenyekiti wa Baraza la Wafugaji >atasimamia uendeshaji wa akaunti zote za Baraza la Wafugaji kulingana na maelekezo ya Kamati ya utendaji au Baraza la Wafugaji.
(b)> >Ataandaa takwimu za mapato na matumizi ya Baraza la >Wafugaji na atawasilisha mahesabu hayo kila mwezi kwenye kikao cha Kamati ya utendaji.
(c) Atakuwa ni mshauri mkuu wa Mwenyekiti wa Baraza la Wafugaji kuhusiana na masuala yote ya kifedha ya Baraza la wafugaji.
(d) Atahakikisha ya kuwa kumbukumbu/stakabadhi zote za >mapato na matumizi ya fedha za mfuko wa Baraza la Wafugaji zinatunzwa vizuri ili kumwezesha Mkaguzi >wa mahesabu ya fedha atakayeteuliwa kulingana na >maelekezo ya Katiba hii, anafanya kazi yake bila >matatizo yoyote.
(e)> Kuwakilisha taarifa za mapato na matumizi ya Baraza >kwa Mkaguzi wa mahesabu aliyeteuliwa ili aweze >kufanya kazi yake vizuri.
(f) Kwa kushirikiana na Mwenyekiti wa Baraza la Wa fugaji, kuitisha kikao cha Kamati kitakachojadili taarifa ya Mkaguzi wa mahesabu. Vilevile kuhakikisha ya kuwa tathmini ya Kamati ya utendaji pamoja na ushauri wake juu ya taarifa ya Mkaguzi wa mahesabu inafikishwa kwenye kikao cha baraza la wafugaji kwa >majadiliano na uamuzi wa mwisho.
(g) Kuandaa bajeti ya Baraza la wafugaji kwa kuzishirikisha serikali za vijiji, kamati za maendeleo za kata na menejimenti ya Shirika la Mamlaka ya Hifadhi ya Ngorongoro na kuhakikisha bajeti hiyo inazingatia malengo na madhumuni yaliyomo kwenye katiba hii.
(h) Kuhakikisha ya kuwa Baraza la Wafugaji linapata taarifa ya mapato na matumizi kila baada ya miezi mitatu.
(i) Atahakikisha stakabadhi zinatolewa kwa michango yote >ya kutunisha mfuko wa Baraza la Wafugaji.
(iv) Naibu Mweka Hazina atafanya shughuli zote anazozifanya mweka hazina kulingana na maelekezo atakayopewa na Mweka Hazina.
(v) Viongozi wa Kamati ndogondogo ambazo ni za muda watakuwa Mwenyekiti na Katibu tu wa Kamati hizo ambao wataziongoza kamati hizi za muda. Viongozi hawa watachaguliwa na wajumbe wa kamati hizi za muda. >Viongozi hawa pamoja na kamati hizi ndogo watashikilia >nafasi hizo kulingana na muda wa utekelezaji wa majukumu >ambayo Kamati hizi zimepangiwa.
3.0> >SEHEMU YA TATU: WAJUMBE WA BARAZA LA WAFUGAJI>
3.01> >Uandikishaji wa Wajumbe wa Baraza la Wafugaji:
(i) Majina ya wajumbe wa Baraza la Wafugaji wote yatawekwa >kwenye orodha itakayotunzwa na Katibu.
(ii) Kila mjumbe wa Baraza la Wafugaji atajaza stakabadhi maalum ambayo ndiyo itakuwa ni kitambulisho cha ujumbe wake. Stakabadhi hiyo, pamoja na kuelezea nafasi ya mjumbe mhusika itakuwa na sahihi ya mwenyekiti na >mjumbe mhusika, na itahusu wajibu wa mjumbe kuilinda na kuitekeleza katiba hii.
3.02> Haki na Wajibu wa Wajumbe:
(a)> >Wajibu wa Wajumbe:>
(i) Kuhakikisha ya kuwa wamepata nafasi hii ya uwaki-lishi kutoka aidha Serikali ya Kijiji, Kamati ya >maendeleo ya Kata au Menejiment ya Shirika, au uwakilishi wa Malaigwanani, akinamama na vijana >kutoka kwenye kila Kata ndani ya Hifadhi ya Ngorongoro.>
(ii) Kutokosa biriafsi kuhudhuria vikao vitatu mfululizo >au vikao vitano kwa mwaka wa fedha husika bila >sababu za msingi zinakubalika na Baraza la Wafugaji.>
(iii) >Kutekeleza kikamilifu majukumu yote watakayo-pangiwa na Baraza la Wafugaji.
(iv) Kulinda kuitetea na kushiriki katika marekebisho ya katiba hii kulingana na taratibu zilizopo ndani ya >katiba hii.>
(b)> Haki za mjumbe wa Baraza la Wafugaji:
(i) Kuhudhuria vikao vyote vya Baraza la Wafugaji.
(ii) Kugombea nafasi yoyote ya uongozi wa Baraza la Wafugaji kulingana na Katiba hii.
(iii) Kushiriki kikamilifu katika kutambua matatizo ya >wale anaowawakilisha na kutoa mchango wa mbinu na mikakati ya ufumbuzi wa matatizo yanayo kwamisha maendeleo yao. Vilevile kushiriki kikamilifu katika utatuzi wa matatizo yanayokwamisha maendeleo kulingana na mbinu pamoja na mikakati iliyopitishwa na Baraza la Wafugaji.>
(iv) Kuchagua viongozi wa ngazi zote za Baraza la wafu-gaji kulingana na maelekezo ya Katiba hii.
3.03 Wajumbe wa Baraza la Wafugaji kujaza stakabadhi maalum: Yahusuyo kipengele hiki angalia kipengele cha 3.01(ii).
4.0 SEHEMU YA NNE: kUJIUZULU, KUJIANDIKISHA TENA NA KUFUKUZWA
4.01 Kujiuzulu:
Mjumbe yeyote wa Baraza la Wafugaji anayo haki ya kujiuzulu kwenye Baraza la Wafugaji kwa kuufuata utaratibu ufuatao:
(a) >Mjumbe wa Baraza la Wafugaji kumwandikia Mwenyekiti wa Baraza la Wafugaji barua na kueleza sababu za kujiuzulu.>
(b)> >Kamati ya Utendaji kuijadili na kutoa uamuzi juu ya suala hilo.>
(c) Endapo Kamati ya Utendaji itaridhika na sababu za mwombaji basi, mwombaji atajulishwa kwa maandishi juu ya uamuzi uliopitishwa.
(d)> >Endapo Kamati ya Utendaji haitaridhika na sababu zilizotolewa na mwombaji, mwombaji atajulishwa kwa maandishi juu ya uamuzi uliopitishwa.>
(e)> >Endapo mwombaji atasisitiza juu ya dhamira yake ya >kujiuzulu kwa maandishi basi ataruhusiwa kujiuzulu.
4.02> >Kujiandikisha tena au kujaza nafasi zilizoachwa wazi kwa sababu za aidha kujiuzulu au kufukuzwa kwa mjumbe wa Baraza la Wafugaji:
4.02.1> Kujiandikisha tena ujumbe wa Baraza la Wafugaji kwa mjumbe aliyejiuzulu:
Mjumbe aliyejiuzulu kwa sababu zozote hatapewa nafasi ya kujiandikisha tena ujumbe wa Baraza la Wafugaji hadi hapo Baraza jipya la Wafugaji litakapoundwa. Kipindi cha kuzuiwa kujiandikisha tena kwa mjumbe aliyejiuzulu hakitazidi miaka mitatu.
4.02.2> >Kuajiandikisha tena ujumbe wa Baraza la Wafugaji >kwa mjumbe aliyefukuzwa:
Mjumbe aliyejiuzulu kwa sababu zozote hatapewa nafasi ya kujiandikisha tena ujumbe wa Baraza la Wafugaji hadi baada ya muda wa mabaraza mawili (kuanzia afukuzwe) yafuatayo ya wafugaji kupita.
Kipindi cha kuzuiwa kwa mjumbe aliyefukuzwa katika Baraza la Wafugaji kujiandikisha tena hakitapungua miaka sita lakini hakitazidi miaka tisa.
4.02.3 >Ujazwaji wa nafasi zilizoachwa wazi na mjumbe/>wajumbe waliojiuzulu au kufukuzwa:
Chombo au taasisi ambayo mjumbe aliyejiuzulu au kufukuzwa anatoka ndicho/ndiyo itapaswa/kitapaswa kumteua mwakilishi wao mpya atakayejaza nafasi ya mwakilishi wao aliyeondolewa.
> Hivyo kama mjumbe mhusika ni Mwenyekiti wa kijiji basi Serikali ya Kijiji husika itateua mwakilishi wao mwingine ambaye ni mjumbe wa Serikali ya Kijiji. >Kama mjumbe mhusika ni diwani basi Kamati ya >maendeleo ya Kata itapaswa kuteua mwakilishi wao mwingine mpya ambaye ni mjumbe wa Kamati ya Maendeleo ya Kata. Uchaguzi wa mwakilishi wa akina mama, vijana au viongozi wa kijadi utafanywa na Baraza la Wafugaji kwa kuchagua moja ya majina mawili kutoka katika Kata mbili ambazo zinapaswa kushirikiana kutoa mwakilishi mmoja kulingana na kipengele cha 5.01. Mapendekezo ya majina hayo mawili yatafanywa na kamati za maendeleo za kata zinazohusika. Kama >mjumbe mhusika ni mwakilishi wa menejimenti ya >Shirika basi menejimenti ya shirika itateua mwakilishi wao mwingine ambaye ni mjumbe wa menejimenti ya Shirika.>
4.03 Kufukuzwa au kupoteza haki za ujumbe wa Baraza la Wafugaji:
Mjumbe wa Baraza la Wafugaji anaweza kupoteza nafasi ya >ujumbe na hivyo kuondolewa kwenye orodha ya wajumbe wa >Baraza la Wafugaji.>
Sababu ambazo zitasababisha mjumbe wa Baraza la Wafugaji kupoteza haki ya kuwa mjumbe:
(i) Kushindwa kwake kutekeleza wajibu wake kama mjumbe wa Baraza la Wafugaji. Wajibu wa wajumbe >wa Baraza la Wafugaji umeelezwa katika kipengele >cha 3.02(9);>
(ii) Kuwa na maradhi ya akili au afya mbaya kwa kipindi >kirefu na hivyo kushindwa kutekeleza wajibu wake;>
(iii) Kutohudhuria vikao vitatu anavyopaswa kuhudhuria mfululizo bila sababu inayokubalika;
(iv) Kushitakiwa kwa kosa lolote la jinai kwa mujibu wa sheria za nchi na kupatikana na hatia na kufungwa;
(v) Iwapo atatamkwa kwa mujibu wa sheria za nchi kuwa >yeye ni mufilisi, ili mradi tu tathmini ya sababu hizo na nyinginezo zozote ambazo zitasababisha mjumbe kupoteza haki ya kuwa mjumbe itafanywa na Kamati >ya Utendaji. Taarifa ya tathmini hii itafikishwa na >Mwenyekiti wa Baraza la Wafugaji kwenye kikao cha >Baraza la Wafugaji ili uamuzi wa mwisho utolewe.
5.0 SEHEMU YA TANO: UUNDAJI WA TAASISI ZA BARAZA LA WAFUGAJI NA UCHAGUZI WA VIONGOZI
5.01 Uundaji wa Baraza la Wafugaji:
Baraza la Wafugaji litakuwa na muundo ufuatao:
(i) Mwenyekiti wa Baraza la Wafugaji;
(ii)> Makamu Mwenyekiti wa Baraza la Wafugaji;
(iii) >Katibu wa Baraza la Wafugaji;>
(iv)> Mweka Hazina wa Baraza la Wafugaji;
(v)> Naibu Mweka Hazina wa Baraza la Wafugaji;
(vi)> >Madiwani sita kutoka kata sita za Tarafa ya Ngorongoro ambazo ni:>

(vii) Wenyeviti wa Serikali za vijiji 14 vya Tarafa ya Ngorongoro.

(x) Mwakilishi 1 (mmoja) kutoka menejimenti ya Shirika ambaye atakuwa ni mhifadhi Mkuu wa Mamlaka ya Hifadhi ya Ngorongoro;
(xi) Wawakilishi 6 (sita) wa Vijana watakaochaguliwa na vijana wenyeji katika Hifadhi ya Ngorongoro.
5.02.1> Uundaji wa Kamati ya Utendaji:
Itakuwa na Wajumbe wafuatao:
(i) Mwenyekiti wa Baraza la Wafugaji;
(ii) Makamu Mwenyekiti wa Baraza la Wafugaji;
(iii) Katibu wa Baraza la Wafugaji;
(iv) Mweka Hazina wa Baraza la Wafugaji;
(v) Madiwani 6 (sita) wa Kata zote za Tarafa ya Ngorongoro;
(vi) Kiongozi 1 (mmoja) wa Kijadi atakayetokana na wale viongozi sita wa kijadi:
(vii) Mwakilishi (1) mmoja kutoka Wanawake (6) waliochaguliwa na Wanawake wenyeji;
(viii) Mwakilishi 1 (mmoja) wa Menejimenti ya Shirika ambaye ni Mhifadhi Mkuu;
(ix) Mwakilishi 1 (mmoja) kutoka kwa Vijana sita waliochaguliwa na vijana wenzao;
5.02.2> Muda wa Baraza:
Baraza la Wafugaji litafanya kazi kwa kipindi cha miaka mitano na baada ya kipindi hicho kuisha uchaguzi mpya wa Baraza jipya la Wafugaji utafanyika:
5.03 Uchaguzi wa Mwenyekiti wa Baraza la Wafugaji:
(i) Katika utaratibu wa kawaida nafasi hii itagombewa mara moja kila baada ya miaka mitano. Nafasi hii itaombwa na wajumbe wa Baraza la Wafugaj i wenye nia ya kujaza nafasi hii kwa kujaza fomu maalum ya uchaguzi. Majina ya wagombea wote wa nafasi hii yatapigiwa kura kwenye Baraza la Wafugaji. Wagombea wote ni lazima wawe ni wajumbe wa Baraza la Wafugaji. Utaratibu wa kura za siri utatumika. Kikao cha Baraza la Wafugaji kitateua baadhi ya wajumbe wa Baraza la Wafugaji ambao watahesabu kura hizo. Wateule wa kuhesabu kura itabidi wawe hawajagombea nafasi yoyote inayohusika na uchaguzi huo. Kwa vile uchaguzi wa nafasi hii utakwenda sambamba na uchaguzi wa nafasi nyingineza Baraza la wafugaji, basi kikao hiki cha uchaguzi wa viongozi wa Baraza la Wafugaji kitateua viongozi wa muda ambao ni Mwenyekiti na Katibu. Viongozi wa muda wataendesha kikao kimoja tu cha uchaguzi na viongozi hao wa muda ni sharti wawe hawajagombea nafasi yoyote ya uongozi katika uchaguzi huo unaohusika. Matokeo ya uchaguzi yatakayotangazwa na Mwenyekiti wa muda yatakuwa ni ya mwisho. Mgombea atakuwa na nafasi ya kukata rufaa mahakamani katika mahakama yenye mamlaka kutengua uamuzi huo na kama hakuridhika na jinsi uchaguzi huo ulivyofanyika ama hakuridhika na matokeo ya uchaguzi huo na atatakiwa afanye hivyo katika muda wa siku (14) kumi na nne kutokea >siku ya uchaguzi vinginevyo haki yake ya kukata rufaa atakuwa ameipoteza. Mrufani huyo atalipa gharama zote ambazo Baraza litakuwa limetumia >iwapo atashindwa katika rufaa hiyo isipokuwa kama mahakama itaamuru vinginevyo.>
(ii) >Iwapo Mwenyekiti wa Baraza la Wafugaji atafariki, >ama atapata ugonjwa wowote utakaomfanya ashindwe kuendelea na kazi zilizotajwa katika katiba hii au nyinginezo za manufaa kwa madhumuni ya katiba hii, na hawezi tena kuendelea na shughuli au kazi au madaraka yake kabla ya kipindi cha uongozi wake kumalizika na taarifa kufikishwa katika Baraza la Wafugaji, Katibu wa Baraza la Wafugaji, kwa idhini ya Baraza la wafugaji na utaratibu wa kuitisha >vikao uliopendekezwa katika katiba hii ataitisha >mkutano wa wajumbe wa baraza la wafugaji katika muda wa siku 30 kumchagua Mwenyekiti mwingine mpya wa baraza kwa kufuata taratibu zote za uchaguzi zilizokubalika katika katiba hii. Isipokuwa katika kipindi hicho cha kuelekea katika uchaguzi huo wa muda Baraza la Wafugaji litateua mwenyekiti wa baraza la wafugaji wa muda kushika nafasi hiyo na madaraka yake yatakwisha mara tu baada ya uchaguzi huo mdogo kumalizika.>
5.04> Uchaguzi wa Makamu Mwenyekiti wa Baraza:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03.
(ii) IIi mradi tu iwapo Makamu Mwenyekiti wa Baraza kwa sababu kama zilizoelezwa katika kifungu 5.03(ii) hapa juu atashindwa kuendelea na kazi zake au madaraka yake au majukumu yake Katibu wa Baraza la Wafugaji katika muda wa siku 14 kuanzia siku hali hiyo ilipojitokeza ataitisha kikao cha dharura haraka iwezekanavyo kwa mujibu wa taratibu za Katiba hii na kwa kufuata taratibu za katiba hii na kwa kufuata taratibu za uchaguzi zilizopendekezwa katika katiba hii baraza la wafugaji litateua Makamu Mwenyekiti mpya wa Baraza la Wafugaji.
5.05> Uchaguzi wa Katibu wa Baraza la Wafugaji:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03.
(ii) IIi mradi tu iwapo Katibu wa Baraza la Wafugaji kwa sababu kama ilivyoelezwa katika kifungu 5.03(ii) hapa juu atashindwa kuendelea na kazi zake au madaraka yake au majukumu yake katika muda wa siku 14 kuanzia siku hali hiyo ilipojitokeza. Mwenyekiti wa Baraza la Wafugaji ataitisha kikao >cha dharura haraka iwezekanavyo kwa mujibu wa >taratibu za Katiba hii na kwa kufuata taratibu za katiba >hii na kwa kufuata taratibu za uchaguzi zilizope->ndekezwa katika katiba hii Baraza la Wafugaji >litateua Katibu mpya wa Baraza la Wafugaji.
Mwenyekiti wa Baraza la Wafugaji atateua Katibu wa muda >na kuitisha kikao katika muda wa siku 14.
5.06> Uchaguzi wa Mweka Hazina wa Baraza la Wafugaji:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03.
(ii) Iwapo kwa sababu kama zilizotajwa katika kifungu 5.03(ii) Mweka Hazina wa Baraza la Wafugaji >atashindwa kuendelea na kazi zake au majukumu yake ya kikazi Katibu wa Baraza katika muda wa >siku 14 kuanzia siku hali hiyo ilipojitokeza ataitisha haraka iwezekanavyo kikao cha Wajumbe wa Baraza la Wafugaji ili kumteua au kumchagua Mweka Hazina wa Baraza la Wafugaji mpya kufuata taratibu zilizowekwa za uchaguzi za Katiba hii. Isipokuwa tu >katika kipindi hicho cha kuelekea uchaguzi mdogo, >Naibu Mweka Hazina wa Baraza la Wafugaji atakaimu nafasi hiyo na mara baada ya uchaguzi, ukaimu wake utamalizika.>
5.07> Uchaguzi wa Naibu Mweka Hazina wa Baraza la Wafugaji:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03.
(ii) Ili mradi iwapo kwa sababu kama zilivyotajwa katika kifungu 5.03(ii) Naibu Mweka Hazina wa Baraza la Wafugaji atashindwa kuendelea na kazi zake na majukumu yake ya kikazi Katibu wa Baraza atafanya kama inavyoelezwa katika kifungu cha 5.05(ii) ili. >kumchagua Naibu Mweka Hazina wa Baraza.
5.08> Uchaguzi wa Wajumbe wa Kamati ya Utendaji:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03. Na nafasi itajazwa na mmoja wa wajumbe wa Baraza la Wafugaji ambaye tayari amekwisha kuchaguliwa kujaza nafasi ya ujumbe wa >Kamati ya Utendaji.
5.09> >Taratibu za Uchaguzi wa Viongozi wa aina nyingine zozote zile:
(i) Taratibu za uchaguzi ni kama zilivyoelezwa kwenye kipengele 5.03; na iwapo itatokea nafasi wazi kwa >sababu zilizotajwa katika kifungu 5.03(ii) au 4.01 >taratibu za ujazwaji nafasi hiyo zitakuwa kama zilivyoelezwa katika vifungu 4.02.3 na 5.08 vya >katiba hii.
(ii) Kutokana na uchache wa nafasi za uwakilishi katika Baraza la Wafugaji katika nyanja za akina mama, >viongozi wa kijadi na vijana utaratibu ufuatao utatumika: Kamati za maendeleo za kata mbili zilizounganishwa katika kupata wawakilishi wao pamoja zitatoa mapendekezo yao ya jina moja kwa kila nyanja tatu husika ili Baraza la Wafugaji liteue mjumbe mmoja kwa kila nyanja atayewakilisha kata >hizo mbili. Mapendekezo ya Kamati za maendeleo >za Kata yatazingatiwa na Baraza la wafugaji katika kujaza nafasi hizi. Kanda ya Kaskazini ina kata za Naionokanoka na Naiyobi, Kanda ya kati ina kata za >Ngorongoro na kata ya Olbalbal.
5.10 Uteuzi wa Wakaguzi wa Kura zilizopigwa:
Majina yasiyopungua matano na yasiyozidi kumi ya wajumbe wa Baraza la Wafugaji, yatapendekezwa kwenye kikao >hicho cha uchaguzi. Wajumbe waliopendekezwa kukagua >matokeo ya kura ni lazima wawe hawajaomba nafasi yoyote ya uchaguzi husika. Kura za siri zitapigwa na wajumbe wa Baraza la Wafugaji kuchagua majina matatu ya wakaguzi wa kura zilizopigwa. Wagombea wa nafasi zilizopigiwa kura kwa wakati huo wanayo nafasi ya kuteua mjumbe wa baraza la wafugaji kwa kila mmoja wa wagombea kukagua kura ili> >kuhakikisha haki inatendeka. Matokeo ya kura hizo yatawakilishwa na wakaguzi wa kura hizo katika fomu maalum walizozijaza na kuweka saini zao pamoja na saini za wajumbe wa baraza, wawakilishi wa wagombea kama wapo, kwa mwenyekiti na Katibu wa muda wa uchaguzi huo. Mwenyekiti wa muda atatangaza matokeo hayo ya uchaguzi mara matokeo hayo yatakapotangazwa viongozi wapya wateule watachukua majukumu yao mara moja.>
5.11> >Kamati ya utendaji teule kuchukua majukumu yake mara tu baada ya uchaguzi:
Mara tu baada ya nafasi zote za uongozi kujazwa katika uchaguzi huo. Kamati ya utendaji teule itachukua majukumu yake yote katika kikao hicho cha uchaguzi. Hii itaashiriwa na Mwenyekiti wa muda wa uchaguzi kumkabidhi Mwenyekiti mteule Katiba ya baraza la >Wafugaji kama ishara ya kumtaka na kumkumbusha >Mwenyekiti mteule kulinda na kutetea Katiba ya Baraza la Wafugaji.>
5.12> Wajumbe wa Kamati ya utendaji kupoteza haki za ujumbe wa Kamati hiyo ya Baraza la Wafugaji:
Sababu za wajumbe wa Kamati ya Utendaji kupoteza haki za Ujumbe wa Kamati hiyo ya Baraza la Wafugaji ni kama ifuatavyo:
(i) Mjumbe wa Kamati ya Utendaji kupoteza sifa za ku-wa mjumbe wa Baraza la wafugaji kama inavyoelekezwa kwenye namba 4.03 kwenye Katiba hii;
(ii) Mjumbe wa Kamati ya utendaji kutohudhuria vikao vitatu mfululizo au jumla ya vikao vitano vya Kamati ya utendaji kwa mwaka bila sababu za msingi;
(iii) Mjumbe kwa sababu zozote zile hatakuwepo kwenye eneo la Hifadhi ya Ngorongoro kwa kipindi kisichopungua miezi sita mfululizo;
(iv) Mjumbe kuwa na mwenendo usioridhisha na hivyo >kuzorotesha shughuli za Kamati ya Utendaji. Tathmini ya moja au yoteyaliyotajwa katika kipengele 5.11> >itafanywa na kamati ya Utendaji na >mapendekezo ya Kamati ya utendaji yatapelekwa >kwenye Baraza la Wafugaji kwa uamuzi wa mwisho. >Uamuzi wa Baraza la Wafugaji juu ya hili suala >utakuwa wa mwisho na hapatakuwa na nafasi ya >rufaa kwa mjumbe mhusika.
5.13> SIFA ZA MGOMBEA WA NAFASI YA MWENYEKITI WA >BARAZA LA WAFUGAJI:
(i) Awe na umri usiopungua miaka 21 (ishirini na moja);
(ii) Awe anajua kusoma na kuandika;
(iii) Awe na elimu ya wastani itakayomwezesha kuteke->leza kazi za madaraka yake;
(iv) Awe ni mfugaji mwenyeji mkazi wa Hifadhi ya Ngo>rongoro;>
(v) Awe mwenye akili timamu na ambaye hajatiwa hatiani kwa kosa lolote lile la jinai au kupata kifungo kwa mujibu wa sheria za nchi ama kutamkwa kuwa ni >mufilisi kwa mujibu wa sheria za ufilisi za nchi ya >Tanzania.>
5.14> >SIFA ZA MGOMBEA WA NAFASI YA KATIBU WA BARAZA LA WAFUGAJI:
(i) Awe na umri si chini ya miaka 18;
(ii) Awe anajua kusoma na kuandika kuzungumza >Kiswahili fasaha;
(iii) Awe na elimu ya darasa la saba au zaidi ya kumwezesha kutekeleza kazi na madaraka yake;
(iv) Awe ni mfugaji mwenyeji mzawa mkazi wa eneo la >Hifadhi ya Ngorongoro;
(v) Awe mwenye akili timamu na ambaye hajatiwa hatiani kwa kosa lolote lile la jinai au kupata kifungo kwa mujibu wa sheria za nchi ama kutamkwa kuwa ni mfilisi kwa mujibu wa sheria za ufilisi za nchi ya Tanzania.
5.15> >SIFA ZA MGOMBEA WA NAFASI YA MWEKA HAZINA NA NAIBU MWEKA HAZINA WA BARAZA LA >WAFUGAJI:
(i) Awe na umri si chini ya miaka 21;
(ii) Awe anajua kusoma na kuandika kuzungumza Kiswahili fasaha, na awe na elimu ya kutosha ya mafunzo ya kazi ya uhasibu;
(iii) Awe ni mfugaji mwenyeji mzawa mkazi wa eneo la Hifadhi ya Ngorongoro;

5.16> >SIFA ZA MGOMBEA FUJUMBE WA KAMATI YA UTENDAJI:

5.17> >Ujazwaji wa nafasi zilizoachwa wazi na mjumbe/wajumbe wa >Kamati ya utendaji kwa sababu zilizotajwa kwenye kipengele >cha 5.12:
Ujazwaji wa nafasi zilizotajwa kwenye kepengele hiki cha 5.12 utazingatia maelekezo yaliyopo kwenye vipengele 4.02.3 na 5.08 vya Katiba hii.
6.0 SEHEMU YA SITA: UENDESHAJI WA VIKAO, MADARAKA NA MAJUKUMU YA KAMATI YA UTENDAJI YA BARAZA LA WAFUGAJI
6.01 Kamati ya Utendaji ya Baraza la Wafugaji kusimamia shughuli >za Baraza la Wafugaji:
Suala hili ni kama ilivyoelekezwa kwenye kipengele cha 2.03(b) cha katiba hii.
6.02> Vikao vya Kamati ya utendaji ya baraza la Wafugaji:
Kamati ya utendaji itakutana angalau mara moja kila mwezi ill> >iweze kutekeleza majukumu yake yaliyofafanuliwa kwenye kipengele cha 2.03(b) cha katiba hii.>
6.03> >Taarifa za vikao:
Taarifa za vikao vya kamati ya utendaji zitatolewa na Katibu wa Baraza la Wafugaji kwa maandishi angalau wiki >moja kabla ya vikao. Agenda zilizokwisha andaliwa >zitaonyeshwa kwenye taaarifa hiyo ya kikao. Taarifa hiyo ya kikao itasainiwa na kiongozi mhusika wa kutoa taarifa hiyo.>
6.04> >Mwenyekiti wa Vikao vya Kamati ya utendaji vya baraza la Wafugaji:
Vikao vyote vya Kamati ya utendaji vitaendeshwa na kusimamiwa na Mwenyekiti wa Baraza la Wafugaji. Endapo Mwenyekiti wa Baraza la Wafugaji hayupo basi mmoja wa wajumbe wa kawaida (yaani wasio na nyadhifa za uongozi maalumu kama Mwenyekiti, Katibu, Mweka Hazina, Naibu Mweka Hazina) ataongoza kikao hicho Uchaguzi wa Mwenyekiti wa muda wa kikao hicho utafanyika kwa siri.
6.05> >Uahirishaji wa vikao vya Kamati ya utendaji vya Baraza la Wafugaji:
Hoja ya kuahirishwa kikao cha Kamati ya utendaji inaweza kutolewa na mjumbe yeyote wa Kamati ya utendaji. Hoja hiyo ni lazima iungwe mkono na nusu ya wajumbe wote ili iweze kukubalika kwa ajili ya utekelezaji.
6.06> >Uwakilishi wa wajumbe/Mjumbe wa Kamati ya Utendaji kwenye vikao vya Kamati ya utendaji ya baraza Ia wafugaji ambavyo wajumbe/mjumbe ameshindwa kuhudhuria:
Mjumbe wa Kamati ya utendaji anao uwezo wa kumteua mwakilishi wake kutoka chombo au taasisi anayoiwakilisha.
Mwenyekiti wa Kijiji anao uwezo wa kumteua mjumbe yeyote kutoka Serikali ya Kijiji chake ili amwakilishe kwenye vikao vya Kamati ya utendaji kama yeye ni mjumbe wa Kamati hiyo. Madiwani wanao uwezo wa kuteua mjumbe yeyote kutoka Kamati ya Maendeleo ya Kata ili wawakilishwe kwenye vikao vya kamati ya utendaji.
Kiongozi wa kijadi au mwakilishi wa akina mama ambaye ni mjumbe wa Kamati ya utendaji anao uwezo wa kumteua mjumbe >yeyote kutoka baraza la wafugaji kwa kofia ya kuwakilisha >matakwa ya kundi lake yaani: Kundi la uwakilishi wa viongozi wa kijadi au kundi la uwakilishi wa akina mama ndani ya Baraza la wafugaji.>
Mjambe anayeiwakilisha menejimenti anao uwezo wa kumteua mjumbe wa menejimenti ambaye yupo kwenye orodha ya >wajumbe wa menejimenti kumuwakilisha kwenye vituo vya Baraza la wafugaji.
(Vyeo vya wajumbe wa menejimenti wanaoweza kuwakilisha kwenye vikao vya baraza la wafugaji na Kamati ya Utendaji wa Baraza la Wafugaji vipo kwenye kipengele cha 1.09 cha Katiba hii.)
6.07> >Madaraka ya Kamati ya utendaji ya Baraza la Wafugaji kuteua Kamati maalumu:
Kamati ya utendaji ya Baraza la wafugaji inao uwezo wa kuteua kamati maalum yenye kujumuisha wajumbe au wasio wajumbe wa Baraza la wafugaji ili mradi Kamati hiyo teule ikubaliwe na >Baraza la Wafugaji.
Baraza la wafugaji litaangalia malengo na majukumu ya Kamati hiyo teule kama yanahalalisha uteuzi wa Kamati hiyo, aina na idadi ya wajumbe wa Kamati hiyo ili kuona kama wanayosifa na ujuzi wa kuyatekeleza majukumu ya kamati hiyo kisha, litatoa >ridhaa ya Kamati kuteua kamati hiyo maalumu.
Hata hivyo Kamati hizi maalumu zilizoteuliwa na Kamati ya utendaji zinaweza kuanza kazi kutokana na unyeti wa majukumu yaliyopewa Kamati hizo na ridhaa ya Baraza la Wafugaji ikatafutwa baadaye. Ridhaa ya Baraza la Wafugaji inalipa uwezo baraza kukubaliana au kutokubaliana na mapendekezo ya Kamati >ya utendaji bila ya kujali kama Kamati hizo zimeanza kazi.
6.08> >Madaraka ya Kamati ya utendaji ya Baraza la Wafugaji kuteua wawakilishi:
Kamati ya utendaji inao uwezo wa kuteua wawakilishi wa Baraza la Wafugaji katika masuala yahusuyo Baraza la Wafugaji. Hata hivyo, wawakilishi hao ni lazima wawe wajumbe wa Baraza la Wafugaji.
6.09> >Mlezi/Walezi wa Baraza la Wafugaji:
Endapo umuhimu utajitokeza wa kuwa na Mlezi/Walezi wa Baraza basi, uamuzi huo utafanywa na Baraza la wafugaji baada ya kutafakari taarifa ya suala hili itakayoletwa na Kamati ya utendaji.
6.10 Muhtasari wa vikao na utekelezaji wa agenda za vikao:
Dondoo za vikao vitachukuliwa na Katibu wa Baraza la Wafugaji.
Dondoo hizi zitahusisha vikao vya Kamati ya utendaji ya Baraza la Wafugaji.
Agenda za vikao zitapelekwa kwa Katibu kulingana na taratibu za uandaaji wa agenda zilizopo kwenye kipengele cha 8.13 cha Katiba hii.
>Agenda zote zitakazoletwa zitajadiliwa na Kamati ya utendaji >na taarifa ya agenda hizo itapelekwa na Mwenyekiti kwenye >baraza la Wafugaji kwa uamuzi wa mwisho.
Agenda zitakazojadiliwa na Kamati ya utendaji ni zile zinazohusu utekelezaji wa sera za Baraza la Wafugaji. Taarifa ya utekelezaji wa agenda hizo itawakilishwa na Mwenyekiti wa baraza la Wafugaji.
6.11 Uteuzi wa Msaidizi wa Katibu na Wafanyakazi wengine:
Kazi hii itafanywa na Kamati ya utendaji kwa niaba ya Baraza la Wafugaji.
6.12 Kazi za viongozi wa Kamati ya utendaji ya Baraza la Wafugaji:
Kazi hizi zimetajwa katika kipengele cha 2 03(b) cha Katiba hii.
7.0> >SEHEMU YA SABA: VIKAO>
7.01> >Sehemu za kufanyia vikao:
Sehemu za kufanyia vikao vya aina zote kama vinavyotajwu katika Katiba hii zitachaguliwa na kamati ya utendaji.
7.02> >Vikao:
Vitakuwepo vikao vya aina zifuatazo:
(i)> >Vikao vya kawaida vya Kamati ya utendaji ya Baraza la >wafugaji;
(ii)> >Vikao vya kawaida vya Baraza la wafugaji:>
(iii)> >Vikao visivyo vya kawaida vya Kamati ya utendaji;>
(iv)> >Vikao visivyo vya kawaida vya Baraza la wafugaji;>
(v)> >Vikao vya Kamati ndogondogo au Kamati maalum;>
(vi)> >Kikao cha mwaka cha Bajeti cha Baraza la Wafugaji.>
7.03> >Vikao vya Kawaida:
(i) Vikao vya kawaida vya Kamati vitafanyika mara moja kila mwezi. Sehemu kubwa ya vikao hivyo itakuwa in kutathmini >utekelezaji wa mipango mbalimbali ya utekelezaji wa >Baraza la Wafugaji.>
(ii) Vikao vya kawaida vya Baraza la Wafugaji vitafanyika mara moja kila baada ya miezi mitatu. Sehemu kubwa ya vikao hivyo itakuwa kupokea, kujadili na kuitolea maamuzi taarifa ya utekelezaji wa shughuli mbalimbali za Kamati ya Utendaji.
7.04> >Kikao cha mwaka cha Bajeti ya Baraza la Wafugaji:
Patakuwepo na kikao kimoja cha kila mwaka cha Baraza la >Wafugaji kwa mwaka wa fedha unaofuata. Kikao hicho vile vile >kitatathmini taarifa ya ufanikishaji wa mipango ya utekelezajina utekelezaji wa bajeti ya mwaka wa fedha ulipita na kitatumika vilevile kuhakikisha> ya kuwa kinatoa dira ya maandalizi ya mipango ya utekelezaji wa bajeti ya mwaka wa fedha ujao. Vilevile kikao hicho kitahakikisha ya kuwa mipango ya utekelezaji wa bajeti ya mwaka unaofuata inazingatia kikamilifu malengo na madhumuni ya kuundwa baraza la wafugaji yaliyomo kwenye katiba hii.>
7.05> >Vikao visivyo vya kawaida vya Baraza la Wafugaji na Kamati>ya Utendaji:
Vikao hivi vitaitishwa kuangalia masuala yasiyo ya kawaida yanayohusu vikao hivyo. Baadhi ya masuala hayo ni yale ambayo yataonekana ni nyeti na yanaweza kuharibu ufanikishaji wa malengo na/au madhumuni ya kuundwa Baraza la wafugaji yaliyomo kwenye katiba hii.
7.06> >Vikao visivyo vya kawaida vya baraza la wafugaji vya >kurekebisha Katiba au taratibu nyingi zilizopo:
Mazingira ya kuitisha vikao hivi ni sawa na mazingira yaliyoelezwa kwenye kipengele cha 7.05.
7.07 Vikao vingine:
Vikao vya Kamati ndogo ndogo/maalumu vitapangwa kulingana na unyeti wa masuala ambayo Kamati hizo za muda zitashughulikia.
7.08 Taarifa ya vikao vya Baraza la Wafugaji:
Taarifa ya Kikao cha mwaka cha Baraza la Wafugaji itatolewa mwezi mmoja kabla ya kikao hicho ili kutoa nafasi ya maandalizi ya kutosha ya kikao hicho na kwa vikao visivyo vya kawaida vya Baraza la Wafugaji taarifa ya wiki mbili kabla ya kikao itatolewa.
7.09 Kutopata taarifa kama ilivyoelekezwa kwenye kipengele cha >7.08 kwa baadhi ya wajumbe siyo sababu ya kutofanyika vikao hivyo:
Kwa sababu zisizoweza kuzuilika inawezekana baadhi ya >wajumbe kutopata taarifa ya vikao hivi wakati muafaka. Hata >hivyo, vikao hivyo vitaendelea kufanyika baada ya Katibu wa Baraza la Wafugaji kutoa maelezo ya kuridhisha kwenye vikao hivyo juu ya sababu ni kwa nini taarifa hizo zimechelewa kuwafikia wajumbe waliohudhuria kikao hicho ili kikao hicho kiweze kuendelea.>
8.0 EHEMUYANANE: TARATIBUZA UENDESHAJIWA VIKAO
8.01> >Mahudhurio:
Katika vikao vya aina zote ni lazima mahudhurio yawe ni nusu ya wajumbe wote. Endapo baada ya saa moja tangu muda wa kikao uliopangwa kuanza kupita na mahudhurio yatakuwa bado hayajafikia nusu basi kikao hicho kitakuwa kimeahirishwa hadi tarehe nyingine itakayopangwa.
Endapo mahudhurio hayajafikia nusu tena hapo baadaye katika >kikao kilichoahirishwa basi Mwenyekiti anayo madaraka ya >kuendesha kikao na wajumbe waliohudhuria ili mradi yafuatayo yamefanyika:>
(a) Ushahidi wa maandishi upo ya kuwa taarifa za wajumbe wote juu ya kikao hicho uliwafikia wakati muafaka.
(b) Theluthi mbili ya wajumbe waliopo wamepata taarifa ya kikao hicho.
8.02> Mwenyekiti wa Vikao:
Mwenyekiti wa Baraza la Wafugaji atakuwa ndiye Mwenyekiti wa kikao cha Baraza la Wafugaji na kama hayupo Mwenyekiti wa muda na Mwenyekiti wa vikao vya kamati ya utendaji vya Baraza la Wafugaji atakuwa kama ilivyoelezwa katika kifungu 6.04.
8.03> >Vikao vya kawaida kuendeshwa kwa taratibu zilizowekwa na Kamati ya Utendaji:
Kamati ya Utendaji ina madaraka ya kupanga taratibu za uendeshaji wa vikao vya kawaida vya Baraza la Wafugaji. >Katika vikao visivyo vya kawaida vya Baraza la Wafugaji, Mwenyekiti wa Baraza la Wafugaji atatoa mapendekezo ya >taratibu za kufuatwa za uendeshaji wa vikao vya dharura vya >Baraza la Wafugaji.
Kwa vikao visivyo vya kawaida vya Kamati ya Utendaji taratibu za uendeshaji za vikao hivyo zitapangwa na Kamati ya Utendaji yenyewe.
8.04> >Masuala yahusianayo na uendeshaji wa watendaji binafsi wa baraza la Wafugaji kujadiliwa kwenye vikao vya Kamati ya utendaji vya Baraza la Wafugaji au vikao vya Baraza la Wafugaji:
Nyakati za warsha au makongamano, hata kama yanahusisha wajumbe wote wa Kamati ya Utendaji au wajumbe wote wa Baraza la wafugaji siyo nafasi wala mahali pa kujadili masuala >ya utendaji binafsi wa viongozi au watendaji wa Baraza la >Wafugaji. Hivyo masuala yahusianayo na uendeshaji wa Baraza la Wafugaji yatajadiliwa kwenye vikao rasmi vya Kamati ya >Utendaji au vikao rasmi vya Baraza la Wafugaji.
8.05> >Upigaji wa kura katika vikao vya Baraza la Wafugaji:
Kura zote zitakuwa ni za siri kwa wajumbe wote wa Baraza la >Wafugaji kuandika jina au jambo wanalolitaka katika karatasi >na kuifunga vizuri.>
Wajumbe waliochaguliwa kwa ajili ya kuzikusanya karatasi hizo >za kura na kuzihesabu watapaswa kuwa ni wale wajumbe wa >Baraza la Wafugaji wasiohusika binafsi na masuala yanayopigiwa kura.>
Suala lolote ambalo itabidi liamuliwe kwa kura lazima lipatiwe >zaidi ya nusu ya kura za wajumbe wote wahopiga kura hizo.
8.06> >Upigaji wa kura katika vikao vya Kamati ya utendaji ya Baraza la Wafugaji:
Utaratibu uliotajwa wa upigaji kura katika kipengele cha 8.05 utazingatiwa.
8.07> >Mwenyekiti wa kikao chochote awe ni wa muda au wa kudumu kulingana na Katiba hii ana madaraka ya kupiga kura turufu kwenye masuala yafuatayo:
(i) Kura za pande mbili zimelingana na hivyo kura yake ya turufu itatoa ufumbuzi na mtazamo wa upande upi upitishwe;
(ii) Kura za pande zaidi ya mbili zimepigwa na upande mmoja unaoongoza kwa kura unahitaji kura moja tu ili uweze kuzidi nusu ya kura zote zilizopigwa.
Kura turufu ya Mwenyekiti inaweza kutumika kusaidia upande unaoongoza endapo Mwenyekiti wa kikao anakubaliana na mtazamo wa upande huo. >Katika uchaguzi ambao uamuzi wake umeshindwa >kufikiwa au una mazingira yanayotofautiana na kipengele cha 8.07(i) na cha 8.07(ii) basi >wagombea wawili au maswala mawili yenye kura >nyingi zaidi watapigiwa/yatapigiwa kura ya >marudio ili uamuzi uweze kufanyika kulingana na >kanuni za uchaguzi wa kipengele cha 8.05.>
8.08> >Taratibu za uchaguzi:
(i) Vikao vyote vihusuvyo Kamati ya Utendaji, taratibu >zake za uchaguzi zitazingatia kanuni za uchaguzi za kipengele cha 5.03 na 8.05 na kubuniwa na Kamati ya Utendaji.>
(ii) Vikao vyote vihusuvyo Baraza la Wafugaji taratibu >zake za uchaguzi zitazingatia kanuni za uchaguzi za kipengele cha 5.03 na 8.05 na kubuniwa na Kamati ya Utendaji.>
8.09> >Taratibu za kukaribisha wageni/wataalamu mbalimbali kwenye vikao vya Kamati ya Utendaji vya Baraza la Wafugaji:
Kamati ya utendaji kwenye vikao vyake ili kuweza kuwa na taarifa za kutosha za kuweza kutathmini masuala mbalimbali ya ubunifu na utekelezaji wa sera za Hifadhi ya Ngorongoro inaweza ikawaalika viongozi na wataalamu mbalimbali ili waweze >kuzipata taarifa hizo. >Baadhi ya maeneo ya watakakotoka waalikwa hao ni:>
(a) Shirika la Mamlaka ya Hifadhi ya Ngorongoro;
(b) >Halmashauri ya Wilaya ya Ngorongoro;>
(c) Serikalii Kuu na Serikali za Mitaa;
(d) >Mashirika ya umma, kidini, yasiyo ya kiserikali au Kampuni >za watu binafsi;
(e) >Wafadhili mbalimbali na kadhalika.>
Watu watakaoalikwa kuhudhuria vikao vya Kamati ya utendaji ya Baraza ni lazima wawe na taarifa ya maandishi na tarehe ya kikao kinachohusika.
8.10> >Taratibu za kukaribisha wageni/wataalam mbalimbali kwenye vikao vya baraza la Wafugaji:
Kulingana na maeneo yaliyotajwa katika kipengele cha 8.09 cha katiba hii, Kamati ya utendaji itatoa mapendekezo ya majina ya wageni/wataalamu kulingana na unyeti wa mchango wao kwenye baraza la wafugaji ili waalikwe kwenye vikao husika. Uamuzi juu ya mapendekezo hayo utakaopitishwa na baraza la Wafugaji utatekelezwa na Kamati ya utendaji.
8.11> >Wageni/Wataalamu mbalimbali waalikwa kutoa michango yao kwa ruhusa ya Mwenyekiti wa kikao:
Ni kwa kibali cha Mwenyekiti tu wageni/wataalamu waalikwa >watatoa michango yao kwenye vikao walivyoalikwa.>
8.12 Wageni/Wataalamu mbalimbali kutoruhusiwa kupiga kura kwenye vikao vya aina zote:
Ni wajumbe wa baraza la wafugaji tu wenye haki ya kupiga kura katika vikao vya aina zote vya baraza la wafugaji kulingana na maelekezo yaliyomo kwenye katiba hii.
8.13> >Taratibu za kuandaa agenda za Baraza la Wafugaji:
Agenda zote ambazo zitafikishwa kwenye Kamati ya utendaji kupitia Katibu wa Baraza la Wafugaji zitafuata utaratibu ufuatao:
(i) Angenda zote zipitishwe na Serikali za Vijiji na >Kamati za maendeleo za Kata na kuletwa na madiwani kwenye masuala yote yahusuyo masuala ya maendeleo vijijini katika Tarafa ya Ngorongoro;>
(ii) Agenda zote zihusuzo menejimenti ya Shirika ziwe >zimepitishwa kwenye Kamati hiyo na mjumbe >mwakilishi wa menejiment katika Baraza la Wafugaji;>
(iii) Agenda zote zihusuzo maendeleo ya akina mama katika Tarafa ya Ngorongoro zitapelekwa kwenye Kamati ya utendaji na mwakilishi wa akina mama kwenye kamati hiyo;
(iv) Agenda zote zihusuzo uongozi wa kijadi/vijana >zitapelekwa kwenye Kamati ya utendaji kupita >mwakilishi wa viongozi wa jadi au vijana kwenye Kamati hiyo.>
8.14> >Taratibu za kuandaa mipango ya utekelezaji wa bajeti ya Baraza la Wafugaji:
Taratibu hizi ni sawa na taratibu za maandishi ya agenda za vikao ambazo zimeelekezwa kwenye kipengele cha 8.13 cha >Katiba hii.>
8.15> >Taratibu za Usimamizi wa Utekelezaji wa mipango ya >Utekelezaji:
Wajumbe wote wa Baraza la Wafugaji watashiriki katika usimamizi wa Utekelezaji wa mipango ya Baraza la Wafugaji kwa utaratibu utakaobuniwa na kamati ya Utendaji na kuamuliwa >na Baraza la Wafugaji.
8.16> >Taratibu za kutathmini na utoaji wa taarifa ya ufanikishaji >wa mipango ya Utekelezaji:
Taratibu zitabuniwa na Kamati ya Utendaji na kuamuliwa na Baraza la Wafugaji.
9.0 SEHEMU YA TISA: MAPATO YA BARAZA LA WAFUGAJI
9.01 Mapato ya Baraza la Wafugaji yatatokana na mchango wa Mamlaka ya Hifadhi ya Ngorongoro, Wafadhili mbalimbali na Baraza la Wafugaji lenyewe:
10.0> >SEHEMU YA KUMI: MAPATO YA BARAZA LA >WAFUGAJI
10.01 >Usimamizi wa fedha na mali nyingine za baraza la Wafugaji:
Kamati ya Utendaji kwa niaba ya baraza la wafugaji itasimamia >fedha na mali zote za Baraza la Wafugaji.
10.02> >Masuala ya Kiuhasibu:
Kamati ya Utendaji kupita Mweka Hazina wake itaandaa kimaandishi na kila wakati takwimu zote za kiuhasibu ili kuhakikisha kuwa nyakati zote mahesabu ni sahihi na yanatoa >picha halisi ya mapato na matumizi ya Baraza la Wafugaji.
10.03> >Mwaka wa fedha na utoaji wa taarifa za mapato na matumizi:
(i) Mwaka wa fedha utaanza tarehe mosi Julai kila >mwaka na utaishia tarehe thelathini Juni ya kila mwaka. Bajeti ya Baraza la Wafugaji itaandaliwa kabla ya tarehe mosi Machi ya Kila mwaka. Mapendekezo ya bajeti ihusianayo na Baraza la Wafugaji kutoka katika Kamati za maendeleo za >Kata yatafikishwa kwenye Kamati ya utendaji kabla ya tarehe Mosi Januari ya kila mwaka;
(ii) Kamati ya utendaji itaanda taratibu za mapato na matumizi ya Baraza la Wafugaji katika vikao vyake vya kila mwezi. Kamati ya utendaji itatoa taarifa ya mapato katika kila kikao cha miezi mitatu cha Baraza la Wafugaji;
(iii) Katika kikao cha bajeti cha Baraza la Wafugaji, taarifa ya mwaka mzima ya mwenendo wa shughuli zote za Baraza la Wafugaji itatolewa na Kamati ya Utendaji kwenye kikao hicho.
10.04> >Uteuzi wa Wakaguzi wa Mahesabu ya fedha ya Baraza la >Wafugaji:
Kamati ya utendaji itatoa mapendekezo kwenye baraza la >Wafugaji juu ya uteuzi huu kulingana na sheria za Nchi ya >Tanzania za kiuhasibu kwa kuzingatia mapato na mali za baraza >kwa wakati unaohusika.
Madaraka na majukumu ya wakaguzi wateule yatakuwa ni kwa kulingana na sheria za ukaguzi huo za Nchi hii ikiwa ni pamoja na maelekezo watakayopewa na Kamati ya utendaji.
10.05> >Jina la Katiba tarehe ya kuanza kutumika na matumizi ya katiba:
(i) Jina kamili la katiba ni Katiba ya Baraza la Wenyeji Wafugaji wa eneo la Hifadhi ya Ngorongoro;
(ii) Katiba hii itaanza kutumika kuanzia tarehe itakapotolewa taarifa ya kuanza kutumika kanuni (rules) zinazohalalisha kuanza kutumika kwa Katiba hii kama taarifa itakavyotangazwa katika gazeti la Serikali;
(iii) Katiba hii itatumika katika eneo la Hifadhi ya >Ngorongoro kwa wafugaji wenyeji wanaoishi katika eneo la Hifadhi ya Ngorongoro.>
10.06 Madaraka ya Kamati ya Utendaji kufanya maamuzi yatakayoboresha ufanisi wa Baraza la Wafugaji:
Ili kupunguza urasimu usio wa lazima, Kamati ya utendaji kwa niaba ya Baraza la wafugaji inayo madaraka ya kufanya maamuzi >yatakayoisaidia kuboresha ufanisi wa Baraza la Wafugaji ili >mradi maamuzi haya yaoane na sera ambazo tayari zimekwisha kupitishwa na Bodi ya Wakurugenzi ya Shirika la Mamlaka ya Hifadhi ya Ngorongoro.>
11.0 KATIBA NA TARATIBU NYINGINE:
11.01 Taratibu za kurekebisha Katiba na taratibu nyingine:
Mapendekezo ya marekebisho ya Katiba na sheria ndogo ndogo >za kuanzisha katiba hii, itabidi yaombwe kwa maandishi na >wajumbe wa Baraza la Wafugaji wasiopungua kumi. Maombi hayo ya kimaandishi yapelekwe kwa Mwenyekiti wa Baraza la >Wafugaji yakiwa na majina na sahihi za wajumbe wahusika. >yakielezea maeneo ambayo wangependa kuona marekebisho hayo yakifanyika.>
Mwenyekiti wa Baraza la Wafugaji ataitisha kikao cha dharura cha Kamati ya utendaji katika kipindi kisichozidi mwezi mmoja tangu apate madai, kimaandishi, ya mapendekezo ya marekebisho >ya katiba hii.
Kamati ya utendaji itaandaa taarifa ya mapendekezo ya aidha >kukubaliana na marekebisho hayo au kuyapinga mapendekezo ya marekebisho hayo katika kikao cha Baraza la Wafugaji. Baraza la Wafugaji litapaswa kukutana katika kipindi kisichozidi miezi mitatu tangu maombi yatolewe ya kurekebisha katiba yaliyozingatia taratibu zilizoelezwa kwenye Katiba hii.>
Baraza la Wafugaji litayajadili mapendekezo yaliyotajwa na wajumbe wa Baraza la Wafugaji wahusika ikiwa ni pamoja na taarifa ya Kamati ya utendaji kuhusiana na suala hilo. Baada ya mjadala huo utaratibu wa kura za siri za ndiyo au hapana utatumika (kwa mwongozo wa kipengele cha 8.05 cha Katiba hii).
Ili kuondoa utata wa kitabu kipi cha Katiba na taratibu zilizopitishwa, saini zilizopitishwa na Baraza la Wafugaji ni lazima saini za Mwenyekiti na Katibu wa Baraza ziwepo kwa kila kitabu cha Katiba halisi na zaidi lazima kuwe na mhuri halisi wa Baraza la Wafugaji kwa kila ukurasa wa Katiba halisi. Vilevile marekebisho ya Katiba yaliyokubaliwa na Baraza la Wafugaji itabidi kila ukurasa wa marekebisho hayo kuwa na saini ya Mwenyekiti na Katibu wa Baraza la Wafugaji pamoja na mhuri halisi wa Baraza la Wafugaji.
Katiba za Baraza la Wafugaji zenye vivuli vya saini za Mwenyekiti wa Baraza la Wafugaji na/au kivuli cha Mhuri wa Baraza la Wafugaji hazitatambuliwa na Baraza la Wafugaji kama nakala halisi za Katiba zilizopitishwa na Baraza la Wafugaji.
11.02 Madaraka ya Kamati ya utendaji kuunda taratibu nyingine ambazo hazimo kwenye Katiba:
Kamati ya utendaji ya baraza la Wafugaji inayo madaraka ya kuunda taratibu nyingine ambazo hazimo kwenye katiba hii. Hata hivyo, ili taratibu hizo ziingizwe kwenye Katiba hii, ni lazima zipitishwe na Baraza la Wafugaji.
11.03 Tafsiri ya vipengele vyote vilivyomo kwenye Katiba hii, na taratibu nyingine zitakayofanywa na Kamati ya utendaji ya Baraza la Wafugaji kuwa ni ya mwisho:
ili> >kuondoa utata na migogoro isiyo ya lazima juu ya tafsiri au ufafanuzi wa Katiba hii na taratibu nyingine za Baraza, katiba hii, inaipa Kamati ya utendaji ya Baraza la Wafugaji uamuzi wa mwisho wa tafsiri na fafanuzi za aina zote kuhusiana na katiba hii na taratibu nyingine za Baraza la Wafugaji. Tafsiri na fafanuzi nyingine zozote ambazo si za Kamati ya utendaji ya Baraza la Wafugaji kuhusiana na Katiba hii, na/au taratibu nyingine za Baraza la Wafugaji zitakuwa si tafsiri au fafanuzi sahihi ambazo zinapaswa kufuatwa na baraza la Wafugaji.>
MWISHO
(i) Kila mjumbe wa baraza la Wafugaji anawajibika >kwa matendo yake na hatawajibika kwa matendo ya mjumbe mwingine wa baraza la Wafugaji bila kujali wadhifa wa mjumbe mhusika katika baraza la Wafugaji;>
(ii) IIi kumuwajibisha mjumbe yeyote wa Baraza la Wafugaji juu ya matendo ya aina yeyote yahusuyo >Baraza la Wafugaji, ni lazima ushahidi wenye vielelezo vya kutosha upatikane na kubainisha >kuhusika kwa mjumbe huyo wa Baraza la Wafugaji;>
(iii) Nakala za Katiba hii zisizokuwa na sahihi za Mwenyekiti na Katiba wa Baraza la Wafugaji >pamoja na mhuri halisi wa Baraza la Wafugaji hazitatambuliwa na baraza la Wafugaji;
(iv) Katiba hii ni mali ya Baraza la Wafugaji, hivyo ni >KOSA LA JINAI kwa mtu, kikundi au Taasisi >yoyote kutumia yaliyomo kwenye Katiba hii iwe ni sehemu au ni Katiba yote, kwa shughuli yoyote ile bila kwanza kupata kibali cha Kamati ya Utendaji ya Baraza la Wafugaji.> {/mprestriction}
