THE DISTANCE UPON EITHER SIDE OF THE MARA BAY FERRY

    It is hereby declared that the distance upon either side of the Mara Bay Ferry within which no person shall establish or maintain a ferry shall be ten miles.

THE DECLARATION OF PUBLIC FERRIES

    The following have been declared to be public ferries for the purposes of the Ferries Act:

IFEMA

    The passage over the Mnyera River at Ifema on the Malinyi-Utengule Road, to be known as the Ifema Ferry.

KIGONGONI

    The passage over the Ruvu River at Kigongoni on the Bagamoyo-Msata Road, to be known as the Kigongoni Ferry.

KIKONGO-BUSISI

    The passage over Smith Sound on the Biharamulo-Usagara Road, to be known as the Kikongo-Busisi Ferry.

KILINDI

    The passage over the Rufiji River on the main Ndundu-Mohoro Road, to be known as the Kilindi Ferry.

KILOMBERO

    The passage over the Kilombero River on the main Ifakara-Mahenge Road, to be known as the Kilombero Ferry.

KIRUMI (MARA RIVER)

    The passage over the Mara River on the new Musoma-Tarime Road via Kirumi to be known as the Kirumi (Mara River) Ferry.

KISAUKE

    The passage over the Wami River on the Bagamoyo-Pangani Road, to be known as the Kisauke Ferry.

LINDI-KITUNDA

    The passage over the Port of Lindi between the beach adjoining the south side of the Lindi Customs Dhow Shed and the beach at Kikwetu Pier, to be known as the Lindi-Kitunda Ferry.

MAGOGONI

    The passage over the entrance to the Harbour of Dar es Salaam, that is to say from Kivukoni Front to East Ferry Point (commonly known as the "Magogoni Ferry").

MALAGARASI

    The passage over the Malagarasi River on the main Kasulu-Nyakanazi Road, to be known as the Malagarasi Ferry.

MARA BAY

    The passage over the estuary of the Mara River from Musoma to Kinessi to be known as the Mara Bay Ferry.

MUMWENDO

    The passage over the Ruvuvu River on the main Lusahunga-Ngara Road, to be known as the Mumwendo Ferry.

MURONGO

    The passage over the Kagera River near Murongo on the main road from Bugene to Mbarara, to be known as the Murongo Ferry.

NDUNDU

    The passage over the Rufiji River on the Dar es Salaam-Lindi Road, to be known as the Ndundu Ferry.

NYANTUKUZA

    The passage over the southernmost reach of Smith Sound between Ihalele in the Burima Chiefdom of the Mwanza District and Nyantukuza in the Geita District, to be known as Nyantukuza Ferry.

NYERA

    The passage over the Rufiji River on the Rusende-Nyera-Mtanza Road, to be known as the Nyera Ferry.

PANGANI

    The passage over the Pangani River estuary on the main Pangani-Mwera Road, to be known as the Pangani Ferry.

RUGEZI

    The passage over Lake Victoria between the island of Ukerewe Chiefdom and the mainland division of the Ukerewe Chiefdom on the Nansio-Kibara Road, to be known as the Rugezi Ferry.

RUVU

    The passage over the Ruvu River on the main Dar es Salaam-Morogoro Road, to be known as the Ruvu Public Ferry.

UTETE

    The passage over the Rufiji River on the main Dar es Salaam-Utete Road, to be known as the Utete Ferry.

UVINZA

    The passage over the Malagarasi River on the main Kasulu-Mpanda Road near Uvinza to be known as the Uvinza Ferry.

ORDERS

THE KIKONGO-BUSISI FERRY ORDER

(Section 15)

G.N. No. 228 of 1959

    1. This Order may be cited as the Kikongo-Busisi Ferry Order.

    2. The Kikongo-Busisi Ferry Regulations shall apply to the conveyance of passengers or cargo of any description over the Kikongo-Busisi Ferry by the service maintained by the Government.

THE NDUNDU FERRY ORDER

G.N. No. 341 of 1959

    1. This Order may be cited as the Ndundu Ferry Order.

    2. The Ndundu Ferry Regulations * shall apply to the conveyance of passengers or cargo of any description over the Ndundu Ferry by the service maintained by the Government.

REGULATIONS

THE IFEMA FERRY REGULATIONS

(Sections 11 and 15)

G.N. No. 459 of 1955

    1. These Regulations may be cited as the Ifema Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the District Commissioner of Mahenge, or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of canoe pontoons propelled by hand.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Mnyera River as and when required, beginning at 6.30 a.m. and ending at 6.30 p.m.:

    Provided that the collector may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of the collector or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    6. The maximum load which each pontoon may carry shall be seven tons total weight inclusive of motor vehicle, loads, animals and passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under these Regulations and upon conviction is liable to pay a fine of one hundred shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    behaves, while on the pontoon, in the opinion of the collector, in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards the pontoon after being warned by the collector that it already contains its maximum load; or

    (d)    boards the pontoon in an unsafe or dangerous manner or causes damage to pontoon or attachments,

commits an offence under these Regulations and is liable upon conviction to a fine of one hundred shillings, and, it shall be lawful for the collector of the administration or a Police Officer forcibly to remove such person from the pontoon.

    9. Any person who uses or attempts to use the pontoon or ancillary canoe without the permission of the collector or in the absence of the collector or during the hours of darkness commits an offence under these Regulations and is liable upon conviction to a fine of one thousand shillings.

    10. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    11. The prescribed toll fees shall be payable on demand to the collectors, and it shall be lawful for the collectors to refuse to carry on the pontoons any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee before embarking his animal, vehicle or other property on the pontoons.

    12. Except in cases mentioned in regulations 8, 10 and 11, the collector may not refuse to accept any passenger or cargo of the kind specified in the Schedule.

    13. The collector shall be responsible for the regularity of the service and the control of traffic embarking therein or disembarking therefrom, and every passenger on the pontoons shall obey all such reasonable directions as the collectors may think fit to give.

    14. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary or desirable.

    15. The toll fees specified in the Schedule shall be exhibited in a conspicuous place on the ferry landing.

THE KIGONGONI FERRY REGULATIONS

    1. These Regulations may be cited as the Kigongoni Ferry Regulations.

    2. In these Regulations, unless the context requires otherwise–

    "administration" means the District Commissioner of Bagamoyo, or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of pontoons attached by pulley to cables stretching from bank to bank.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Ruvu as and when required beginning at sunrise and ending at sunset:

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of collectors or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

THE KIKONGO-BUSISI FERRY REGULATIONS

    1. These Regulations may be cited as the Kikongo-Busisi Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Regional Engineer of Mwanza, or the officer acting on his behalf;

    "collector" means the member of the crew appointed by the administration to collect toll fees;

    "Nahodha" means the person appointed by the administration to be in charge of the ferry;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by means of a self-propelled steel pontoon, or by a steel pontoon towed by a motor vessel.

    4. The ferry services shall be operated daily throughout the year, except when in the opinion of the administration it would be unsafe to do so, and shall make crossings of Smith Sound between Busisi and Kikongo at the times set out in the timetable drawn up by the administration, beginning at 7 a.m. and terminating at 7 p.m.:

    Provided that the Nahodha shall make additional crossings outside these hours as and when directed by the administration.

    5. (1) Every ferry craft while under way shall at all times be under the charge and control of the Nahodha.

    (2) In addition to the Nahodha each ferry craft shall carry the minimum crew laid down by the administration for that type of craft.

    6. The ferry shall take on and land all passengers, cargo and livestock only at landing places and at landing ramps approved by the administration for that purpose.

    7. (1) The maximum load which the ferry may carry shall be–

    (a)    23½ tons when the self-propelled craft is in operation with a maximum axle load of 8 tons;

    (b)    10 tons when the dumb pontoon is in operation.

    (2) For the purpose of these Regulations a loaded 5-ton motor lorry shall be deemed to be the equivalent of 7.8 tons and each passenger shall be deemed to be equivalent of one hundred and fifty pounds of load.

    8. The ferry craft in use shall be kept clean, seaworthy and in good repair.

    9. (1) The maximum number of passengers and vehicles which each ferry craft is permitted to carry shall be displayed conspicuously in English and Kiswahili at both ferry landings and on board the ferry craft.

    (2) Each ferry craft shall be equipped with such life saving apparatus and fire extinguishing appliances as shall be considered necessary by the administration and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    10. Any person who–

    (a)    wilfully obstructs the Nahodha, collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    boards the pontoon after being warned by the Nahodha that it already contains its maximum load; or

    (c)    boards the pontoon in an unsafe or dangerous manner or causes damage to the pontoon or attachments,

commits an offence under these Regulations and is liable upon conviction to a fine not exceeding five hundred shillings, and it shall be lawful for the Nahodha or the collector or the administration or a Police Officer forcibly to remove such person from the pontoon.

    11. The Nahodha may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    12. The toll fees specified in the Schedule shall be payable on demand to the collector, and it shall be lawful for the collector to refuse to carry on the pontoons any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee before embarking his animal, vehicle or other property on such pontoon.

    13. Except in the cases mentioned in regulations 10 and 11 the Nahodha may not refuse to accept any passengers or cargo of the kind specified in the Schedule.

    14. The Nahodha shall be responsible for the regularity of the service and the control of traffic embarking thereon or disembarking therefrom, and every passenger on a pontoon shall obey all such reasonable directions as the Nahodha may think fit to give.

    15. The administration may at any time suspend the service of the ferry for any reason which may appear to it to render this course necessary or desirable.

    16. A notice shall be exhibited in a conspicuous place on both ferry landings stating the toll fees specified in the Schedule and that an official printed and numbered fixed fee receipt must be obtained for any ferry fees paid to the collector.

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    8. Any person who–

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Regional Engineer, Morogoro, or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule hereto.

    3. The ferry services shall be operated by the administration by means of pontoons attached by pulley to cables stretching from bank to bank.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Kilombero as and when required beginning at 6.30 a.m. and ending at 6.30 p.m.:

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

THE KIRUMI (MARA RIVER) FERRY REGULATIONS

G.N. No. 288 of 1957

    1. These Regulations may be cited as the Kirumi (Mara River) Ferry Regulations, and shall apply to the public ferry known as the Kirumi (Mara River) Ferry.

    2. In these Regulations the following expressions shall have the meanings respectively assigned to them, that is to say–

    "administration" means the Engineer-in-Chief or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees prescribed in the Schedule to these Regulations.

    3. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so, and shall make crossings of the Mara River as and when required beginning at 7 a.m. and terminating at 7 p.m.:

    Provided that a collector may make additional crossings outside these hours as and when directed by the administration.

    4. The ferry services shall be operated by the administration by means of pontoons attached by pulley to cables stretching from bank to bank.

    5. (1) The pontoons while under way shall at all times be under the charge and control of a collector or, if present, by the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    6. The maximum load which the pontoon may carry shall be ten tons total weight inclusive of motor vehicles, loads, animals and passengers and for the purpose of these Regulations, each passenger shall be deemed to be the equivalent of one hundred and fifty pounds of load.

    7. If a passenger with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under those Regulations and upon conviction is liable to pay a fine of one hundred shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work a pontoon in the execution of his duties; or

    (b)    behaves while on a pontoon in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards a pontoon after being warned by the collector that it already contains its maximum load; or

    (d)    boards a pontoon in an unsafe or dangerous manner or causes damage to a pontoon or attachments; or

    (e)    boards a pontoon or uses or attempts to use a pontoon without the permission of the collector or in the absence of the collector,

commits an offence against these Regulations and is liable on conviction to a fine of one hundred shillings, and it shall be lawful for the collector, or the administration or a Police Officer forcibly to remove such person from the pontoon.

    9. A collector may refuse to allow to board a pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking, or during carriage.

    10. The toll fees specified in the Schedule hereto shall be payable on demand to the collector and it shall be lawful for the collector to refuse to carry on any pontoon any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee before embarking his animal, vehicle or other property on such pontoon.

    11. Except in the cases mentioned in regulation 8, 9 or 10, the collector may not refuse to accept any passenger or cargo of the kind specified in the Schedule.

    12. The collector shall be responsible for the regularity of the service and the control of traffic embarking thereon or disembarking therefrom, and every passenger on a pontoon shall obey all such reasonable directions as the collector may think fit to give.

THE KISAUKE FERRY REGULATIONS

G.N. No. 214 of 1956

    1. These Regulations may be cited as the Kisauke Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the District Commissioner, of Bagamoyo;

    "ferry" means the Kisauke Ferry and includes craft used in carrying on the ferry service;

    "licensee" means the holder of a licence under the Public Ferries Act in respect of the Kisauke Public Ferry;

    "Nahodha" means the person appointed by the licensee to be in charge of the ferry;

    "toll collector" means the nahodha or any person deputed by him to collect toll fees.

    3. The ferry shall be managed and carried on by the licensee by means of a pontoon.

    4. The ferry service shall be efficiently maintained daily throughout the year and shall make crossings of the Wami River as and when required beginning at 7 a.m. and terminating at 7 p.m. and at such other times as the licensee may decide.

    5. (1) The ferry while under way shall at all times be under the charge and control of the Nahodha.

    (2) In addition to the Nahodha the crew of the pontoon shall consist of five persons of whom not less than three shall be on duty at one time.

    6. (1) The ferry craft in use shall at all times be kept clean, seaworthy and in good repair.

    (2) The ferry craft shall be inspected once in every six months by the administration and the licensee shall beach the ferry craft and carry out all reasonable instructions given by the administration for the purpose of such inspection and service fees shall be paid by the licensee.

    7. Each ferry craft shall be equipped with such life saving apparatus and fire extinguishing appliances as shall be considered necessary by the administration, and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    8. (1) The maximum load which the ferry is permitted to carry shall be three tons.

    (2) There should be exhibited by the licensee in a conspicuous place on the ferry craft a notice in English, Gujarati and Kiswahili denoting the maximum load which such craft is permitted to carry.

    9. Any person crossing by the ferry who shall–

    (a)    refuse to pay the prescribed toll fee; or

    (b)    fraudulently or forcibly pass by the toll collector without paying the prescribed toll fee; or

    (c)    wilfully obstruct the toll collector or other person employed to work such ferry in the execution of their respective duties; or

    (d)    enter a ferry craft knowing that it contains its maximum load,

shall be guilty of a breach of these Regulations and it shall be lawful for the Nahodha, any toll collector, member of the crew or Police Officer forcibly to remove from ferry any such person.

    10. The Nahodha may require any person in charge of a vehicle to remove from such vehicle any articles which are being carried in or upon or which are attached to such vehicle, before such vehicle is driven onto the ferry, and any such person who having failed to observe such requirement drives or causes or permits to be driven any such vehicle onto the ferry shall be guilty of a breach of these Regulations.

    11. The toll fees specified in the Schedule hereto may be demanded by the toll collector from every person using the ferry, and it shall be lawful for the toll collector to refuse to carry any person or the cattle or vehicle of any person on the ferry unless such person shall have paid the appropriate toll fee before entering or embarking his cattle or vehicle on the ferry.

    12. A toll collector shall not demand from any person more than the appropriate toll fee specified in the Schedule and shall not refuse to take a passenger on the ferry except in the cases mentioned in regulations 9 and 10, or for some other reasonable cause.

    13. The table of toll fees shall be exhibited by the licensee in a conspicuous place on each ferry landing.

    14. No person in charge of any craft shall permit such craft to obstruct the working of the ferry.

    15. The Nahodha shall have sole authority to regulate the ferry service and to control the traffic thereon and every passenger shall obey all reasonable directions given by the Nahodha.

    16. Upon giving at least forty-eight hours' notice to persons using or likely to use the ferry as the administration considers necessary to bring to the notice of such persons, the licensee may, once in every two months, and for a period not exceeding forty-eight hours withdraw the pontoon from the ferry service for the purpose of servicing or repair.

THE KOME FERRY REGULATIONS

    1. These Regulations may be cited as Kome Regulations and shall apply to the public ferry service on a public Ferry, commonly known as the Mafia Ferry Kilindoni Point, in the Indian Ocean (herein referred to as the "Ferry Service").

    2. In these Regulations, the following expressions shall, unless the context otherwise requires, have the meaning hereby respectively assigned to them, that is to say–

    "administration" means the Regional Engineer, Minister of Communication, Works, and Transport, Lindi, or the officer acting on his behalf;

    "collector" means the member of the crew of the motor boat appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of a motor boat for the carriage of passengers and selected cargo only.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so, and shall make crossings in lake Victoria between Nyakalilo and Kome Islands at regular intervals beginning at 5 a.m. and ending at 9 p.m.

    5. The collectors may make additional crossings outside the hours specified in regulation 4 as and when directed by the administration.

    6. The maximum number of passengers which may be carried in the ferry at any one time shall be limited to eight in number and the maximum load inclusive of passengers and cargo shall be one ton total, and for the purposes of these Regulations each passenger shall be the equivalent of 150 kg. of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he shall be guilty of an offence against the Regulations and on conviction shall be liable to pay a fine of one thousand shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    behaves, while on the pontoon, in the opinion of the collector, in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

The prescribed toll fee shall be payable on demand of the collectors, and it shall be lawful for the collector to refuse to carry on the motor boat any person or load, unless the appropriate toll fee shall have been paid in respect of such person or load prior to embarkation on the motor boat.

    6. The maximum load which each pontoon may carry shall be seven tons total weight inclusive of motor vehicle, loads, animals and passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    7. If a passenger with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under these Regulations and upon conviction is liable to pay a fine of one hundred shillings.

The maximum number of passengers which may be carried in the ferry at any one time shall be limited to eight in number and the maximum load inclusive of passengers and cargo shall be one ton total, and for the purposes of these Regulations each passenger shall be the equivalent of 150 kg. of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

    1. These Regulations may be cited as the Magogoni Ferry Regulations.

    2. In these Regulations, unless the context otherwise, requires–

    "approved" means approved by the Minister;

    "collector" means the person appointed by the licensee to be in charge of the operation of the ferry service and to collect toll fees and includes any officer of the licensee in authority over him;

    "coxswain" means the person appointed by the licensee to control a ferry;

    "ferry" means any ferry boat or combination of ferry boats used in operating the ferry service;

    "ferry boat" means any motor launch, floating vessel or pontoon used in operating the ferry service;

    "Harbour Master" means the Harbour Master of Dar es Salaam Harbour;

    "licensee" means the person licensed under the Ferries Act to ply for hire on the public ferry, commonly known as the "Magogoni Ferry" between Azania Front and East Ferry Point, Dar es Salaam;

    "Magogoni Ferry" means the public ferry between Kivukoni Front and East Ferry Point, Dar es Salaam;

    "Port Manager" means the Port Manager of the Port of Dar es Salaam;

    "toll fees" means the fees prescribed in the Schedule to these Regulations.

    3. The ferry service shall be operated by the licensee by means of a ferry consisting of ferry boats which shall be a pontoon in tow of a motor launch or a motor launch without such pontoon as the circumstances of the traffic crossing the ferry may from time to time demand or such other form of craft as may be approved.

    4. (1) No ferry boat shall be used for the operation of the ferry service until such ferry boat has been approved for such use.

    (2) Every approval given in pursuance of the provisions of paragraph (1) of this regulation shall be in writing and shall specify the maximum load which may be carried on the ferry boat to which such approval relates and shall also specify the life saving and fire extinguishing apparatus to be carried thereon.

    (3) There shall be exhibited by the licensee in a conspicuous place on every ferry boat a notice in English and a notice in Kiswahili denoting the maximum load specified for such ferry boat under the provisions of paragraph (2) of this regulation.

    (4) Every ferry boat shall carry thereon in serviceable condition the life saving and fire extinguishing apparatus specified therefor under the provisions of paragraph (2) of this regulation.

    (5) No person shall cause or permit a load in excess of the maximum load specified therefor under the provisions of paragraph (2) of this regulation to be on any ferry boat.

    5. (1) The coxswain shall be responsible for the control of traffic embarking on a ferry or disembarking therefrom.

    (2) All passengers, cattle and vehicles or other cargo shall be taken on and landed at the ramps provided for that purpose on each side of the ferry crossing and when being so taken on or landed any ferry boat then being used shall be secured to such ramps.

    (3) Every passenger embarking on or disembarking from a ferry shall obey all such reasonable directions as the coxswain thereof may think fit to give.

    6. (1) A ferry while under way shall at all times be under the control of the coxswain thereof.

    (2) Every passenger while on a ferry shall obey all such reasonable directions as the coxswain thereof may think fit to give.

    7. (1) Every ferry boat used for carrying vehicles shall be equipped at each end thereof with a removable barrier.

    (2) The barriers under subregulation (1) shall be of a type and strength sufficient when in position to prevent any vehicle from leaving such ferry boat.

    (3) The barrier at the seaward end shall be in position when any vehicle is being loaded on such ferry boat and both barriers shall be in position while such ferry boat is under way.

    8. The coxswain of a ferry shall keep such ferry clear of all vessels navigating the harbour entrance and shall at all times carry out any lawful direction given by the Port Manager or Harbour Master or any pilot in the employment of the Tanzania Railways Corporation and Tanzania Harbours Authority.

    9. (1) The licensee shall operate daily *

    (a)    a full ferry service at reasonable intervals between 5.30 a.m. and 10 p.m.; and

    (b)    a restricted ferry service thereafter,

by using one or more ferries for the purpose of carrying passengers and motor-vehicles.

    (2) Nothing in subregulation (1) shall be interpreted so as to prohibit the licensee from operating the full ferry service, whenever he considers it appropriate to do so, outside the hours prescribed in paragraph (a) of that subregulation.

    10. If a passenger on the ferry service with intent to defraud the licensee–

    (a)    refuses to pay the appropriate toll fee and any special toll which may be exigible; or

    (b)    leaves or attempts to leave a ferry without paying the appropriate toll fee and any special toll which may be exigible,

commits an offence under these Regulations.

    11. Any person who–

    (a)    is in a state of intoxication or behaves in a violent or offensive manner to the annoyance of others on a ferry;

    (b)    does anything which may cause injury to persons employed or travelling on the ferry service;

    (c)    without lawful authority operates the ferry service or moves or sets adrift or otherwise causes damage to any ferry boat or causes damage to landing places, approaches or ramps maintained in connection with the ferry service;

    (d)    disobeys while embarking on or disembarking from a ferry the reasonable directions of the coxswain thereof;

    (e)    commits any nuisance or uses profane, obscene, indecent or abusive language on a ferry;

    (f)    wilfully removes, alters, destroys or damages any ferry boat, gate, tow-bar, table of charges, gear, tackle, landing place, approach, ramp or other thing maintained in connection with the ferry service;

    (g)    boards or places anything on a ferry after being warned by the collector that the ferry already contains its maximum load,

commits an offence under these Regulations and it shall be lawful for the collector, coxswain or a Police Officer forcibly to remove such person from the ferry on which he may have embarked.

    12. (1) The toll fees specified in the Schedule to these Regulations shall be payable on demand to the collector.

    (2) It shall be lawful for the collector to refuse to carry on the ferry any person or the cattle, vehicle or other property of any person unless such person shall have paid the appropriate toll fee and where exigible the appropriate special toll before entering or embarking his cattle, vehicle or other property on the ferry.

    13. Except in the case mentioned in paragraph (a) of Regulation 10 and the cases mentioned in regulations 11 and 12, the collector may not refuse to accept any passenger or any cargo of the kind specified in the Schedule to these Regulations.

    14. (1) If any person in charge of any shore boat or other small craft shall cause or permit such boat or craft to lie alongside the ferry landings so as to cause obstruction to the working of the ferry, he commits an offence under these Regulations.

    (2) No person shall use the ferry landings or ramps for any purpose not connected with the ferry service without the permission of the Minister.

    (3) If any person shall cause or permit any water-borne craft of any description when proceeding past the ferry ramps to travel at a speed which shall cause risk or accident to passengers or property at or on the ramps, or risk to the safe working of the ferry service, commits an offence under these Regulations.

    15. Every ferry boat when under way and whether in tow or otherwise shall exhibit the ordinary lights prescribed under the Dar es Salaam Port Rules or any rules or regulations amending or replacing the same for the time being in force.

    16. The collector shall be responsible for the regularity of the ferry service.

    17. Any passenger, other than the driver of the vehicle, who remains in a vehicle while it is on the ferry or either of the ramps thereof commits an offence under these Regulations.

    18. Any driver of a vehicle who fails to engage the first or lowest gear of such vehicle while such vehicle is being driven upon the ferry or upon either of the ramps thereof commits an offence under these Regulations.

    19. (1) Any passenger other than the driver of a vehicle who embarks on to the ferry before all vehicles have embarked thereon commits an offence under these Regulations.

    (2) Any driver of a vehicle who causes such vehicle to be disembarked from the ferry before all passengers other than the drivers of vehicles have disembarked therefrom shall be guilty of an offence against these Regulations.

THE MALAGARASI FERRY REGULATIONS

G.N. No. 450 of 1955

    1. These Regulations may be cited as the Malagarasi Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Regional Engineer, Kigoma Region, or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of pontoons attached by pulleys to cables stretching from bank to bank.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Malagarasi River as and when required beginning at sunrise and ending at sunset:

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of collectors or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    6. The maximum load which each pontoon may carry shall be ten tons total weight inclusive of motor vehicle, loads, animals, passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under these Regulations and upon conviction is liable to pay a fine of one hundred shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    behaves, while on the pontoon, in the opinion of the collector, in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards the pontoon after being warned by the collector that it already contains its maximum load; or

    (d)    boards the pontoon in an unsafe or dangerous manner or causes damage to the pontoon or its attachments,

commits an offence under these Regulations and shall be liable upon conviction to a fine of one hundred shillings, and it shall be lawful for the collector or the administration or a Police Officer forcibly to remove such person from the pontoon.

    9. Any person who uses or attempts to use the pontoon or ancillary canoe without the permission of the collector or in the absence of the collector or during the hours of darkness commits an offence under these Regulations and is liable upon conviction to a fine of one thousand shillings.

    10. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    11. The prescribed toll fees shall be payable on demand to the collectors, and it shall be lawful for the collectors to refuse to carry on the pontoons any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee before embarking his animal, vehicle or other property on the pontoon.

    12. Except in the cases mentioned in regulations 8, 10 and 11, the collectors may not refuse to accept any passenger or cargo of the kind specified in the Schedule.

    13. The collectors shall be responsible for the regularity of the service and control of traffic embarking therein or disembarking therefrom, and every passenger on the pontoons shall obey all such reasonable directions as the collectors may think fit to give.

    14. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary or desirable.

    15. The toll fees specified in the Schedule shall be exhibited in a conspicuous place on the ferry landing.

THE MARA BAY FERRY REGULATIONS

G.N. No. 176 of 1954

    1. These Regulations may be cited as the Mara Bay Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "ferry" means the Mara Bay Ferry and includes the craft used in carrying on the ferry service;

    "licensee" means the holder of a licence under the Ferries Act * in respect of the Mara Bay Ferry;

    "Nahodha" means the person appointed by the licensee to be in charge of the ferry;

    "toll collector" means the Nahodha or any person deputed by him to collect toll fees;

    "toll fees" means the fees prescribed in the Schedule to these Regulations.

    3. The ferry service shall be managed and carried on by the licensee by means of at least one craft, which shall be capable of carrying at least one lorry of up to five tons gross laden weight.

    4. (1) The ferry service shall be efficiently maintained daily throughout the year between Musoma and Kinesi on Mara Bay and at least two crossings shall be made in each direction from Mondays to Fridays inclusive and one crossing on Saturdays and Sundays and the times of the daily crossings in each direction shall be notified to persons using or likely to use the ferry in the Musoma and North Mara Districts in such manner as the District Commissioner in each district considers necessary to bring such times to the notice of such persons, and the licensee shall in like manner give at least ten days' notice of any change in such times.

    (2) The licensee shall also be prepared at any time to provide a special charter ferry at the special charge laid down therefor in the Schedule to these Regulations. Should the licensee at any time refuse to comply with any reasonable request by any person to provide a special charter service, the District Commissioner, Musoma, or the District Commissioner, North Mara, may require the licence to provide such service.

    5. (1) Each ferry craft while under way shall be in sole control of a Nahodha approved under the provisions of paragraph (3) of this regulation.

    (2) In addition to the Nahodha, each ferry craft shall carry the minimum crew laid down for that type of craft by the District Commissioner, Musoma.

    (3) The Nahodha and each member of the crew shall be in possession of a certificate of competency for their particular work and the certificate of competency shall be issued by the District Commissioner, Musoma, and shall be in such form as he may think fit.

    6. The ferry shall take on and land all passengers, cargo and livestock only at landing places approved either by the District Commissioner, Musoma or by the District Commissioner, North Mara.

    7. The licensee shall provide all facilities necessary to enable the craft to moor in safety at the approved landing places at any time of day.

    8. (1) The ferry craft in use shall at all times be kept clean, seaworthy and in good repair and each ferry craft shall be inspected once in every year by an officer approved by the Regional Commissioner, Mara Region, and certified by him as fit for a further year's service unless the craft, after such inspection, can in the opinion of the inspecting officer, be certified only for a shorter period, in which case a second inspection shall be held at the expiry of such period.

    (2) The licensee shall beach the ferry craft and carry out all reasonable requests given by the District Commissioner, Musoma, or the District Commissioner, North Mara, for the purposes of such inspection.

    (3) The fees and expenses of the inspection shall be paid by the licensee.

    9. Each ferry craft shall be equipped with such life-saving apparatus and fire-extinguishing appliances as shall be considered necessary by the District Commissioner, Musoma, and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    10. (1) The maximum number of passengers or vehicles which each ferry craft is permitted to carry shall be laid down by the District Commissioner, Musoma.

    (2) There shall be exhibited by the licensee in a conspicuous place on each ferry craft a notice in English, and Kiswahili denoting the maximum number of passengers or vehicles which such craft is permitted to carry.

    11. Any person crossing by the ferry who–

    (a)    refuses to pay the appropriate toll fee as laid down in the Schedule to these Regulations; or

    (b)    fraudulently or forcibly passes by the toll collector without paying the prescribed toll fee; or

    (c)    wilfully obstructs the toll collector or other person employed to work such ferry in the execution of his duties; or

    (d)    enters a ferry craft knowing that it contains its maximum load,

commits a breach of these Regulations and is liable to the penalties prescribed under in the Ferries Act * and it shall be lawful for the Nahodha, any toll collector, member of the crew or Police Officer forcibly to remove from the ferry any such person.

    12. The toll fees specified in the Schedule to these Regulations may be demanded by the toll collector from every person using the ferry and it shall be lawful for the toll collector to refuse to carry any person or the cattle, cargo or vehicle of any person on the ferry unless such person shall have paid the appropriate toll fee before entering or embarking his cattle, cargo or vehicle on the ferry.

    13. A toll collector shall not demand from any person more than the appropriate toll fee specified in the Schedule to these Regulations and shall not refuse to take a passenger on the ferry except in the cases mentioned in regulations 11 and 12 or for some other reasonable cause.

    14. The table of toll fees shall be exhibited by the licensee in a conspicuous place on each ferry landing and ferry craft.

    15. No person in charge of any craft shall permit such craft to obstruct the working of the ferry.

    16. The Nahodha shall have sole authority to regulate the ferry service and to control the traffic thereon and every passenger shall obey all reasonable directions given by the Nahodha.

    17. Upon giving at least forty-eight hours' notice to persons using or likely to use the ferry in the Musoma and North Mara Districts in such manner as the District Commissioner in each district considers necessary to bring to the notice of such persons, the licensee may once in every two months and for a period not exceeding forty-eight hours in each case withdraw any ferry craft from service for the purpose of servicing or repair.

THE MSANGA MKUU FERRY REGULATIONS

(Section 11)

    1. Citation

    These Regulations may be cited as the Msanga Mkuu Regulations, and shall apply to the public ferry service on a public Ferry, commonly known as the Msanga Mkuu Ferry at Mtwara Point, between Mshangani Mtwara and Mpondo Msanga (herein referred to as the "Ferry Service").

    2. In these Regulations, the following expressions shall, unless the context otherwise requires, have the meaning hereby respectively assigned to them, that is to say–

    "administration" means the Regional Engineer, Ministry of Communications, Works and Transport, Mtwara, or the officer acting on his behalf;

    "collector" means the member of the crew of the motor boat appointed by the administration to collect toll fees;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of a motor boat for the carriage of passengers and selected cargo only.

    4. The Ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so, and shall make crossings of the Mtwara Harbour entrance at regular intervals of not more than 20 minutes per round trip, beginning at 5 a.m. and ending at 9 p.m.

    5. The collectors may make additional crossing outside the hours specified in regulation 4 as and when directed by the administration:

    (a)    The motor boat while under way shall at all times be under the control of the collectors, or if present, the administration.

    (b)     All passengers and cargo shall be taken on or landed at the landing stages provided by the administration.

    6. The maximum number of passengers which may be carried in the ferry at any one time shall be limited to eight in number and the maximum load inclusive of passengers and cargo shall be one ton total, and for the purposes of these Regulations each passenger shall be the equivalent of 150 kgs. of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he shall be guilty of an offence against these Regulations and on conviction shall be liable to pay a fine of one thousand shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    behaves, while on the pontoon, in the opinion of the collector in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards the motor boat after being warned by the collector that it already contains its maximum load; or

    (d)    boards the motor boat in an unsafe or dangerous manner or causes damage to the pontoon or attachments,

shall be guilty of an offence against these Regulations and shall be liable on conviction to a fine of one thousand shillings, and it shall be lawful for the collector of the administration or a Police Officer forcibly to remove such person from the motor boat.

    9. Any person who uses or attempts to use the motor boat without the permission of the collector or administration, or in the absence of the collector or administration, shall be guilty of an offence against these Regulations and shall be liable on conviction to a fine of one thousand shillings.

    10. The collector may refuse to allow on board any person or load which, in his opinion, may endanger safety during the act of boarding, or disembarkation, or during carriage.

    11. The prescribed toll fee shall be payable on demand of the collectors, and it shall be lawful for the collector to refuse to carry on the motor boat any person or load, unless the appropriate toll fee shall have been paid in respect of such person or load prior to embarkation on the motor boat.

    12. The collectors shall be responsible for the regularity of the service and the control of traffic embarking thereon or disembarking therefrom, and every passenger on the motor boat shall obey all such reasonable directions as the collectors may think fit to give.

    13. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary or desirable.

    14. The maximum number of passengers and/or loads which the motor boat is permitted to carry shall be displayed conspicuously in Kiswahili at both ferry landings and on the motor boat.

    15. The toll fees specified in the Schedule shall be exhibited in a conspicuous place at each ferry landing.

THE MURONGO FERRY REGULATIONS

    1. These Regulations may be cited as the Murongo Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Engineer-in-Chief or the officer acting on his behalf;

    "collector" means the member of the crew of the pontoon appointed by the administration to collect toll fees;

    "toll fees" means the fees prescribed in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of pontoons attached by pulleys to cables stretching from bank to bank.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Kagera as and when required beginning at 6 a.m. and terminating at 6 p.m:

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of collectors or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    (3) The collector of the Murongo pontoon shall give right of way to the Tanzania Railways Corporation and Tanzania Harbours Authority's tug plying on the Kagera River.

    6. The maximum load which each pontoon may carry shall be three and a half tons total weight inclusive of motor vehicle loads, animals and passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    7. If a passenger, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under these Regulations and upon conviction shall be liable to a fine of one hundred shillings.

    8. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    behaves, while on the pontoon, in the opinion of the collector in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards the pontoon after being warned by the collector that it already contains its maximum load; or

    (d)    boards the pontoon in an unsafe or dangerous manner or causes damage to the pontoon or its attachments,

commits an offence under these Regulations and is liable upon conviction to a fine of one hundred shillings and it shall be lawful for the collector or the administration or a Police Officer forcibly to remove such person from the pontoon.

    9. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    10. The toll fees specified in the Schedule shall be payable on demand to the collectors and it shall be lawful for the collectors to refuse to carry on the pontoons any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee before embarking his animal, vehicle or other property on the pontoons.

    11. Except in the cases mentioned in regulations 8, 9 and 10 the collectors may not refuse to accept any passenger or cargo of the kind specified in the Schedule.

    12. The collectors shall be responsible for the regularity of the service and the control of traffic embarking therein or disembarking therefrom, and every passenger on the pontoons shall obey all such reasonable directions as the collectors may think fit to give.

    13. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary or desirable.

    14. The toll fees specified in the Schedule shall be exhibited in a conspicuous place on the ferry landing.

    "administration" means the Regional Engineer, Coast Region or the officer acting on his behalf;

    "toll fees" means the fees set out in the Schedule to these Regulations.

    3. The ferry services shall be operated by the administration by means of pontoons towed by a motor vessel.

    4. The ferry services shall be operated daily throughout the year except when in the opinion of the administration it would be unsafe to do so and shall make crossings of the Rufiji River as and when required beginning at 6.30 a.m. and ending at 6.30 p.m.:

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of collectors or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    6. The maximum load which each pontoon may carry shall be twelve tons total weight inclusive of motor vehicles, loads, animals and passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    7. Any person who–

    (a)    wilfully obstructs the collector or other person employed to work the pontoon in the execution of his duties; or

    (b)    boards the pontoon after being warned by the collector that it already contains its maximum load; or

    (c)    boards the pontoon in an unsafe or dangerous manner or causes damage to the pontoon or its attachments,

commits an offence under these Regulations and is liable upon conviction to a fine not exceeding five hundred shillings, and it shall be lawful for the collector or the administration or a Police Officer forcibly to remove such person from the pontoon.

    8. The maximum number of passengers and/or vehicles which each ferry craft is permitted to carry shall be displayed conspicuously in English and Kiswahili at both ferry landings and on board the ferry craft.

    9. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    10. The prescribed toll fee shall be payable on demand to the collectors, and it shall be lawful for the collectors to refuse to carry on a pontoon any motor vehicle unless the person in charge of the said vehicle shall have paid the appropriate toll fee before embarking his vehicle on such pontoon.

    Provided that the collectors may make additional crossings outside these hours as and when directed by the administration.

    5. (1) The pontoons while under way shall at all times be under the charge and control of collectors or, if present, the administration.

    (2) All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    7. If the person in charge of a motor vehicle, with intent to defraud the administration–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    leaves or attempts to leave the ferry without paying the prescribed toll fee,

he commits an offence under these Regulations and upon conviction is liable to pay a fine of one hundred shillings.

    8. Any person who–

    10. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    11. The prescribed toll fee shall be payable on demand to the collectors, and it shall be lawful for the collectors to refuse to carry on the pontoon any motor vehicle unless the person in charge of the said vehicle shall have paid the appropriate toll fee before embarking his vehicle on the pontoon.

THE PANGANI FERRY REGULATIONS

    1. These Regulations may be cited as the Pangani Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the District Commissioner, Pangani, or the officer acting on his behalf;

    "collector" means the person appointed by the licensee to collect toll fees but he shall not be a member of the crew of the ferry;

    "ferry" means the Pangani Ferry and includes craft used in carrying on the ferry services;

    "licensee" means the holder of a licence under the Ferries Act * in respect of the Pangani Public Ferry;

    "toll fees" means the fees set out in the schedule to these Regulations;

    "Nahodha" means any person appointed from time to time by the licensee to be in charge of the ferry.

    3. The ferry shall be managed and carried on by the licensee by means of a pontoon propelled by a launch.

    4. The ferry service shall be efficiently maintained daily throughout the year and shall make crossings of the Pangani River as and when required beginning at 7 a.m. and terminating at 7 p.m. and at such other times as the licensee may decide, except during the hours of darkness, provided that in case of emergency and with the permission of the administration the ferry may be used during the hours of darkness.

    5. (1) The ferry while under way shall at all times be under the charge and control of the Nahodha.

    (2) In addition to the Nahodha the crew of the ferry shall consist of five persons of whom not less than three shall be on duty at any one time.

    6. All passengers and all animals, vehicles and other cargo shall be taken on or landed at the ramps provided for that purpose.

    7. (1) The ferry craft in use shall at all times be kept clean, seaworthy and in good repair.

    (2) The ferry craft shall be inspected once in every six months by the administration and the licensee shall beach the ferry craft and carry out all reasonable instructions given by the administration for the purpose of such inspection.

    8. Each ferry craft shall be equipped with such life saving apparatus and fire extinguishing appliances as shall be considered necessary by the administration, and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    9. (1) The maximum load which each craft may carry shall be ten tons total weight inclusive of motor vehicles, loads, animals and passengers and for the purpose of these Regulations each passenger shall be the equivalent of one hundred and fifty pounds of load.

    (2) There shall be exhibited by the licensee in a conspicuous place at both approaches to the ferry a notice in English, and Kiswahili denoting the maximum load which such craft is permitted to carry.

    10. If a passenger, with intent to defraud, boards or attempts to board the ferry without paying the prescribed toll fee, he commits an offence under these Regulations and upon conviction is liable to a fine not exceeding one hundred shillings.

    11. Any person who–

    (a)    wilfully obstructs the collector from collecting toll fees or any member of the crew of the ferry in the execution of his duties; or

    (b)    behaves, while on the ferry, in an insulting or indecent manner towards any member of the crew or any passenger, or commits any nuisance or uses obscene or abusive language; or

    (c)    boards the ferry after being warned that it already contains its maximum load; or

    (d)    boards the ferry in an unsafe or dangerous manner or causes damage to the ferry or its attachments,

commits an offence under these Regulations and is liable upon conviction to a fine of one hundred shillings, and it shall be lawful for the Nahodha, any member of the crew or any Police Officer forcibly to remove such person from the ferry.

    12. Any person who uses or attempts to use the ferry without the permission of the Nahodha or in the absence of the Nahodha or, save as provided by regulation 4 hereof, during the hours of darkness commits an offence under these Regulations and is liable upon conviction to a fine not exceeding one thousand shillings.

    13. The Nahodha may refuse to allow on board the craft any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    14. The prescribed toll fees shall be payable before embarkation to the collector, and it shall be lawful for the Nahodha to refuse to carry on the ferry any person or animal, vehicle or other property of any person unless such person shall have paid the appropriate toll fee to the collector before embarking his animal, vehicle or other property on the ferry.

    15. The Nahodha may require any person in charge of a vehicle to remove from such vehicle any articles which are being carried in or upon or which are attached to such vehicle, before such vehicle is driven on to the ferry and any such person who having failed to observe such requirements drives or causes or permits to be driven any such vehicle aboard the ferry commits an offence under these Regulations and is liable upon conviction to a fine not exceeding one hundred shillings.

    16. Except in the cases mentioned in regulations 11, 12, 13 and 14, the Nahodha may not refuse to accept any passenger or cargo of the kind specified in the Schedule.

    17. The Nahodha shall be responsible for the regularity of the service and the control of traffic embarking therein or disembarking therefrom, and every passenger on the ferry shall obey all such reasonable directions as the Nahodha may think fit to give.

    18. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary and desirable.

    19. Upon giving at least forty-eight hours' notice, the licensee may, once in every two months, and for a period not exceeding forty-eight hours withdraw the craft from the ferry service for the purpose of servicing or repair.

    20. The toll fees specified in the Schedule shall be exhibited in a conspicuous place on both the ferry landings.

    1. These Regulations may be cited as the Rugezi Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Engineer-in-Chief or the officer acting on his behalf;

    "approved" means approved by the Regional Engineer, Mwanza Region, or the officer acting on his behalf;

    "ferry" means the craft used in carrying on the ferry service;

    "licensee" means the holder of a licence under the Ferries Act in respect of the Rugezi Public Ferry;

    "Nahodha" means the person appointed by the licensee to be in charge of the ferry;

    "toll collector" means the Nahodha or any person deputed by him to collect toll fees;

    "toll fees" means the fees prescribed in the Schedule to these Regulations.

    3. The ferry should be managed and carried on by the licensee by means of a pontoon or any other vessel provided by the administration.

    4. The ferry service shall be officially maintained daily throughout the year and shall make crossings between Ukerewe Island and the mainland as and when required beginning at 7 a.m. and terminating at 10 p.m.

    5. (1) The ferry shall be under the sole control of the approved Nahodha.

    (2) In addition to the Nahodha the crew of the pontoon shall consist of ten persons of whom not less than six shall be on duty at any one time.

    6. The ferry shall keep out of the way of all vessels belonging to the Tanzania Railways Corporation and Tanzania Harbours Authority.

    7. (1) The ferry craft in use shall at all times be kept clean, seaworthy and in good repair.

    (2) The ferry craft shall be inspected once in every six months by an officer appointed by the Regional Engineer, Mwanza Region, and the licensee shall beach the ferry craft and carry out all reasonable orders given by the Regional Engineer, Mwanza Region or the officer acting on his behalf with a view to facilitating inspection and the survey fees shall be paid by the licensee.

    8. Each ferry craft shall be equipped with such life-saving apparatus and fire-extinguishing appliances as shall be considered necessary by the Regional Engineer, Mwanza Region, or officer acting on his behalf and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    9. (1) The maximum load which the ferry is permitted to carry shall be as follows:

    On a wooden pontoon .................

    (2) There shall be exhibited by the licensee in a conspicuous place on the ferry craft a notice in English, and Kiswahili denoting the maximum load which such craft is permitted to carry.

    10. Any person crossing by the ferry who–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    fraudulently or forcibly passes by the toll collector without paying the prescribed toll fee; or

    (c)    wilfully obstructs the toll collector or other person employed to work such ferry in the execution of their respective duties; or

    (d)    enters a ferry craft knowing that it contain its maximum load,

commits an offence under these Regulations and it shall be lawful for the Nahodha, any toll collector, member of the crew or Police constable forcibly to remove from the ferry any such person.

    11. The toll fees specified in the Schedule to these Regulations may be demanded by the toll collector from every person using the ferry, and it shall be lawful for the toll collector to refuse to carry any person or the cattle or vehicle of any person on the ferry unless such person shall have paid the appropriate toll fee before entering or embarking his cattle or vehicle on the ferry.

    12. A toll collector shall not demand from any person more than the appropriate toll fee specified in the Schedule to these Regulations and he shall not refuse to take a passenger on the ferry except in the cases mentioned in regulations 10 and 11, or for some reasonable cause.

    13. The table of toll fees shall be exhibited by the licensee in a conspicuous place on each ferry landing.

    14. No person in charge of any canoe or other craft shall cause such canoe to lie alongside the ferry landings so as to cause an obstruction to the working of the ferry.

    15. The Nahodha shall have sole authority to regulate the ferry service and to control the traffic thereon and every passenger shall obey all such reasonable directions as the Nahodha may think fit to give.

    16. Upon giving forty-eight hours' notice of his intention to do so the licensee may, once in every two months, and for a period not exceeding forty-eight hours withdraw the pontoon from the ferry service for the purpose of dry docking.

commits an offence under these Regulations and is liable upon conviction to a fine of one hundred shillings, and it shall be lawful for the collector or the administration or a Police Officer forcibly to remove such person from the pontoon.

    9. Any person who uses or attempts to use the pontoon or ancillary canoe without the permission of the collector or in the absence of the collector or during the hours of darkness commits an offence under these Regulations and is liable upon conviction to a fine of one thousand shillings.

    10. The collector may refuse to allow to board the pontoon any vehicle, animal or person which, in his opinion, may endanger safety during the act of boarding or disembarking or during carriage.

    11. The prescribed toll fee shall be payable on demand to the collectors, and it shall be lawful for the collectors to refuse to carry on the pontoons any motor vehicle unless the person in charge of the said vehicle shall have paid the appropriate toll fee before embarking his vehicle on the pontoons.

    12. Except in the cases mentioned in regulations 8, 10 and 11, the collectors may not refuse to accept any passenger or cargo.

    13. The collectors shall be responsible for the regularity of the service and the control of traffic embarking therein or disembarking therefrom and every passenger on the pontoons shall obey all such reasonable directions as the collectors may think fit to give.

    14. The administration may at any time suspend the service of the ferry for any reason which may appear to render this course necessary or desirable.

    15. The toll fees specified in the Schedule shall be exhibited in a conspicuous place on the ferry landing.

THE UVINZA FERRY REGULATIONS

G.N. No. 19 of 1956

    1. These Regulations may be cited as the Uvinza Ferry Regulations.

    2. In these Regulations, unless the context otherwise requires–

    "administration" means the Engineer-in-Chief;

    "engineer" means the Regional Engineer, Kigoma Region, or his representative authorised in writing by the administration;

    "ferry" means the Uvinza Ferry and includes craft used in carrying on the ferry service;

    "licensee" means the holder of a licence under the Ferries Act * in respect of the Uvinza Public Ferry;

    "Nahodha" means the person appointed by the licensee to be in charge of the ferry;

    "toll collector" means the Nahodha or any person deputed by him to collect toll fees.

    3. The ferry shall be managed and carried on by the licensee by means of a pontoon or any other vessel provided by the administration.

    4. The ferry service shall be efficiently maintained daily throughout the year and shall make crossings of the Malagarasi River as and when required beginning at 7 a.m. and terminating at 7 p.m. and at such other times as the licensee may decide.

    5. (1) The ferry while under way shall at all times be under the charge and control of the Nahodha or, if present, the administration.

    (2) In addition to the Nahodha the crew of the pontoon shall consist of ten persons of whom not less than six shall be on duty at any one time.

    6. (1) The ferry craft in use shall at all times be kept clean, seaworthy and in good repair.

    (2) The ferry craft shall be inspected once in every six months by the Engineer and the licensee shall beach the ferry craft and carry out all reasonable instructions given by the Engineer for the purpose of such inspection and service fees shall be paid by the licensee.

    7. Each ferry craft shall be equipped with such life saving apparatus and fire extinguishing appliances as shall be considered necessary by the Engineer, and such apparatus and appliances shall be kept so as to be at all times fit and ready for use.

    8. (1) The maximum load which the ferry is permitted to carry shall be as follows–

    On a wooden pontoon ..................

    (2) There shall be exhibited by the licensee in a conspicuous place on the ferry craft a notice in English, and Kiswahili denoting the maximum load which such craft is permitted to carry.

    9. Any person crossing by the ferry who–

    (a)    refuses to pay the prescribed toll fee; or

    (b)    fraudulently or forcibly passes by the toll collector without paying the prescribed toll fee; or

    (c)    wilfully obstructs the toll collector or other person employed to work such ferry in the execution of their respective duties; or

    (d)    enters a ferry craft knowing that it contains its maximum load,

commits a breach of these Regulations and it shall be lawful for the Nahodha, any toll collector, member of the crew or Police constable forcibly to remove from the ferry any such person.

    10. The toll fees specified in the Schedule to these Regulations may be demanded by the toll collector from every person using the ferry, and it shall be lawful for the toll collector to refuse to carry any person or cattle or vehicle of any person on the ferry unless such person shall have paid the appropriate toll fee before entering or embarking his cattle or vehicle on the ferry.

    11. A toll collector shall not demand from any person more than the appropriate toll fee specified in the Schedule to these Regulations and he shall not refuse to take a passenger on the ferry except in the cases mentioned in regulations 9 and 10, or for some other reasonable cause.

    12. The table of toll fees shall be exhibited by the licensee in a conspicuous place on each ferry landing.

    13. No person in charge of any craft shall permit such craft to obstruct the working of the ferry.

    14. The Nahodha shall have sole authority to regulate the ferry service and to control the traffic thereon and every passenger shall obey all reasonable directions given by the Nahodha.

    15. Upon giving at least forty-eight hours' notice to persons using or likely to use the ferry as the Engineer considers necessary to bring to the notice of such persons, the licensee may, once in every two months, and for a period not exceeding forty-eight hours withdraw the pontoon from the ferry service for the purpose of servicing or repair.
