CHAPTER 78
AGRICULTURAL PRODUCTS (CONTROL OF MOVEMENT) ACT
An Act to provide for the control and regulation of movement of agricultural products under certain circumstances.
[7th November, 1966]
[G.N. No. 313 of 1966]
Act No. 3 of 1966
This Act may be cited as the Agricultural Products (Control of Movement) Act.
In this Act, unless the context otherwise requires–
"agricultural products" includes livestock and products derived from livestock but does not include meat, hides or skins, or horn or bone;
"Minister" means the Minister for the time being responsible for commerce.
3. Minister may control movement of agricultural products
When the Minister has reason to believe that a shortage of any agricultural product exists or is likely to occur in any district or any part of a district, he may, after consultation with the Minister for the time being responsible for regional administration, by order published in the Gazette, prohibit, restrict or regulate the removal of such agricultural product from the district or any part thereof.
4. Order to specify the period
Every order made under section 3 shall specify the period during which it is to remain effective and that the Minister may, after consultation as provided in section 3, time to time, by order published in the Gazette, extend the period of an order for such further period or periods as he may think necessary.
where the Minister has, by an order made under section 3, prohibited, restricted or regulated the movement of any agricultural product from any district or part of a district, any person who moves, or permits or causes to be moved, or attempts to move such agricultural product from the district or part of the district, as the case may be, in respect of which the order has been made in contravention of any of the terms of such order shall be guilty of an offence and shall be liable on conviction to a fine not exceeding two thousand shillings or to imprisonment for a term not exceeding six months or both.
