PART I
PRELIMINARY PROVISIONS (regs 1-2)

1.    Citation

    These Regulations may be cited as the National Lotteries Regulations.

2.    Interpretation

    In these Regulations, unless the context otherwise requires–

    "Act" means the National Lotteries Act *;

    "closing date" means the date from which all sales of lottery tickets issued in respect of any lottery shall cease;

    "commencement date" means the date from which sales of lottery tickets issued in respect of any lottery shall commence;

    "Committee" means the Draw Supervisory Committee appointed by the Board under the provisions of regulation 30;

    "lottery" means a national lottery;

    "ordinary lottery" means a lottery promoted and conducted once in every month in accordance with the provisions of these Regulations;

    "paying authority" means the person authorised by these Regulations to pay prizes to holders of winning tickets;

    "programme" means a notice published in the Gazette and containing particulars required to be published, by the Director under the provisions of section 7(a) of the Act;

    "special lottery" means a lottery, other than an ordinary lottery, promoted and conducted by the Director with the approval of the Board of Trustees to mark the occasion of any festival or public holiday;

    "ticket" means a lottery ticket.

PART II
ORDINARY LOTTERIES (regs 3-6)

3.    Promotion of ordinary lotteries

    The Board shall promote an ordinary lottery once every month.

4.    Time for draw

    The draw of an ordinary lottery promoted in any month shall, subject to the provisions of Part VI, be conducted on such day between the first and the twenty-fifth of the following month as the Director may decide.

5.    Number of tickets to be issued

    The Director shall issue in respect of every ordinary lottery a number of tickets as the Board may direct.

6.    Prizes for ordinary lotteries

    There shall be assigned in respect of every ordinary lottery the following prizes which shall be announced in the Gazette and other newspapers as may be directed by the Board–

    (a)    one first prize;

    (b)    one second prize;

    (c)    one third prize;

    (d)    two fourth prizes;

    (e)    twenty fifth prizes;

    (f)    one hundred and fifty sixth prizes

    (g)    one thousand five hundred seventh prizes;

    (h)    fifteen thousand eighth prizes.

PART III
SPECIAL LOTTERIES (regs 7-9)

7.    Special lotteries

    (1) In addition to the ordinary lotteries the Director may with the approval of the Board, promote and conduct a special lottery to mark the occasion of any national festival or public holiday.

    (2) The draw of a special lottery shall, subject to the provisions of Part VI, be held on such date as the Director may specify in the programme.

8.    Tickets to be issued for special lotteries

    The Board shall in respect of every special lottery issue a number of tickets as it may decide.

9.    Prizes for special lotteries

    (1) The Board shall assign in respect of every special lottery prizes which shall be announced in the Gazette and other newspapers as the Board may decide.

    (2) The Board may by notice in the Gazette and other newspapers vary the amount of the prizes in such manner as it may think fit in respect of any special lottery.

PART IV
LOTTERY TICKETS (regs 10-13)

10.    Price of tickets

    The price of each ticket for a special lottery shall be fixed by the Board.

11.    Tickets for every lottery to bear serial numbers

    All tickets issued for any lottery shall bear serial numbers, the first ticket to bear the serial number 1.

12.    Tickets to be issued in booklets

    (1) Tickets shall be issued in booklets each containing such number of tickets as the Board may decide and there shall be attached to every ticket a counterfoil on which there shall be printed a serial number corresponding with the serial number printed on the ticket and which shall have sufficient space for the purpose of recording thereon the name and address of the purchaser of the ticket and the name and address of the seller.

    (2) The top cover of every booklet shall have printed thereon the serial numbers of the first and last tickets in the booklet and shall provide space for the purpose of recording thereon the name of the selling agent or the person authorised to sell tickets to whom the booklet is issued for sale of the tickets therein contained.

13.    Contents of the tickets

    (1) There shall be printed on every ticket–

    (a)    the serial number;

    (b)    the price of the ticket;

    (c)    the date of the draw; and

    (d)    such other matter as the Board may think fit.

    (2) The Board may cause to be printed on the reverse of the ticket such information relating to–

    (a)    the commencement date;

    (b)    the closing date;

    (c)    the manner in which prizes may be claimed; and

    (d)    any other relevant matter,

as it may think fit.

PART V
SALE OF LOTTERY TICKETS (regs 14-28)

14.    Appointment of selling agents

    (1) Tickets may be sold either by persons authorised by the Board to sell tickets on its behalf or by selling agents appointed by the Board, or by the Director on behalf of the Board.

    (2) A selling agent may appoint one or more sub-agents to sell lottery tickets on his behalf on such terms and conditions as it may be agree upon.

15.    Letter of appointment

    On the appointment of a selling agent the Director shall issue the selling agent with a letter of appointment in the form prescribed in the Schedule hereto.

16.    Security bond

    No person shall be appointed as a selling agent unless he has furnished the Director with a security bond for such sums as the Director may think fit.

    (2) Every bond shall be in the form prescribed in the Schedule hereto and shall be executed by the selling agent and by two sureties approved by the Board or the Director on behalf of the Board.

17.    Revocation of appointment of selling agents

    The Board may, where it is satisfied that a selling agent is neglecting his duties as a selling agent or has contravened any of the provisions of the Act or of these Regulations or of any of the terms specified in his letter of appointment or for any other reasons whatsoever, revoke the appointment of the selling agent by giving him one month's notice in writing.

18.    Supply of tickets to selling agents

    Every selling agent shall, not later than ten days before the commencement date in respect of any lottery be supplied with such number of tickets as he may request or such number of tickets as the Director may think fit.

19.    Commencement dates

    (1) The commencement date for any ordinary lottery shall be the first day of the month of which the lottery is promoted.

    (2) The commencement date for a special lottery shall be such date as the Board may appoint.

20.    Closing dates

    (1) The closing date for any lottery shall be such date as the Director may appoint.

    (2) The Director may appoint different closing dates in respect of different areas.

    (3) The closing date shall be specified in the programme.

21.    Sales to cease on closing date

    No person authorised to sell tickets in any area either on behalf of the Board or as a selling agent or as a sub-agent, shall on or after the closing date appointed for that area in respect of any lottery, sell tickets for that lottery.

22.    Duty to return all the unsold tickets and counterfoils on closing date

    (1) Every selling agent and other person authorised by the Board to sell tickets on its behalf shall, within two days immediately after the closing date, return to the Director all the counterfoils of the tickets sold by him and all unsold tickets in his possession in respect of the lottery to which the closing date relates together with a return of sold tickets in such form as the Board may direct.

    (2) Where a selling agent or other person authorised by the Board to sell tickets on its behalf resides outside Dar es Salaam he shall, within two days immediately after the closing date, dispatch all the counterfoils of the tickets sold by him and all unsold tickets in his possession in respect of the lottery to which the closing date relates to the Director by registered post together with a return of the sold and unsold tickets in such form as the Director may direct.

    (3) All unsold tickets shall be carefully cut on the top right hand corner by the agent before he dispatches them.

    (4) The copy of the list of tickets sold and those which have not been sold shall be dispatched to the District Development Director for his custody and one copy shall be forwarded, by registered mail, to the Director.

    (5) A copy of the list of sold and unsold tickets shall be a prima facie evidence of the tickets sold and those which were not sold.

23.    Duty to remit value of tickets sold

    Every selling agent and other person authorised by the Board to sell tickets on its behalf shall, within seven days of the closing date, remit to the Director a sum equal to the value of the tickets sold by the agent or person:

    Provided that in the case of a selling agent he shall be entitled to deduct from such sum by way of his remuneration a sum equal to fifteen per centum thereof or as it may be decided by the Board.

24.    Sub-agents

    Where a selling agent has appointed a sub-agent to sell tickets on behalf of the selling agent, it shall be the responsibility of the selling agent to recover from the sub-agent the counterfoils of the tickets sold by the sub-agent and any unsold tickets in the possession of the sub-agent in time to enable the selling agent to comply with the provisions of regulation 22.

25.    Name of purchaser to be recorded on counterfoil

    It shall be the duty of the person selling lottery tickets either on behalf of the Board or as a selling agent or as a sub-agent to ensure that the full names and the address of the purchaser are legibly recorded on the counterfoil.

26.    Tickets not to be purchased by more than one person

    (1) A ticket may not be purchased or held by more than one person.

    (2) Where the counterfoil or any tickets has recorded thereon the names of two or more persons as being the purchasers of the ticket, the person whose name first appears on the counterfoil shall, for the purpose of Part VII and subject to the provisions of that Part, be deemed to be the holder of the ticket.

27.    Accounting system

    (1) The Board shall cause to be maintained a separate register in respect of every selling agent and every person authorised by it to sell lottery tickets.

    (2) There shall be recorded in such register in respect of every lottery–

    (a)    the draw number;

    (b)    the number of tickets issued;

    (c)    the serial numbers of the tickets issued;

    (d)    the value of the tickets issued;

    (e)    the value received;

    (f)    the number of the issue vouchers and the date of issue;

    (g)    the number of tickets sold;

    (h)    the number of unsold tickets returned and the date on which they were received;

    (i)    the serial numbers of unsold tickets returned.

28.    Theft of tickets

    (1) Where any ticket issued to a selling agent or other person authorised by the Board to sell tickets on its behalf is stolen, the selling agent or such other person shall forthwith report the theft to the police and notify the Director of the theft and if such ticket is recovered before the closing date of the lottery to which the ticket relates, such recovery shall also be forthwith notified to the Director.

    (2) A list of all persons who have lost their tickets shall be compiled and circulated to all finance officers in every district and to all agents.

PART VI
DRAWS (regs 29-36)

29.    Venue

    The draw of a lottery shall be held at such place and at such time as the Director may appoint.

30.    Draw Supervisory Committee

    (1) The Director shall, with the approval of the Board, appoint six persons to form a Committee to be known as the Draw Supervisory Committee.

    (2) Every draw shall be held in the presence of at least three members of the Committee.

    (3) On the completion of a draw the members of the Committee present thereat shall, if satisfied that the draw has been conducted properly and in accordance with the Regulations, issue a certificate stating the result of the draw.

    (4) Every certificate issued under subregulation (3) shall be signed by the members of the Committee present at the draw.

31.    Postponement of draw

    (1) The Director may, when he is of the opinion that it is necessary or desirable to do so, postpone a draw or draws for any lottery or for any particular prize or prizes.

    (2) Where any draw is postponed a notice to that effect shall be published in such newspaper or newspapers as the Director may decide.

32.    Procedure

    (1) Until such time when a new procedure under subregulation (3) is introduced, every draw shall be conducted by employing a drum.

    (2) Where a drum is employed the following procedure shall be followed if the number of tickets issued in respect of the draw does not exceed 150,000 and this procedure may be changed according to the number of tickets issued–

    (i)    according to this procedure before a draw is made, the Director shall cause to be prepared, 150,000 pieces of papers and each piece bearing a serial number, the first of which shall be 1 and the last one 150,000; and

    (ii)    any draw which is made by employing a drum shall follow the following procedure–

        (a)    before the time for the draw every piece of paper prepared shall be folded as the Director may direct;

        (b)    at the time of the draw every piece of paper shall be placed in the drum;

        (c)    for the draw of the first prize the drum shall be turned several times so as to ensure that the pieces of papers are well mixed up and when it stops–

            (i)    one of the windows shall be opened, and one piece of paper shall be picked and the number appearing on that piece of paper shall be declared a winning ticket; and

            (ii)    the piece of paper picked under (i) shall be folded again and put back in the drum before the next prize;

        (d)    the procedure explained under (c) shall be followed for the first prize to the fifth prize;

        (e)    for the draw of the sixth prize the procedure explained under (c) shall be followed and if–

            (i)    the piece of paper picked has a number with four or more digits every ticket the last four digits of the serial number of which corresponds with the number appearing on the piece of paper picked shall be declared to be the winning ticket;

            (ii)    if the number appearing on the piece of paper picked has three digits, every ticket the last four digits of the serial number of which corresponds with the number appearing on the piece of paper picked shall be declared to be the winning ticket; or

            (iii)    if the number appearing on the piece of paper picked has less than four digits the draw for that prize shall be repeated;

        (f)    for the draw of the seventh prize the procedure explained under (c) may be followed–

            (i)    if the number appearing on the piece of paper picked has three digits or more every ticket the last three digits of the serial number of which corresponds with the number appearing on the piece of paper picked shall be declared to be the winning ticket;

            (ii)    if the number appearing on the piece of paper picked has two digits, every ticket the last three digits of the serial number of which corresponds with the number appearing on the piece of paper picked shall be declared to be the winning ticket; or

            (iii)    if the number appearing on the piece of paper picked has two digits, the draw for that prize shall be repeated;

        (g)    for the draw of the eighth prize the procedure explained under (c) shall be followed–

            (i)    if the number appearing on the piece of paper picked has two or more digits, every ticket the last digit of the serial number of which corresponds with the last digit appearing on the piece of paper picked shall be declared to be a winning ticket; or

            (ii)    if the number appearing on the piece of paper picked has one digit, the draw for that prize shall be repeated.

    (3) Where ordinary machines are employed and the number of tickets printed are 150,000 the following procedure shall be followed–

    (a)    six machines shall be placed in a row and marked from left to right A, B, C, D, E and F respectively;

    (b)    machine A shall be so adjusted as to be capable of registering either 0 or 1;

    (c)    machine B shall be so adjusted as to be capable of registering any figure from 0 to 4;

    (d)    the remaining machines shall be so adjusted as to be capable of registering any figure from 0 to 9;

    (e)    for the draw for the first prize all the six machines shall be operated and the number formed by placing together the figures appearing on machines A, B, C, D, E and F in that order shall be declared to be the winning number and if the number so formed is 000000 the winning number shall be 150000;

    (f)    for the draws for the second, third and up to fifth prizes the same procedure as described in paragraph (e) shall be adopted for each of the prizes, and in each case the number formed by placing together the figures appearing on machines A, B, C, D, E and F in that order shall be declared to be the winning number of the prize for which the draw is made and if the number so formed is 00000 the winning number shall be 150000;

    (g)    for the draw for the sixth prize only machines D, E and F shall be operated and every ticket the last three digits of the serial number of which corresponds with the number formed by placing together the figures appearing on machines D, E and F in that order shall be declared to be the winning ticket;

    (h)    for the draw for the seventh prize in an ordinary lottery only machines E and F shall be operated and every ticket the last two digits of the serial number of which correspond with number formed by placing together the figures appearing on machines E and F in that order shall be declared to be the winning ticket;

    (i)    for the draw for the eighth prize in an ordinary lottery or the sixth prize in a special lottery only machine F shall be operated and every ticket the last digit of the serial number of which corresponds with the figure appearing on the machine shall be declared to be the winning ticket; and

    (j)    this procedure may change according to the number of tickets which are issued for every lottery draw.

33.    Examination of machine

    Before every draw a person appointed by the Director shall examine the machine used and the draw shall not take place unless the person is satisfied that the machine is in perfect order.

34.    Fault appearing during the draw

    Where during a draw the members of the Committee are satisfied that there is some fault in any of the machines or that the machine or any of the machines is not functioning as it normally should, they may postpone the draw until such time as the machine can be repaired or replaced.

35.    Only sold tickets to participate in draws for the first three prizes

    (1) Where the number drawn for any of the first three prizes is the number of a ticket that has not been sold the prize shall immediately be drawn for again.

    (2) Where there is some doubts as to whether or not the ticket bearing the winning number in respect of any of the first three prizes has been sold, the Director shall cause an investigation to be made and if after such investigation he is satisfied that the ticket was not sold, a draw shall be arranged for that prize without undue delay.

    (3) The Director, may postpone a draw for a particular prize, or for any period that he may find fit, or for the purpose of investigation.

36.    Where one ticket wins more than one prize out of the first three prizes

    (1) Where in any lottery a ticket qualifies for two or more prizes amongst the first three prizes, such ticket shall be declared to be the winner of the highest prize only and other prize or prizes shall immediately be drawn for again.

    (2) A winner of a lottery under paragraph (1) may be paid more than one prize if the second prize is one which is won by counting the last digits.

PART VII
CLAIMS FOR AND PAYMENT OF PRIZES (regs 37-42)

37.    Interpretation

    In this Part, unless the context otherwise requires–

    "holder" means–

    (a)    in relation to a ticket which has won any of the first three prizes, the person whose name appears on the counterfoil as the purchaser of the ticket, and includes–

        (i)    in the case where the person whose name appears on the counterfoil having died, his executor or the administrator of his estate;

        (ii)    in the case where the person whose name appears on the counterfoil is of unsound mind, the person appointed as the manager of his estate under the provisions of the Mental Diseases Act *;

        (iii)    in the case where the person whose name appears on the counterfoil is a person of under the apparent age of fifteen years, the father of such person or if the father is dead or cannot be found after reasonable inquiry, the mother or such person or; if the mother is dead or cannot be found after a reasonable enquiry, such person as in the opinion of the Director is the guardian of such person;

        (iv)    in the case where the person whose name appears on the counterfoil is a person of under the apparent age of fifteen years and the ticket has been bought for him by mother of such person or, if the mother is dead or cannot be found after a reasonable enquiry, the father or if the father is dead such person as in the opinion of the Director is the guardian of such person; or

        (v)    in the case where the person whose name appears on the counterfoil has transferred the ticket to some other person the transferee of the ticket:

                Provided that such transferee shall not be accepted as the holder unless he satisfies the Director as to the transfer of the ticket to him;

    (b)    in relation to a ticket which has won any other prize, the person who is in possession of the ticket at the time of its presentation for the purpose of claiming the prize;

    "paying authority" means the person authorised by these Regulations to pay prizes to holders of winning ticket.

38.    Paying authorities

    (1) In relation to the prizes of the one thousand shillings and over in an ordinary lottery and in a special lottery the paying authority shall be the Director or any senior officer authorised by him in that behalf.

    (2) In relation to the remaining prizes the paying authority shall be the Internal Revenue Officers and such selling agents as the Director may appoint to be paying authorities.

39.    Claims for prizes

    (1) The holder of a winning ticket shall be entitled to payment of the prize won by the ticket only upon presentation and surrender of the ticket to the paying authority that he is the holder of the ticket.

    (2) Where a ticket is presented and surrendered to the paying authority and the prize is paid to the holder, the paying authority shall forthwith mark or stamp the ticket with the word "paid".

    (3) Where a paying authority, other than the Director, is presented with a ticket which–

    (a)    is not whole or bears any alteration, abrasure or erasure; or

    (b)    in the opinion of the paying authority the ticket is not genuine,

the paying authority shall forthwith issue the holder of the ticket with a receipt for the ticket and forward the ticket to the Director for his decision under section 7(e) of the Act as to whether the prizes should be paid or not.

40.    Lost tickets

    (1) Where any person claims to have been the holder of a winning ticket and to have lost the ticket–

    (a)    if the ticket is one which has won any one of the first three prizes, the Director shall, on behalf of the Board, appoint a Committee of three persons to investigate the claimant's claim in such manner as it may deem fit and shall report its findings to the Director; or

    (b)    if the ticket is one which has won any other prize, the claimant shall submit his claim to the Director and the Director may decline to pay the prize unless the claimant satisfies the Director that the ticket was sold to him or that he was lawfully in possession of the ticket.

    (2) Where the Committee appointed under subparagraph (a) of paragraph (1) finds that the claimant's claim is genuine the Director shall pay to the claimant the relevant prize subject to such conditions as to indemnity as he may deem fit and to such deduction not exceeding one-tenth of the value of the prize as may be specified by the Board as the fee for the investigation.

41.    Where no prize claimed within six months

    Where the prize in respect of any winning ticket is not claimed within six months from the date of the draw, no prize shall be paid in respect of the ticket and the prize shall be paid into the National Lottery Fund.

42.    Seller's prizes

    (1) Where a ticket which has won any one of the first three prizes was issued for sale to a selling agent–

    (a)    the Director shall pay to the selling agent a seller's prize of a sum equal to five per centum of the prize won by the ticket if the ticket was sold by the selling agent himself;

    (b)    the Director shall pay–

        (i)    to the sub-agent, a seller's prize of a sum equal to three per centum of the prize won by the ticket; and

        (ii)    to the selling agent, a seller's prize of the prize won by the ticket;

        if the ticket was sold by a sub-agent of a selling agent.

    (2) Where a ticket which has won any one of the first prizes was sold by any person authorised by the Board to sell tickets on its behalf, the Director shall pay to the person who sold the ticket a seller's prize of a sum equal to five per centum of the prize won by the ticket.

PART VIII
SECURITY ARRANGEMENTS (regs 43-46)

43.    All unsold tickets to be kept in a safe

    The Director shall on the day preceding the date of the draw of any lottery, place all tickets in respect of that lottery in a strong room or a safe to which only the Director or a person authorised in writing by him shall have access.

44.    Parcels of unsold tickets to be opened by the Director or by authorised person

    Every parcel containing unsold tickets dispatched by a selling agent or by a person authorised by the Board to sell tickets shall be opened only either by the Director or by some person authorised by him in that behalf.

45.    Unsold tickets arriving later than the day preceding draw

    Where any parcel containing unsold tickets reaches the Director later than the day preceding the date of the draw of the lottery to which such unsold tickets may relate, the Director shall immediately place all the unsold tickets in the parcel in a strong room or in accordance with the provisions of regulation 43.

46.    Destruction of unsold tickets

    Where the draw in respect of a lottery has taken place the Director shall, as soon as may be practicable, cause all the unsold tickets relating to that lottery to be destroyed either in his presence or in the presence of a person authorised by him in that behalf in writing and in such manner as the Director may think fit.

47.    Failure to return unsold tickets

    Any selling agent or other person authorised by the Board to sell tickets on its behalf who fails to return to the Director or to despatch to the Director by registered post all the counterfoils of the tickets sold by him and all the unsold tickets within two days of the closing date of the lottery to which such counterfoils and unsold tickets relate commits an offence.

48.    False information

    Any person who knowingly or recklessly gives to an Investigation Committee or to the Director any false information affecting any claim by himself or any person for a prize in respect of winning ticket commits an offence.

49.    Interfering with parcel containing unsold tickets

    Any person, other than the Director or any person authorised by the Director under the provisions of regulation 43 or 44, who–

    (a)    enters into any strong room in which unsold tickets have been placed;

    (b)    opens or attempts to open any safe in which unsold tickets have been placed; or

    (c)    opens or attempts to open any parcel of unsold tickets addressed to the Director,

commits an offence.

50.    Penalty

    Any person who commits an offence under these Regulations shall be liable upon conviction to a fine not exceeding two thousand shillings or to imprisonment for a term not exceeding two months or to both such fine and imprisonment.

4.    Neither you nor your sub-agent will be entitled to sell lottery tickets outside your area of operation.

5.    Your appointment as a selling agent will be governed by the provisions of the National Lotteries Regulations, and is subject to the following conditions–

    (a)    that you comply with the terms of this letter and with the requirements of the National Lotteries Act * and of the National Lotteries Regulations;

    (b)    that within seven days of the receipt of this letter by you, you return to the Director, National Lotteries, P.O. Box 1717, Dar es Salaam the following–

        (i)    the duplicate of this letter duly signed by you in the space provided for your signature;

        (ii)    the enclosed security bond executed by you and two sureties approved by me, duly stamped as required by law.

6.    This letter of appointment will replace any agreement entered into between you and the Director or you and any other officer of the National Lottery appointing you a selling agent.
