1. This Notice may be cited as the Local Government Authorities (Division into Wards) Notice.
2. The local government authorities specified in the Schedule to this Notice are divided into the wards specified below their names, for the purposes of local government authorities elections.

1. Kunduchi | Commencing at a point 1 kilometre away from the north-western corner of Wazo Hill Cement Factory, the boundary follows a southerly direction along the present City Boundary to include the whole of Goba Ward to a point 2 kilometres west of the water tanks at Mbezi Industrial Area. It then turns north-easterly to a point 200 metres south of the said tanks; thence easterly to the junction of New Bagamoyo Road and the road to Hotel Africana. The boundary continues eastward into the Indian Ocean touching Bungoyo Island at its northern tip to the present City Boundary; then the boundary turns north-west along the present City Boundary to the point of commencement. |
2. Kawe | Commencing at a point where New Bagamoyo Road crosses Kijitonyama River, the boundary follows the river eastward to the coast line. It then follows the coastline to the tip of Msasani peninsula, then eastward to the present City Boundary. The boundary then takes a north-westerly direction along the City Boundary to a point where the City Boundary meets the southern boundary of Kunduchi Ward. It then follows the said southern boundary of Kunduchi Ward westward to the Western City Boundary; then in a south westerly direction to the point of commencement. |
3. Msasani | Commencing from a point where Bagamoyo Road crosses Selander Bridge, along the centre of Bagamoyo Road north-westwards to a place where this road crosses Kijitonyama River; thence north-eastward along Kijitonyama River to the Coastline; thence along the coastline eastward and northward along the southern boundary southward to a point directly opposite Selander Bridge. The boundary then turns south-west to the point of commencement. |
4. Kinondoni | Commencing at a point where Bagamoyo Road crosses Selander Bridge; thence along the centre of the Bagamoyo Road/westwards to its junction with Morocco Road along the centre of Morocco Road to its junction with Katani Road; thence westward along the centre of Katani Road for a distance of about 666 metres, to a point where it meets an unnamed stream; thence southwards following this stream until it joins Sinza River; thence south-eastwards along the Sinza River, to where it meets the Msimbazi River; thence along the centre of Msimbazi Creek to the point of commencement. |
5. Mwananyamala | Commencing at a point along the Bagamoyo Road opposite Village Museum; thence southwards in a straight line for a distance of about 16,000 metres to Sinza River; thence downstream along the Sinza River to its junction with an unnamed stream; thence it follows the western boundary of the Kinondoni Ward to junction of Bagamoyo/Morocco Roads; thence westwards along the centre of Bagamoyo Road to the point of commencement. |

25. Yombo | The area bounded to the south-east by Mzinga River, to the north-east by Kilwa Road and the southern boundary of Mgulani southward to the north the southern boundary of Mgulani South/Ward, to the north the southern boundaries of Temeke East, Temeke West and Vingunguti Wards to the west and south the Ukonga Ward boundary. |
26. Temeke East | Commencing at a point where Yombo Street meets Temeke Street; thence along the centre of Temeke Street, to a point where it meets Mbagala Road; thence along the centre of Mbagala Road for a distance of about 33 metres to its junction with Kazole Street; thence southwards along the centre of Kazole Street to its junction with Mahunda Street; thence southwards along the centre of Mahunda Street to its junction with Kivungo Street; thence south-westerly along an unnamed street which is a continuation of Mahunda Street till it meets Yombo River; thence northerly along Yombo River to a point where it joins Mwale River; thence northerly again along Mwale River to a point where it joins Temeke River; thence north-easterly in a straight line to join Yombo Street to the point of commencement. |

Chumbageni | Commencing at the junction of Mombasa Road and the old township boundary, the boundary follows the old township boundary eastwards across the Indian Ocean for a distance of approximately 4.1 kilometres, where it meets the Raska Zone/Bombo Ward western boundary. It then turns southward across the Indian Ocean for a distance of approximately 1.5 kilometres to the Port Road; thence along Port Road westwards for approximately 200 metres to its junction with Mombasa Road; thence southward along Boma Road for a distance of about 700 metres to the Korogwe Railway line westward for approximately 800 metres to its junction with the Jamhuri Road; thence in a northerly direction along Jamhuri Road for 900 metres to its junction with Chumbageni Road; thence in a northerly direction along Jamhuri Road for 900 metres to its junction with Chumbageni Road; thence westward along Chumbageni Road for about 2 kilometres to its junction with the old township boundary (Escarpment Road); thence northwards along the old township boundary for two kilometres to the point of commencement. |
2. Duga | Commencing at the junction of Duga and Pangani Roads in the east, the boundary follows Duga Road north-westerly for about 870 metres to Duga Lodging, then leaves Duga Road and shoots north-westwards for about 150 metres to its junction with the airport storm water drain, then follows the drain southward to its junction with Masiwani Road; thence eastward following the old township boundary along Masiwani Road through survey beacon No. CB: 899 for 1.15 kilometres to its junction with Pangani Road. It then follows Pangani Road northwards for about 800 metres to the point of commencement. |
3. Mabawa | Commencing at the junction of Pangani and Mabawa Roads, in the west, the boundary runs eastwards along Mabawa Road for approximately 1 kilometre to its junction with Msambweni storm water drain, then in a south-easterly direction along Msambweni drain for 230 metres to the old township boundary; thence southwardly following the old township boundary along Msambweni Road, for 1.5 kilometres to its junction with Kivumbitifu Road at beacon No. GB: 899, then follows the old township boundary westwards for 1 kilometre to survey beacon No. GB: 899; thence in a northerly direction along Pangani Road for 1.2 kilometres to the point of commencement. |

Majengo | Commencing at the crossing of Jamhuri Road and Korogwe Railway Line, the boundary follows the railway line north-eastwards for approximately 1.2 kilometres to a point where it crosses Taifa Road (Pangani Road); then follows Taifa Road southwards for 1.4 kilometres, to its junction with Jamhuri Road; thence westwardly along Jamhuri Road for 800 metres to its junction with Uhuru Road; thence north-westwards along Jamhuri Road for 500 metres to the point of commencement. |

Makorora | Commencing at the junction of Swahili Street and Jamhuri Road, the boundary follows Jamhuri Road eastwards for 450 metres, to its junction with Mnyanjani Road; thence along Mnyanjani Road south-eastwards for 1.5 kilometres to Beacon No. T. 625 of the old township boundary; thence southwards along the old township boundary for 700 metres and north-west for 1.6 kilometres to its junction with the Msambweni storm water drain for 150 metres; thence northwards following the same drain for 850 metres to its crossing with Jamhuri Road; thence eastwards along Jamhuri Road to the point of commencement. |

Msambweni | Commencing at the roundabout of Taifa Road and Jamhuri Road; thence eastwards along Jamhuri Road for 1 kilometre, at its crossing with the Msambweni storm water drain; thence southwards along Msambweni storm water drain for 800 metres at its crossing with Mabawa Road; thence north-westwards along the same drain for 230 metres; thence westwards along Mabawa Road for 1 kilometre to its junction with Pangani Road; thence northwards for 1 kilometre to the point of commencement. |

Mwanzange | Commencing at the roundabout of Taifa Road and Jamhuri Road, the boundary follows Jamhuri Road north-westward for 1.3 kilometres at its crossing with Korogwe Railway Line; thence westward along the railway line for 5 kilometres to its crossing with the Kange storm water drain; thence south-east along the storm water drain for 4 kilometres to the old township boundary; thence north-eastward for 1.36 kilometres to the airport storm water drain and follows the drain to Duga Road; thence westward along Duga Road or approximately 1.15 kilometres to its junction with Pangani Road; thence northward along Pangani Road, for 1.5 kilometres to the point of commencement. |

Mzingani | Commencing at the crossing of Jamhuri Road and the old township boundary, the boundary follows the old township boundary north-east for 300 metres at Eckenforde Avenue; thence eastward along Eckenforde Avenue for 800 metres to the Indian Ocean; thence southward along the coast line for 4.2 kilometres to the north-east Tangasisi Ward boundary; thence westward along Mnyanjani Road for 2.1 kilometres to beacon No. T. 626; thence north-westward along Mnyanjani Road for 1.4 kilometres to its crossing with Jamhuri Road; thence along Jamhuri Road for 1.15 kilometres to the point of commencement. |

The boundary then turns towards the direction of survey point ST 17 until it reaches Kilakala River. Then it follows Kilakala River towards the north-west up to Dar es Salaam Road. 9. Mafiga | Commencing at Madaraka/Kenyatta Road roundabout, the boundary follows Kenyatta Road in a north-westerly direction until it reaches Kiswanya Street. Here the boundary follows TANZAM Highway towards the south-west up to Beacon TP 20 BF T646; thence in a south-easterly direction until it reaches Madaraka Road at Beacon BF. 648. 10. Boma | Commencing at the bridge where Dar es Salaam Road crosses River Morogoro, the boundary runs south along Morogoro River until it comes in level with Sabasaba Street. At this point the boundary turns to the east and joins with Boma Road; after which it follows this road heading in a southerly direction until it meets Kingalu Road. From this point of contact it then connects to land mark Ngandela Y which is situated to the south-west and thence north-east to Beacon ST 17 proceeding in the direction of Beacon TP 8 up to the point where it joins River Kilakala. Then it follows the course of this river up to the bridge on which Dar es Salaam Road crosses; the boundary then runs along Dar es Salaam Road to the point of commencement. |

Mwembesongo | Commencing at a point on River Morogoro which falls in level with Choma Street, the boundary follows Choma Street westward straight to the central railway line after which it follows the railway in a north-westerly direction until it meets TANZAM Highway. The Boundary then runs eastwards with the highway to TANZAM/Turiani Road towards the north up to where the road crosses River Ngerengere; thence along Ngerengere River until it joins Morogoro River. Kihesa | Commencing at the former township northern gate sign board the boundary proceeds in an easterly direction; thence joining the new eastern boundary; it then follows the new township boundary southwards through Kidunda Peak from where it follows a south-westerly direction till it joins the old township boundary; it then turns north-westwards in a straight line till it meets the great north road at the junction of the Mtwivila Primary School Road and the great north road; it then proceeds in the northerly direction along the great north road till its commencing point. |

Gangilonga | Commencing at the main water reservoir in the east the ward boundary proceeds south-eastwards until it intersects with the former eastern township boundary at a land survey mark OR.2; thence it (ward boundary) follows the former township boundary; thence to a point where the former township boundary turns southwards; from this point the ward boundary proceeds first westwards for 200m and then northwards along the surveyed southern and western boundaries of the Police lines plot; thence through the surveyed eastern boundary of plot 45 of Block H and the northern surveyed boundary of plots 45, 44, 43 and 41 in the same Block H till the junction of Jamat Street and two lanes, one heading north-westwards to form a T-junction with Store Street, the other heading north-eastwards to the western side of the Central Market. From this junction the boundary proceeds north-eastwards along Jamat Street; thence to the junction of this street and Kenyatta Drive from where it proceeds northwards first along Kenyatta Drive and then along Pawage Road after crossing Uhuru Avenue till at the junction of Pawage Road and Banyakyusa Street. Mwangata | Commencing at Ujinde Peak the boundary proceeds eastwards for a distance of 4,600m; thence meeting Hoho Stream, and following stream south-eastwards till it intersects with the former township boundary 500m. west of Frelimo Road; then follows the former township boundary southwards through survey marks HA 25 and HA.544 where it crosses the Kalenga Road to survey mark S.33; then it descends westwards down the escarpment till the intersection of the former township boundary and Kalenga Road from where it follows Kalenga Road till the intersection of this road with the new township boundary; then it runs northwards along the new township boundary till Ujinde Peak which is the commencing point. |

RULES
(Section 121)
G.N. No. 128 of 1984
1. Citation
These Rules may be cited as the Local Government Authorities (Election Petitions) Rules.
2. Interpretation
In these Rules, unless the context requires otherwise–
"Act" means Local Government (Elections) Act *;
"Court" means the court of a Resident Magistrate;
"election officer" means a Returning Officer, a presiding officer or any other officer upon whom any function of an official nature is conferred by the Act;
"prescribed" means, in relation to forms, forms prescribed in the First Schedule to these Rules, and in relation to fees, the fees prescribed in the Second Schedule to these Rules.
3. Particulars required to be stated in petition Form A
(1) Every petition shall carry a title in the prescribed form and shall state–
(a) the name and address of the petitioner;
(b) the name and address of the respondent Form A or, where there are two or more respondents, of each of the respondents;
(c) the grounds upon which the petitioner relies for the relief sought by him;
(d) the nature of the reliefs sought by the petitioner.
(2) Every petition shall be divided into paragraphs numbered consecutively, each of which shall, as nearly as possible, be confined to a strict petition of the subject matter.
4. Parties
(1) The Attorney-General shall not be made a party to any petition except one which is presented by him or which is based on any of the grounds specified in section 112(3).
(2) Where a petition based on grounds referred to in paragraph (1) such as misconduct or contravention of any provision of any written law by the successful candidate or by any persons acting for or on behalf of the successful candidate, the successful candidate shall be made a party to the petition in addition to the Attorney-General; save that an election officer shall not be made a party to a petition without the consent of the court.
(3) In a petition presented by the Attorney-General, the Attorney-General may make all such persons parties to the petition as respondents who are likely to be adversely affected in the event of the relief sought by the Attorney-General being granted.
5. Addition and substitution of parties
(1) Where the only person made a party to a petition is the Attorney-General and in the opinion of the court it is desirable or necessary for the purposes of the determination of the issue involved that the unsuccessful candidate or any other person be made a party to the petition, the court may by order direct that the unsuccessful candidate or such other person be made a party; and upon such order being made the proceedings shall be adjourned until such time as the person who is to be made a party has been served with a copy of the petition.
(2) Where in any petition the Attorney-General has been joined as a party with the unsuccessful candidate and the Attorney-General advises the court in writing that he has no interest in the petition, the court may, if it is satisfied that no misconduct on the part of any election officer is alleged, direct that the Attorney-General shall cease to be a party and the petition shall be proceeded with between the petitioner and the remaining respondent or respondents as the case may be.
6. Grounds which may be taken at hearing
The petitioner shall not, save with the leave of the court, urge or be heard in support of any ground not set forth in the petition, save that the court shall not, in determining a petition, be confined to the grounds set forth in the petition.
7. Rejection or amendment of petitions
(1) Where a petition is not drawn up in the manner prescribed, it may be rejected or be returned to the petitioner for the purpose of being amended within the time to be fixed by the Registrar.
(2) Where the court rejects any petition, it shall record the reason for such rejection.
8. Presentation of petitions
(1) A petition shall be presented by lodging it with the Resident Magistrate-in-charge upon paying the prescribed fee.
(2) A petition may be presented under this rule either by the petitioner himself or by his advocate.
(3) The petitioner shall supply the Resident Magistrate-in-charge with three copies of the petition and with such additional number of copies as there may be respondents.
9. Service of petition Form B
(1) Where a petition has been presented and has not been rejected or returned to the petitioner, the Resident Magistrate-in-charge shall–
(a) send a copy of the petition together with a notice in the prescribed form to the Electoral Authority;
(b) cause to be served upon each of the respondents a copy of the petition together with a copy of the notice in the prescribed form;
(c) post upon the court notice board a certified copy of the petition.
(2) Service of the documents referred to in paragraph (1)(b) of this rule, shall be effected by personal service; except that where the Resident Magistrate-in-charge is satisfied–
(a) that the respondent cannot be found; or
(b) that the respondent has refused to accept service of the documents; or
(c) that personal service cannot be effected without considerable delay or expenses; or
(d) that it is otherwise desirable so to do, he may direct that the documents be served by substituted service in such manner as the court may direct.
10. Fixing of hearing
(1) Upon presentation of a petition the Resident Magistrate-in-charge shall, as soon as may be practicable, arrange for the parties or their advocates to appear before a Resident Magistrate for the purpose of fixing a date for the hearing of the petition.
(2) Where any party fails to appear before the Resident Magistrate upon being required by the Resident Magistrate-in-charge so to do, the Resident Magistrate shall proceed to fix a hearing date in the absence of such party and shall advise the party in writing of the date of hearing so fixed.
11. Security of costs
(1) The Resident Magistrate shall not fix a date of the hearing of any petition unless the petitioner has paid into the court, as security for costs, a sum of five hundred shillings in respect of each respondent.
(2) Where any person is made a respondent pursuant to an order of the court, the petitioner shall within such time as the court may direct or if the court has not given any direction in that behalf, within seven days of the date on which the order directing a person to be joined as a respondent is made, pay into the court a further sum of five hundred shillings in respect of such person.
(3) Where on an application made by the petitioner, the court is satisfied that compliance with the provisions of paragraph (1) or paragraph (2) of this rule will cause considerable hardship to the petitioner, the court may direct that the petitioner give such other form of security as the court may consider fit:
Provided that no order shall be made under this paragraph unless an opportunity had been given to the respondent, or, where there are two or more respondents, to each of the respondents to make representation in that behalf.
(4) The provisions of this rule requiring a petitioner to give security for costs shall not apply to the Attorney-General in any case in which the Attorney-General is the petitioner or one of the petitioners.
12. Lists of votes objected to
(1) Where scrutiny under the provisions of paragraph (d) of section 120 of the Act is sought either by the petitioner or a respondent, the party seeking such scrutiny shall, not less than six days before the day fixed for the hearing of the petition, lodge with the Resident Magistrate-in-charge a list of votes intended to be objected to by him and of the objections to each vote; and no evidence shall be adduced at the trial against the validity of any vote or in support of any head of objection not specified in the list, save with the leave of the court and upon such terms as the court may order.
(2) The party lodging a list in accordance with the provisions of paragraph (1) of this rule shall at the same time deliver to the Resident Magistrate-in-charge two copies of the list and such additional number of copies as there may be parties to the petition.
(3) The Resident Magistrate-in-charge shall cause a copy of the list to be sent to the Electoral Authority and to every other party to the petition.
(4) No respondent shall be heard in support of any ground of objection not set forth in the list required to be lodged by this rule, save by leave of the court and upon such terms as the court may order.
13. Recriminatory case
(1) Where the respondent to a petition intends to allege that the election of any party to the petition was undue, he shall, not less then six days before the day fixed for the hearing of the petition, lodge with the Resident Magistrate a list of the objections upon which he intends to rely.
(2) Where a respondent lodges with the Resident a list in accordance with the provisions of paragraph (1) of this rule, he shall supply the Resident Magistrate with two copies of such additional number of copies as there may be parties to the petition.
(3) The Resident Magistrate shall cause a copy of the list to be sent to the Electoral Authority and to every other party to the petition.
(4) No respondent shall be heard in support of any ground of objection not set forth in the list required to be lodged by this rule, save by leave of the court and upon such terms as the court may order.
14. Abatement of petition
(1) A petition shall abate–
(a) upon the death of a sole petitioner or of the sole surviving petitioner;
(b) where the petitioner seeks a declaration that–
(i) the election is void;
(ii) the nomination of the person elected was invalid; or
(iii) any candidate was duly elected,
upon the death of the successful candidate.
(2) Where a petition abates by reason of the sole petitioner or the sole surviving petitioner, the court may, if it considers it equitable and just so to do, award to the respondent or, where there are two or more respondents, to each of the respondents, such costs as the court may deem proper; save that the amount of costs awarded to a respondent under this paragraph shall not exceed the amount of costs for which the petitioner had given security in respect of that respondent.
15. Place and time of trial
(1) The trial of a petition shall be held at such time and place as the Resident Magistrate-in-charge may determine.
(2) The Resident Magistrate-in-charge may give notice of the day, time and place of the trial to each of the parties, and publish such notice in the Gazette and in such newspaper or newspapers as he may think fit.
16. Consolidation of petitions
Where two or more petitions are presented in relation to the same election, the court may direct that some or all of such petitions be consolidated and tried as one petition.
17. Trial in court
Every petition shall be tried in open court.
18. Chief Justice may order petition to be tried by two or more magistrates
(1) Where, in the opinion of the Chief Justice a petition is likely to raise complicated questions of law or of facts, he may direct that the petition be tried by two or more magistrates.
(2) Where a petition is tried by two or more magistrates, the petition shall be determined in accordance with the decision of the majority of those magistrates.
19. Postponement of trial
(1) The court may, by order made on the application of a party to a petition and supported by an affidavit, and after notice to the other parties or of its own motion by notice in such form as the court may direct, postpone the beginning of the trial of the petition to such day as the court may specify.
(2) A copy of the notice issued under the provisions of paragraph (1) of this rule shall be sent by the Resident Magistrate to each of the parties to the petition and a copy of such notice, or as the case may be, order shall be posted on the court's notice board.
(3) Where by reason of the absence of the Magistrate or any of the magistrates the trial cannot commence on the day appointed for the trial, the trial shall stand adjourned to the following day, and so on from day-to-day, until magistrate or the magistrates are available to try the petition.
20. Adjournments
(1) The court may in its discretion adjourn the trial of a petition.
(2) Subject to the provisions of paragraph (1) of this rule, the trial shall be continued until its conclusion.
21. Illness of Resident Magistrate, etc.
Where the magistrate who has begun the trial of a petition is prevented by reason of illness or other reasonable cause from concluding the proceedings the proceedings shall be commenced de novo before another magistrate, save that where the magistrate who first tried the petition concluded the hearing of the petition but was prevented from giving his decision by reason of illness or other cause, he may, and subject to such direction as the Chief Justice may give, write out his decision and it shall be lawful for another magistrate, to deliver the decision so written out.
22. Failure by petitioner to appear
(1) Where a petitioner fails to appear before the court on the day on which the petition is to be heard, the court may dismiss the petition.
(2) Where a petition has been dismissed under paragraph (1) of this rule the court may re-admit the petition if the petitioner satisfies the court that his failure to appear on the day of the hearing was due to a reasonable cause.
23. Failure by respondent to appear
Where a respondent fails to appear on the day on which the petition is to be heard, the court may proceed to hear the petition, his absence notwithstanding, and the decision of the court in every such case shall be binding upon the respondent.
24. Appearance by advocate
For the purposes of these Rules, where a party is represented by an advocate, appearance by the advocate shall be deemed to be appearance by the party whom he represents.
25. Withdrawal of petition
(1) The petitioner may at any stage after the petition has been lodged and before the decision has been delivered, by notice in writing addressed to the Resident Magistrate-in-charge, withdraw the petition subject to such terms relating to costs as the court may deem fit to order.
(2) Where a petitioner withdraws a petition he shall not be entitled to file a fresh petition in respect of the same election save that where the court is satisfied that the petition was withdrawn for the reason that it would have been defeated on the ground of any procedural irregularity, the court may allow the petitioner to lodge a fresh petition in respect of the same election.
(3) Where there are two or more petitioners, the petition shall not be withdrawn save on application in writing by all the petitioners.
26. Certain provisions of the Civil Procedure Code to apply
(1) Subject to the provision of the Act and of these Rules the practice and procedure in respect of a petition shall be regulated, as nearly as may be, by the rules regulating the practice and procedure in a civil suit.
(2) Without prejudice to the generality of the provisions of paragraph (1) of this rule, the provisions of section 45 and of the First Schedule to the Civil Procedure Code *, which relate to discovery and inspection of documents, transfer of proceedings, settlement of issues and determination of suits, summoning of witnesses, admissibility of affidavits, awarding of costs, judgements and execution of a decree, shall apply mutatis mutandis to the proceedings on a trial of a petition and to the enforcement of an order for costs made by the court; save that no order for costs made against the Attorney-General may be executed or enforced against the Attorney-General or the Government of the United Republic.
27. Petition not to be dismissed for reason of irregularity
(1) Save as is expressly provided to the contrary in these Rules, no petition shall be dismissed for the reason only of non-compliance with any of the provisions of these Rules or for the reason only of any other procedural irregularity unless the court is of the opinion that such non-compliance or irregularity has resulted or is likely to result in the miscarriage of justice.
(2) Where there has been any non-compliance with any of the provisions of the Rules or any other procedural irregularity, the court may require the petitioner, subject to such terms as to costs or otherwise as the court may direct to rectify the non-compliance or the irregularity in such manner as the court may order.
(3) Where an order has been made under paragraph (2) of this rule, and the petitioner fails to comply with such order within such time as the court may specify, the court may dismiss the petition.
28. Transitional provisions
Subject to paragraph (2), these Rules shall apply to petitions lodged before the coming into operation of these Rules in the same manner as they apply to petitions lodged after the coming into operation of these Rules:
Provided that no petition lodged or partly heard before the coming into operation of these Rules shall be dismissed by reason only of non-compliance with any of the provisions of these Rules, but the court shall, in any such case, make such order as it may consider necessary to rectify such non-compliance.
29. Fees
The fee prescribed in the Second Schedule to these Rules shall be payable in respect of the matters specified in the Schedule in relation to the fees.
