1. This Notice may be cited as the Appointment of Registrar and Assistant Registrars (Registrar-General's Office) Notice.
2. Every Senior Assistant Registrar and every Assistant Registrar in the Office of the Registrar-General is appointed to be–
(a) an Assistant Registrar-General of Births and Deaths under section 5 of the Births and Deaths Registration Act *;
(b) a Deputy Registrar under section 3 of the Business Names (Registration) Act *;
(c) an Assistant Registrar under–
(i) Section 3 of the Registration of Documents Act *;
(ii) Section 292 of the Companies Act *;
(iii) Section 2 of the Patents (Registration) Act *;
(iv) Section 4 of the Land Registration Act *;
(v) Section 4 of the Trade Unions Act *;
(vi) Section 4 of the Trade and Service Marks Act *.
3. The following are appointed for the purposes of the Chattels Transfer Act–
(a) the Registrar of Titles to be the Registrar; and
(b) every Assistant Registrar of Titles and Senior Registration Officer to be Assistant Registrars.

1. This Notice may be cited as the Authorised Persons (Attestation of Instruments) Notice.
2. The following persons or classes of persons are authorised to attest an instrument under the provisions of the Chattels Transfer Act–
(a) where the instrument is executed within the United Republic or in Kenya or Uganda –
A Judge of the High Court.
A Magistrate.
A Justice of the Peace.
An Advocate.
The Registrar appointed under the Act.
An Assistant Registrar appointed under the Act.
The Registrar of the High Court.
An Administrative Officer.
A Revenue Officer.
A Senior Land Assistant.
A Land Assistant.
The Administrator-General.
An Assistant Administrator-General.
(b) where the instrument is executed elsewhere than in the United Republic, Kenya or Uganda–
A Judge.

RULES
(Section 53)

1. Short title
These Rules may be cited as the Chattels Transfer Rules.
2. Attestation clause
Every person attesting the execution of an instrument or of a memorandum of satisfaction or of a transfer of an instrument shall sign an attestation clause in one of the forms contained in the First Schedule, whichever may be appropriate.
3. Forms to be used
The forms contained in the Second Schedule shall be used in all matters to which they refer.
4. Document to be written legibly in English on durable paper
Every affidavit, instrument, memorandum and transfer shall be clearly and legibly written, printed or typewritten in the English or Kiswahili languages on paper or parchment of durable quality measuring thirteen inches by eight inches and margins of one and a half inches along the top and binding edges of each sheet shall be left blank for use in the office of the Registrar.
5. Fees payable
(1) The fees set out in the third column of the Third Schedule shall be charged for the several matters set out opposite thereto in the second column of that Schedule.
(2) No fee shall be payable for any search or the issue of any copy required by any officer of the Government for official purposes.
