THE NATIONAL SPORTS COUNCIL (REGISTRATION OF SPORTS ASSOCIATIONS) (FORMS AND FEES) REGULATIONS

(Section 28)

    1. These Regulations may be cited as the National Sports Council (Registration of Sports Associations) (Forms and Fees) Regulations.

    2. In these Regulations, unless the context require otherwise–

    "the Act" means the National Sports Council of Tanzania Act *;

    "prescribed" means, in relation to forms, forms prescribed in the First Schedule to these Regulations, and in relation to fees, fees prescribed in the Second Schedule to these Regulations.

    3. Every application for the registration of a sports association shall be in the form prescribed in Form A, and be accompanied by a statement of particulars in the form prescribed in Form B.

    4. Every application for exemption from registration shall be made to the Registrar in writing and shall be accompanied by the prescribed fee.

    5. (1) Every certificate of exemption issued by the Registrar shall be in the form prescribed in Form C.

    (2) Every certificate of registration issued by the Registrar shall be in the form prescribed in Form D.

    6. (1) No application for registration of a sports association shall be considered by the Registrar unless the appropriate fee has been paid in respect thereof.

    (2) The Minister may in any case remit in full or in part the prescribed fee where he considers it reasonable so to do.

    (3) Where there is any dispute as to what the appropriate prescribed fee is in respect of any application, the matter shall be referred to the Minister whose decision therein shall be final.

(Regulation 2)

    (a) On application for registration of a sports association which has branches in or members from two or more districts, for every sport, whether indoor or outdoor, provided for by the association.

    (b) On application for registration of a sports association which operates or has members from only one district, for every sport, whether indoor or outdoor, provided for by the association.

    (c) On application for exemption from registration under the Act, whether or not the association operates in, or has members from, two or more districts.

    (d) On issue of certificate of registration or for every copy of certificate.

THE NATIONAL SPORTS COUNCIL OF TANZANIA (EFFECTIVE IMPLEMENTATION OF MANDATE) REGULATIONS

1.    Short title

    These Regulations may be cited as the National Sports Council of Tanzania (Effective Implementation of Mandate) Regulations.

2.    Interpretation

    In these Regulations–

    "Council" means the Regional or District Council established by Regulation 3.

3.    Establishment of Regional or District Sports Council

    (1) There is hereby established a in respect of each regional and district a Regional, or as the case may be, a District Sports Council, which shall be affiliated to the National Sports Council of Tanzania.

    (2) The Council shall–

    (a)    be a body corporate with perpetual succession and an official seal;

    (b)    be capable of holding, purchasing and otherwise acquiring and disposing of any property, movable or immovable, for purposes of carrying out the functions conferred on the Council by the National Sports Council of Tanzania.

4.    Functions of Council

    (1) The functions of the Council shall be–

    (a)    to develop, promote and control all forms of amateur sports on Regional or District basis with voluntary amateur sports organisations or associations by providing–

        (i)    training and other staff;

        (ii)    grants in aid to Regional or District Sports associations or organisations;

        (iii)    stadia, playing fields and other facilities;

        (iv)    sports equipment and other sports items as may be necessary for the acceleration of development of sports;

    (b)    to encourage and facilitate co-operation among the various Regional or District Sports associations;

    (c)    to approve of Regional or District sports competitions and festivals which the Regional or District or any other associations organise;

    (d)    to organise in consultation with the Regional or District associations, national and other sports competitions and festivals as a means of exchanging experience and fostering friendly relations with other regions or districts;

    (e)    to stimulate general interest in all sports through organisations at all Regional and District levels; and

    (f)    to implement the general policy of sports promotion formulated by the National Sports Council of Tanzania.

    (2) The Council may–

    (a)    in consultation with the Regional or District Sports associations, award medals, certificates, diplomas, trophies and any other incentives for the encouragement and promotion of sporting activities;

    (b)    advise the National Sports Council of Tanzania regarding external relations in the field of sports;

    (c)    arrange with local authorities for the provision of sporting facilities at a region or district level and endeavour to inculcate a high standard of sportsmanship and discipline in all sportsmen;

    (d)    provide or facilitate the provision of medical and other facilities for the examination, maintenance and amelioration of the health and well being of sportsmen;

    (e)    raise by public appeals or otherwise funds and property of the Council in the furtherance of the Council's functions and hold and invest all monies not used for purposes of sports, as the Council may deem fit for the benefit of the Council and sports in general;

    (f)    consult with other associations, institutions or persons upon matters of common interest relating to amateur sports, coordinate the views and opinion and make representations on behalf of those associations, institutions or persons to the public and generally do any act or thing, whether alone or in co-operation or association with such other institution or body of persons as the Council may deem fit for the interests considered to be beneficial to sports or physical recreation in the region, district or in the United Republic generally.

5.    Composition of Council

    (1) The Council shall consist of–

    (a)    a Chairman, who shall be the Regional Development Director in the case of a region and the District Executive Director in the case of a district;

    (b)    a Secretary, who shall be a Regional or District Officer;

    (c)    seven or more other members, not exceeding ten, whom the Regional Commissioner or District Commissioner shall appoint;

    (d)    such other members as the Regional Commissioner or District Commissioner shall appoint under subregulation (2) of this regulation;

    (e)    all District Sports Officers;

    (f)    a Treasurer, whose appointment shall be subject to the prior approval of the Regional Commissioner or District Commissioner.

    (2) Each Regional or District association which is affiliated to the Council and the Regional Commissioner or District Commissioner shall unless there are special reasons, which reasons shall be indicated in writing, decline to do so, appoint persons nominated under subregulations (1) of this regulation to be members of the Council.

    (3) A member of the Council shall, unless–

    (a)    his appointment is sooner terminated by the Regional Commissioner or District Commissioner in the public interest; or

    (b)    that member otherwise ceases to be a member,

hold office for a period as the Regional Commissioner or District Commissioner specifies in the appointment or where there is no specified period, for a period of not more than three years from the date of his appointment, and shall be eligible for re-appointment.

    (4) A member of the Council may at any time resign by giving notice in writing to the Regional Commissioner or District Commissioner and from the date that member specifies in the notice, or where the member does not specify any date, from the date of the receipt of the notice by the Regional Commissioner or District Commissioner, that member shall cease to be a member of the Council.

    (5) Where a member of the Council is, without the permission of the Council–

    (a)    absent from more than four consecutive meetings of that Council; or

    (b)    absent from the United Republic for a period exceeding one year,

that member shall cease to be a member of the Council.

6.    Casual vacancies

    Where a member of the Council ceases to be a member before the normal expiration of his term of office, the Regional Commissioner or District Commissioner, after consultation with the Council, may appoint another person to hold office until the time that first named person's term of office would have expired, had that first named person not ceased to be a member.

7.    Quorum and procedure

    (1) The Council shall hold a meeting at any time it deems necessary or expedient for the transaction of business.

    (2) At any meeting of the Council one half of the members shall constitute a quorum.

    (3) The Council may elect one of their number be the Vice-Chairman of the Council.

    (4)(a)    At any meeting of the Council the Chairman or, in his absence, the Vice-Chairman, shall preside.

    (b)    Where both the Chairman and the Vice-Chairman are absent, the members present at the meeting shall elect one of their number to be the Chairman for the meeting.

    (5) In any event of an equality of votes the Chairman of the meeting shall have a casting vote in addition to his deliberative vote.

    (6) Minutes in proper form of each meeting of the Council shall be kept and shall be confirmed by the Council at the following next meeting and signed by the Chairman of the meeting.

8.    Funds of Council

    (1) The funds and resources of the Council shall consist of–

    (a)    the sums as may be allocated by Parliament;

    (b)    any loan granted to the Council by the Government or any other person with the approval of the Regional Commissioner or District Commissioner;

    (c)    any sum or property which may become payable to or vested in the Council in respect of any matter incidental to the carrying out of the Council's functions;

    (d)    any sums or property which may be donated to the Council.

    (2) Where a sum or property is to be donated to the Council under paragraph (d) of subregulation (1) of this regulation, the Council shall not be obliged to accept that donation for a particular purpose unless the Council approves of the terms and conditions attached to that donation.

9.    Report by the Council

    The Council shall, within six months after the end of each financial year, make a report to the Regional Commissioner or District Commissioner on the conduct of the Council's business during that year and the Regional Commissioner or District Commissioner shall lay a copy of the report before the Regional Development Committee or the District Council.

10.    Accounts and auditing

    (1) The Council shall keep proper accounts and other records in relation to the Council's business and shall prepare in respect of each financial year a statement of accounts in a form approved of by the Regional Commissioner or District Commissioner being a form which conforms to commercial standards.

    (2) Subject to any resolution of the National Assembly under section 28 of the Public Finance Act * the accounts of the Council shall be audited by the auditors appointed annually by the Regional Commissioner or District Commissioner.

    (3) As soon as the accounts of the Council for any financial year have been audited the Council shall send to a Regional Commissioner or District Commissioner a copy of the statement of accounts prepared in respect of that year together with a copy of any report made by the auditors in that respect.

    (4) The Regional Commissioner or District Commissioner shall, within a period of six months (or such longer period as the National Assembly may, by resolution, appoint) after the end of the financial year to which the accounts relate, lay a copy of the statement and auditor's report before the Regional Development Committee or District Council. {/mprestriction}
